88 relating to the system by which an application for a low income
99 housing tax credit is scored.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sec. 2306.6710(b) of the Government Code is
1212 amended as follows:
1313 (b) If an application satisfies the threshold criteria, the
1414 department shall score and rank the application using a point
1515 sys
1616 tem that:
1717 (1) prioritizes in descending order criteria regarding:
1818 (A) financial feasibility of the development based on the
1919 supporting financial data required in the application that will
2020 include a project underwriting pro forma from the permanent or
2121 construction lender;
2222 (B) quantifiable community participation with respect to
2323 the development, evaluated on the basis of written statements from
2424 any neighborhood organizations on record with the state or county
2525 in which the development is to be located and whose boundaries
2626 contain the proposed development site;
2727 (C) the income levels of tenants of the development;
2828 (D) the size and quality of the units;
2929 (E) the commitment of development funding by local
3030 political subdivisions;
3131 (F) the level of community support for the application,
3232 evaluated on the basis of written statements from the state
3333 representative or the state senator that represents the district
3434 containing the proposed development site;
3535 (G) the rent levels of the units;
3636 (H) the cost of the development by square foot;
3737 (I) the services to be provided to tenants of the
3838 development; and
3939 (J) whether, at the time the complete application is
4040 submitted or at any time within the two-year period preceding the
4141 date of submission, the proposed development site is located in an
4242 area declared to be a disaster under Section 418.014;
4343 (K) in a county with a population of 4.1 million or more,
4444 whether the development will be located in a high opportunity area,
4545 where the opportunity index of an area is determined by considering
4646 walking access from the development to rail transit or a transit
4747 center, walking access from the development to an employment
4848 center, or the income level of the census tract. The department
4949 shall consider each of these criteria at the same level or priority;
5050 SECTION 2. This Act takes effect September 1, 2013.
