| 9 | 9 | SECTION 1. Subchapter H, Chapter 201, Transportation Code, | |
| 10 | 10 | is amended by adding Section 201.623 to read as follows: | |
| 11 | 11 | Sec. 201.623. CONSTRUCTION OF DETENTION PONDS. In the | |
| 12 | 12 | construction of detention ponds associated with its highway | |
| 13 | 13 | projects, the department shall consider: | |
| 14 | 14 | (1) using a permeable surface for the detention pond; | |
| 15 | 15 | and | |
| 16 | 16 | (2) completing the detention pond so that its finished | |
| 17 | 17 | state would enable it to be used as green space, available for use | |
| 18 | 18 | by wildlife or the general public. | |
| 19 | 19 | SECTION 2. This Act takes effect September 1, 2013. |
