66 AN ACT
77 relating to the composition of the board of directors of the Fort
88 Bend Subsidence District.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 8834.051, Special District Local Laws
1111 Code, is amended by amending Subsections (a) and (d) and adding
1212 Subsections (h) and (i) to read as follows:
1313 (a) The district is governed by a board of 15 [13] directors
1414 appointed as provided by this section.
1515 (d) The persons designated by Subsections (e), (f), [and]
1616 (g), and (h) shall appoint directors in January to fill vacancies
1717 caused by the expiration of directors' terms. The district shall
1818 mail notice regarding the necessity of an appointment to the
1919 persons designated by Subsections (e), (f), [and] (g), and (h) not
2020 later than the 20th day before the date of the board's January
2121 meeting.
2222 (h) The board of directors of the North Fort Bend Water
2323 Authority shall appoint two directors.
2424 (i) The directors shall serve staggered terms as follows:
2525 (1) five members appointed under Subsection (e) and
2626 four members appointed under Subsection (f) shall serve terms
2727 expiring on January 1 of odd-numbered years; and
2828 (2) one member appointed under Subsection (e), two
2929 members appointed under Subsection (f), one member appointed under
3030 Subsection (g), and two members appointed under Subsection (h)
3131 shall serve terms expiring on January 1 of even-numbered years.
3232 SECTION 2. As soon as practicable after the effective date
3333 of this Act, the board of directors of the North Fort Bend Water
3434 Authority shall appoint two members of the board of directors of the
3535 Fort Bend Subsidence District as provided by Section 8834.051,
3636 Special District Local Laws Code, as amended by this Act.
3737 SECTION 3. The Fort Bend Subsidence District retains all
3838 the rights, powers, privileges, authority, duties, and functions
3939 that it had before the effective date of this Act.
4040 SECTION 4. (a) The legal notice of the intention to
4141 introduce this Act, setting forth the general substance of this
4242 Act, has been published as provided by law, and the notice and a
4343 copy of this Act have been furnished to all persons, agencies,
4444 officials, or entities to which they are required to be furnished
4545 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
4646 Government Code.
4747 (b) The governor, one of the required recipients, has
4848 submitted the notice and Act to the Texas Commission on
4949 Environmental Quality.
5050 (c) The Texas Commission on Environmental Quality has filed
5151 its recommendations relating to this Act with the governor, the
5252 lieutenant governor, and the speaker of the house of
5353 representatives within the required time.
5454 (d) All requirements of the constitution and laws of this
5555 state and the rules and procedures of the legislature with respect
5656 to the notice, introduction, and passage of this Act are fulfilled
5757 and accomplished.
5858 SECTION 5. This Act takes effect immediately if it receives
5959 a vote of two-thirds of all the members elected to each house, as
6060 provided by Section 39, Article III, Texas Constitution. If this
6161 Act does not receive the vote necessary for immediate effect, this
6262 Act takes effect September 1, 2013.
