77 relating to peace officers commissioned by the State Board of
88 Veterinary Medical Examiners.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 2.12, Code of Criminal Procedure, is
1111 amended to read as follows:
1212 Art. 2.12. WHO ARE PEACE OFFICERS. The following are peace
1313 officers:
1414 (1) sheriffs, their deputies, and those reserve
1515 deputies who hold a permanent peace officer license issued under
1616 Chapter 1701, Occupations Code;
1717 (2) constables, deputy constables, and those reserve
1818 deputy constables who hold a permanent peace officer license issued
1919 under Chapter 1701, Occupations Code;
2020 (3) marshals or police officers of an incorporated
2121 city, town, or village, and those reserve municipal police officers
2222 who hold a permanent peace officer license issued under Chapter
2323 1701, Occupations Code;
2424 (4) rangers and officers commissioned by the Public
2525 Safety Commission and the Director of the Department of Public
2626 Safety;
2727 (5) investigators of the district attorneys', criminal
2828 district attorneys', and county attorneys' offices;
2929 (6) law enforcement agents of the Texas Alcoholic
3030 Beverage Commission;
3131 (7) each member of an arson investigating unit
3232 commissioned by a city, a county, or the state;
3333 (8) officers commissioned under Section 37.081,
3434 Education Code, or Subchapter E, Chapter 51, Education Code;
3535 (9) officers commissioned by the General Services
3636 Commission;
3737 (10) law enforcement officers commissioned by the
3838 Parks and Wildlife Commission;
3939 (11) airport police officers commissioned by a city
4040 with a population of more than 1.18 million located primarily in a
4141 county with a population of 2 million or more that operates an
4242 airport that serves commercial air carriers;
4343 (12) airport security personnel commissioned as peace
4444 officers by the governing body of any political subdivision of this
4545 state, other than a city described by Subdivision (11), that
4646 operates an airport that serves commercial air carriers;
4747 (13) municipal park and recreational patrolmen and
4848 security officers;
4949 (14) security officers and investigators commissioned
5050 as peace officers by the comptroller;
5151 (15) officers commissioned by a water control and
5252 improvement district under Section 49.216, Water Code;
5353 (16) officers commissioned by a board of trustees
5454 under Chapter 54, Transportation Code;
5555 (17) investigators commissioned by the Texas Medical
5656 Board;
5757 (18) officers commissioned by:
5858 (A) the board of managers of the Dallas County
5959 Hospital District, the Tarrant County Hospital District, the Bexar
6060 County Hospital District, or the El Paso County Hospital District
6161 under Section 281.057, Health and Safety Code; and
6262 (B) the board of directors of the Ector County
6363 Hospital District under Section 1024.117, Special District Local
6464 Laws Code;
6565 (19) county park rangers commissioned under
6666 Subchapter E, Chapter 351, Local Government Code;
6767 (20) investigators employed by the Texas Racing
6868 Commission;
6969 (21) officers commissioned under Chapter 554,
7070 Occupations Code;
7171 (22) officers commissioned by the governing body of a
7272 metropolitan rapid transit authority under Section 451.108,
7373 Transportation Code, or by a regional transportation authority
7474 under Section 452.110, Transportation Code;
7575 (23) investigators commissioned by the attorney
7676 general under Section 402.009, Government Code;
7777 (24) security officers and investigators commissioned
7878 as peace officers under Chapter 466, Government Code;
7979 (25) an officer employed by the Department of State
8080 Health Services under Section 431.2471, Health and Safety Code;
8181 (26) officers appointed by an appellate court under
8282 Subchapter F, Chapter 53, Government Code;
8383 (27) officers commissioned by the state fire marshal
8484 under Chapter 417, Government Code;
8585 (28) an investigator commissioned by the commissioner
8686 of insurance under Section 701.104, Insurance Code;
8787 (29) apprehension specialists and inspectors general
8888 commissioned by the Texas Juvenile Justice Department as officers
8989 under Sections 242.102 and 243.052, Human Resources Code;
9090 (30) officers appointed by the inspector general of
9191 the Texas Department of Criminal Justice under Section 493.019,
9292 Government Code;
9393 (31) investigators commissioned by the Commission on
9494 Law Enforcement Officer Standards and Education under Section
9595 1701.160, Occupations Code;
9696 (32) commission investigators commissioned by the
9797 Texas Private Security Board under Section 1702.061(f),
9898 Occupations Code;
9999 (33) the fire marshal and any officers, inspectors, or
100100 investigators commissioned by an emergency services district under
101101 Chapter 775, Health and Safety Code;
102102 (34) officers commissioned by the State Board of
103103 Dental Examiners under Section 254.013, Occupations Code, subject
104104 to the limitations imposed by that section;
105105 (35) investigators commissioned by the Texas Juvenile
106106 Justice Department as officers under Section 221.011, Human
107107 Resources Code; [and]
108108 (36) the fire marshal and any related officers,
109109 inspectors, or investigators commissioned by a county under
110110 Subchapter B, Chapter 352, Local Government Code; and
111111 (37) officers commissioned by the State Board of
112112 Veterinary Medical Examiners under Section 801.163, Occupations
113113 Code.
114114 SECTION 2. Subchapter D, Chapter 801, Occupations Code, is
115115 amended by adding Section 801.163 to read as follows:
116116 Sec. 801.163. PEACE OFFICERS. (a) The board may commission
117117 as a peace officer to enforce this chapter an employee who has been
118118 certified as qualified to be a peace officer by the Commission on
119119 Law Enforcement Officer Standards and Education.
120120 (b) An employee commissioned as a peace officer under this
121121 chapter has the powers, privileges, and immunities of a peace
122122 officer while carrying out duties as a peace officer under this
123123 chapter.
124124 SECTION 3. This Act takes effect immediately if it receives
125125 a vote of two-thirds of all the members elected to each house, as
126126 provided by Section 39, Article III, Texas Constitution. If this
127127 Act does not receive the vote necessary for immediate effect, this
128128 Act takes effect September 1, 2013.
