 A BILL TO BE ENTITLED
 AN ACT
 relating to the creation of a pilot program for the identification
 and treatment of a concussion suffered by a student athlete.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Chapter 38, Education Code, is amended by adding
 Subchapter E to read as follows:
 SUBCHAPTER E.  SPORTS INSURANCE MANAGEMENT PILOT PROGRAM
 Sec. 38.201.  SPORTS INSURANCE MANAGEMENT PILOT PROGRAM.
 (a)  The Texas Education Agency shall establish a Sports Injury
 Pilot Program to administer a concussion-testing insurance program
 for students participating in University Interscholastic League
 programs.  The commissioner shall select the school districts that
 would initially participate in the pilot program.  Prior to
 December 31, 2014, the commissioner shall submit a report on the
 findings of the program to the Legislative Budget Board and the
 Governor.
 (b)  The program shall include:
 (1)  return to play protocol inclusive of preseason
 neurocognitive baseline testing,
 (2)  post injury neurocognitive testing,
 (3)
 access to a physician(s) trained in the diagnosis
 and management of a concussion, and
 (4)  an excess accident insurance policy that is
 designed to cover the expenses related to the diagnosis and
 management of concussion
 SECTION 2.  This Act takes effect on September 1, 2013.
