99 AN ACT
1010 relating to the determination of an applicant's eligibility for any
1111 program administered by the Health and Human Services Commission.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Sections 521.044(a) and (c), Transportation
1414 Code, are amended to read as follows:
1515 (a) Information provided on a driver's license application
1616 that relates to the applicant's social security number may be used
1717 only by the department or disclosed only to:
1818 (1) the child support enforcement division of the
1919 attorney general's office;
2020 (2) another state entity responsible for enforcing the
2121 payment of child support;
2222 (3) the United States Selective Service System as
2323 provided by Section 521.147; [or]
2424 (4) the unclaimed property division of the
2525 comptroller's office; or
2626 (5) the Health and Human Services Commission.
2727 (c)(1) On the request of a state entity responsible for
2828 investigating or enforcing the payment of child support, the
2929 department shall disclose information regarding an applicant's
3030 social security number.
3131 (2) On the request of the Health and Human Services
3232 Commission and for the purpose of assisting the commission in
3333 determining an applicant's eligibility for any program
3434 administered by the commission, the department shall disclose
3535 information regarding an applicant's social security number.
3636 SECTION 2. If before implementing any provision of this Act
3737 a state agency determines that a waiver or authorization from a
3838 federal agency is necessary for implementation of that provision,
3939 the agency affected by the provision shall request the waiver or
4040 authorization and may delay implementing that provision until the
4141 waiver or authorization is granted.
4242 SECTION 3. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect September 1, 2013.
