10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. The heading to Section 56.03, Family Code, is |
---|
12 | 12 | | amended to read as follows: |
---|
13 | 13 | | Sec. 56.03. APPEAL BY STATE [IN CASES OF VIOLENT OR HABITUAL |
---|
14 | 14 | | OFFENDER]. |
---|
15 | 15 | | SECTION 2. Section 56.03, Family Code, is amended by |
---|
16 | 16 | | amending Subsections (b), (c), (d), (e), and (f), and adding |
---|
17 | 17 | | Subsection (b-1) to read as follows: |
---|
18 | 18 | | (b) The state is entitled to appeal an order of a court in a |
---|
19 | 19 | | juvenile case [in which the grand jury has approved of the petition |
---|
20 | 20 | | under Section 53.045] if the order: |
---|
21 | 21 | | (1) dismisses a petition or any portion of a petition; |
---|
22 | 22 | | (2) arrests or modifies a judgment; |
---|
23 | 23 | | (3) grants a new trial; |
---|
24 | 24 | | (4) sustains a claim of former jeopardy; or |
---|
25 | 25 | | (5) grants a motion to suppress evidence, a |
---|
26 | 26 | | confession, or an admission and if: |
---|
27 | 27 | | (A) jeopardy has not attached in the case; |
---|
28 | 28 | | (B) the prosecuting attorney certifies to the |
---|
29 | 29 | | trial court that the appeal is not taken for the purpose of delay; |
---|
30 | 30 | | and |
---|
31 | 31 | | (C) the evidence, confession, or admission is of |
---|
32 | 32 | | substantial importance in the case. |
---|
33 | 33 | | (b-1) The state is entitled to appeal a disposition in a |
---|
34 | 34 | | case on the grounds that the disposition is illegal. |
---|
35 | 35 | | (c) The prosecuting attorney may not bring an appeal under |
---|
36 | 36 | | Subsection (b) or (b-1) later than the 15th day after the date on |
---|
37 | 37 | | which the order or ruling to be appealed is entered by the court. |
---|
38 | 38 | | (d) The state is entitled to a stay in the proceedings |
---|
39 | 39 | | pending the disposition of an appeal under Subsection (b) or (b-1). |
---|
40 | 40 | | (e) The court of appeals shall give preference in its docket |
---|
41 | 41 | | to an appeal filed under Subsection (b) or (b-1). |
---|
42 | 42 | | (f) The state shall pay all costs of appeal under Subsection |
---|
43 | 43 | | (b) or (b-1), other than the cost of attorney's fees for the |
---|
44 | 44 | | respondent. |
---|
45 | 45 | | SECTION 3. The changes in law made by this Act apply only to |
---|
46 | 46 | | conduct that occurs on or after the effective date of this Act. |
---|
47 | 47 | | Conduct that occurs before the effective date of this Act is covered |
---|
48 | 48 | | by the law in effect at the time the conduct occurred, and the |
---|
49 | 49 | | former law is continued in effect for that purpose. For the |
---|
50 | 50 | | purposes of this section, conduct occurs before the effective date |
---|
51 | 51 | | of this Act if any element of the conduct occurred before that date. |
---|
52 | 52 | | SECTION 4. This Act takes effect September 1, 2013. |
