99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the dissolution of the Lipan Creek Flood Control
1212 District.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. On the effective date of this Act:
1515 (1) the Lipan Creek Flood Control District is
1616 dissolved;
1717 (2) the terms of the directors of the district expire;
1818 and
1919 (3) any assets of the district, including any tax or
2020 assessment revenue, that remain after payment of the district's
2121 liabilities are transferred to Concho and Tom Green Counties, in
2222 the proportion that the area of each county located in the territory
2323 of the district bears to the total area of the district.
2424 SECTION 2. The following laws are repealed:
2525 (1) Chapter 628, Acts of the 59th Legislature, Regular
2626 Session, 1965; and
2727 (2) Chapter 473, Acts of the 67th Legislature, Regular
2828 Session, 1981.
2929 SECTION 3. (a) The legal notice of the intention to
3030 introduce this Act, setting forth the general substance of this
3131 Act, has been published as provided by law, and the notice and a
3232 copy of this Act have been furnished to all persons, agencies,
3333 officials, or entities to which they are required to be furnished
3434 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
3535 Government Code.
3636 (b) The governor, one of the required recipients, has
3737 submitted the notice and Act to the Texas Commission on
3838 Environmental Quality.
3939 (c) The Texas Commission on Environmental Quality has filed
4040 its recommendations relating to this Act with the governor, the
4141 lieutenant governor, and the speaker of the house of
4242 representatives within the required time.
4343 (d) All requirements of the constitution and laws of this
4444 state and the rules and procedures of the legislature with respect
4545 to the notice, introduction, and passage of this Act are fulfilled
4646 and accomplished.
4747 SECTION 4. This Act takes effect immediately if it receives
4848 a vote of two-thirds of all the members elected to each house, as
4949 provided by Section 39, Article III, Texas Constitution. If this
5050 Act does not receive the vote necessary for immediate effect, this
5151 Act takes effect September 1, 2013.
