66 AN ACT
77 relating to a prohibition on certain law enforcement inquiries
88 regarding the nationality or immigration status of a victim of or
99 witness to a criminal offense.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Article 2.13, Code of Criminal Procedure, is
1212 amended by adding Subsection (d) to read as follows:
1313 (d) A peace officer may not inquire as to the nationality or
1414 immigration status of a victim of or witness to a criminal offense
1515 except as necessary to investigate the offense or to provide the
1616 victim or witness with information about federal visas designed to
1717 protect individuals providing assistance to law enforcement.
1818 SECTION 2. This Act takes effect immediately if it receives
1919 a vote of two-thirds of all the members elected to each house, as
2020 provided by Section 39, Article III, Texas Constitution. If this
2121 Act does not receive the vote necessary for immediate effect, this
2222 Act takes effect September 1, 2013.
