7	7	relating to the composition of the board of directors of the Fort
8	8	Bend Subsidence District.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 8834.051, Special District Local Laws
11	11	Code, is amended by amending Subsections (a) and (d) and adding
12	12	Subsections (h) and (i) to read as follows:
13	13	(a) The district is governed by a board of 15 [13] directors
14	14	appointed as provided by this section.
15	15	(d) The persons designated by Subsections (e), (f), [and]
16	16	(g), and (h) shall appoint directors in January to fill vacancies
17	17	caused by the expiration of directors' terms. The district shall
18	18	mail notice regarding the necessity of an appointment to the
19	19	persons designated by Subsections (e), (f), [and] (g), and (h) not
20	20	later than the 20th day before the date of the board's January
21	21	meeting.
22	22	(h) The board of directors of the North Fort Bend Water
23	23	Authority shall appoint two directors.
24	24	(i) The directors shall serve staggered terms as follows:
25	25	(1) five members appointed under Subsection (e) and
26	26	four members appointed under Subsection (f) shall serve terms
27	27	expiring on January 1 of odd-numbered years; and
28	28	(2) one member appointed under Subsection (e), two
29	29	members appointed under Subsection (f), one member appointed under
30	30	Subsection (g), and two members appointed under Subsection (h)
31	31	shall serve terms expiring on January 1 of even-numbered years.
32	32	SECTION 2. As soon as practicable after the effective date
33	33	of this Act, the board of directors of the North Fort Bend Water
34	34	Authority shall appoint two members of the board of directors of the
35	35	Fort Bend Subsidence District as provided by Section 8834.051,
36	36	Special District Local Laws Code, as amended by this Act.
37	37	SECTION 3. The Fort Bend Subsidence District retains all
38	38	the rights, powers, privileges, authority, duties, and functions
39	39	that it had before the effective date of this Act.
40	40	SECTION 4. (a) The legal notice of the intention to
41	41	introduce this Act, setting forth the general substance of this
42	42	Act, has been published as provided by law, and the notice and a
43	43	copy of this Act have been furnished to all persons, agencies,
44	44	officials, or entities to which they are required to be furnished
45	45	under Section 59, Article XVI, Texas Constitution, and Chapter 313,
46	46	Government Code.
47	47	(b) The governor, one of the required recipients, has
48	48	submitted the notice and Act to the Texas Commission on
49	49	Environmental Quality.
50	50	(c) The Texas Commission on Environmental Quality has filed
51	51	its recommendations relating to this Act with the governor, the
52	52	lieutenant governor, and the speaker of the house of
53	53	representatives within the required time.
54	54	(d) All requirements of the constitution and laws of this
55	55	state and the rules and procedures of the legislature with respect
56	56	to the notice, introduction, and passage of this Act are fulfilled
57	57	and accomplished.
58	58	SECTION 5. This Act takes effect immediately if it receives
59	59	a vote of two-thirds of all the members elected to each house, as
60	60	provided by Section 39, Article III, Texas Constitution. If this
61	61	Act does not receive the vote necessary for immediate effect, this
62	62	Act takes effect September 1, 2013.
