A BILL TO BE ENTITLED
AN ACT
relating to the intersection of a free road and a toll road.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Chapter 372, Transportation Code, is amended by
adding Subchapter C to read as follows:
SUBCHAPTER C. INTERSECTION OF TOLL PROJECT AND FREE ROAD
Sec. 372.101. DEFINITION. In this subchapter, "free road"
includes a street or public highway.
Sec. 372.102. CONSTRUCTION OF TOLL PROJECT. A toll project
entity may not construct a toll project that intersects with a free
road unless the toll project is constructed or a traffic control
signal is used in a manner that allows traffic on the free road to
flow freely without yielding or stopping for toll project traffic.
SECTION 2. This Act applies only to construction of a toll
project, as defined by Section 372.001, Transportation Code that
begins on or after the effective date of this Act. A toll project
the construction of which begins before the effective date of this
Act is governed by the law in effect on the date of the beginning of
the construction, and the former law is continued in effect for that
purpose.
SECTION 3. This Act takes effect September 1, 2013.
