9 | 9 | | housing tax credit is scored. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Sec. 2306.6710(b) of the Government Code is |
---|
12 | 12 | | amended as follows: |
---|
13 | 13 | | (b) If an application satisfies the threshold criteria, the |
---|
14 | 14 | | department shall score and rank the application using a point |
---|
15 | 15 | | sys |
---|
16 | 16 | | tem that: |
---|
17 | 17 | | (1) prioritizes in descending order criteria regarding: |
---|
18 | 18 | | (A) financial feasibility of the development based on the |
---|
19 | 19 | | supporting financial data required in the application that will |
---|
20 | 20 | | include a project underwriting pro forma from the permanent or |
---|
21 | 21 | | construction lender; |
---|
22 | 22 | | (B) quantifiable community participation with respect to |
---|
23 | 23 | | the development, evaluated on the basis of written statements from |
---|
24 | 24 | | any neighborhood organizations on record with the state or county |
---|
25 | 25 | | in which the development is to be located and whose boundaries |
---|
26 | 26 | | contain the proposed development site; |
---|
27 | 27 | | (C) the income levels of tenants of the development; |
---|
28 | 28 | | (D) the size and quality of the units; |
---|
29 | 29 | | (E) the commitment of development funding by local |
---|
30 | 30 | | political subdivisions; |
---|
31 | 31 | | (F) the level of community support for the application, |
---|
32 | 32 | | evaluated on the basis of written statements from the state |
---|
33 | 33 | | representative or the state senator that represents the district |
---|
34 | 34 | | containing the proposed development site; |
---|
35 | 35 | | (G) the rent levels of the units; |
---|
36 | 36 | | (H) the cost of the development by square foot; |
---|
37 | 37 | | (I) the services to be provided to tenants of the |
---|
38 | 38 | | development; and |
---|
39 | 39 | | (J) whether, at the time the complete application is |
---|
40 | 40 | | submitted or at any time within the two-year period preceding the |
---|
41 | 41 | | date of submission, the proposed development site is located in an |
---|
42 | 42 | | area declared to be a disaster under Section 418.014; |
---|
43 | 43 | | (K) in a county with a population of 4.1 million or more, |
---|
44 | 44 | | whether the development will be located in a high opportunity area, |
---|
45 | 45 | | where the opportunity index of an area is determined by considering |
---|
46 | 46 | | walking access from the development to rail transit or a transit |
---|
47 | 47 | | center, walking access from the development to an employment |
---|
48 | 48 | | center, or the income level of the census tract. The department |
---|
49 | 49 | | shall consider each of these criteria at the same level or priority; |
---|
50 | 50 | | SECTION 2. This Act takes effect September 1, 2013. |
