13 | 13 | | SECTION 1. Subtitle C, Title 4, Special District Local Laws |
---|
14 | 14 | | Code, is amended by adding Chapter 3924 to read as follows: |
---|
15 | 15 | | CHAPTER 3924. ONION CREEK METRO PARK DISTRICT |
---|
16 | 16 | | SUBCHAPTER A. GENERAL PROVISIONS |
---|
17 | 17 | | Sec. 3924.001. DEFINITIONS. In this chapter: |
---|
18 | 18 | | (1) "Board" means the district's board of directors. |
---|
19 | 19 | | (2) "City" means the City of Austin. |
---|
20 | 20 | | (3) "County" means Travis County. |
---|
21 | 21 | | (4) "Director" means a board member. |
---|
22 | 22 | | (5) "District" means the Onion Creek Metro Park |
---|
23 | 23 | | District. |
---|
24 | 24 | | Sec. 3924.002. NATURE OF DISTRICT. The Onion Creek Metro |
---|
25 | 25 | | Park District is a special district created under Section 59, |
---|
26 | 26 | | Article XVI, Texas Constitution. |
---|
27 | 27 | | Sec. 3924.003. PURPOSE; DECLARATION OF INTENT. (a) The |
---|
28 | 28 | | creation of the district is essential to accomplish the purposes of |
---|
29 | 29 | | Sections 52 and 52-a, Article III, and Section 59, Article XVI, |
---|
30 | 30 | | Texas Constitution, and other public purposes stated in this |
---|
31 | 31 | | chapter. By creating the district and in authorizing the city, the |
---|
32 | 32 | | county, and other political subdivisions to contract with the |
---|
33 | 33 | | district, the legislature has established a program to accomplish |
---|
34 | 34 | | the public purposes set out in Section 52-a, Article III, Texas |
---|
35 | 35 | | Constitution. |
---|
36 | 36 | | (b) The creation of the district is necessary to promote, |
---|
37 | 37 | | develop, encourage, and maintain employment, commerce, |
---|
38 | 38 | | transportation, housing, tourism, recreation, the arts, |
---|
39 | 39 | | entertainment, economic development, safety, and the public |
---|
40 | 40 | | welfare in the district. |
---|
41 | 41 | | (c) This chapter and the creation of the district may not be |
---|
42 | 42 | | interpreted to relieve the city or the county from providing the |
---|
43 | 43 | | level of services provided as of the effective date of the Act |
---|
44 | 44 | | enacting this chapter. The district is created to supplement and |
---|
45 | 45 | | not to supplant city or county services provided in the district. |
---|
46 | 46 | | Sec. 3924.004. CONFIRMATION ELECTION REQUIRED. The initial |
---|
47 | 47 | | directors shall hold an election to confirm the creation of the |
---|
48 | 48 | | district as provided by Section 49.102, Water Code. |
---|
49 | 49 | | Sec. 3924.005. CONSENT OF MUNICIPALITY REQUIRED. (a) The |
---|
50 | 50 | | initial directors may not hold an election under Section 3924.004 |
---|
51 | 51 | | until the city has consented by ordinance or resolution to the |
---|
52 | 52 | | creation of the district and to the inclusion of land in the |
---|
53 | 53 | | district. |
---|
54 | 54 | | (b) If the city does not consent to the creation of the |
---|
55 | 55 | | district and to the inclusion of land in the district before |
---|
56 | 56 | | September 1, 2014: |
---|
57 | 57 | | (1) the district is dissolved September 1, 2014, |
---|
58 | 58 | | except that: |
---|
59 | 59 | | (A) any debts incurred shall be paid; |
---|
60 | 60 | | (B) any assets that remain after the payment of |
---|
61 | 61 | | debts shall be transferred to the city or another local |
---|
62 | 62 | | governmental entity to be used for a public purpose; and |
---|
63 | 63 | | (C) the organization of the district shall be |
---|
64 | 64 | | maintained until all debts are paid and remaining assets are |
---|
65 | 65 | | transferred; and |
---|
66 | 66 | | (2) this chapter, including Section 3924.055, expires |
---|
67 | 67 | | September 1, 2014. |
---|
68 | 68 | | (c) In addition to the requirements prescribed by |
---|
69 | 69 | | Subsection (a), the ordinance or resolution described by Subsection |
---|
70 | 70 | | (a): |
---|
71 | 71 | | (1) must specify the qualifications for persons to be |
---|
72 | 72 | | eligible to serve as permanent directors; and |
---|
73 | 73 | | (2) may limit the number of terms a director may serve. |
---|
74 | 74 | | Sec. 3924.006. FINDINGS OF BENEFIT AND PUBLIC PURPOSE. (a) |
---|
75 | 75 | | The district is created to serve a public use and benefit. |
---|
76 | 76 | | (b) All land and other property included in the district |
---|
77 | 77 | | will benefit from the improvements and services to be provided by |
---|
78 | 78 | | the district under powers conferred by Sections 52 and 52-a, |
---|
79 | 79 | | Article III, and Section 59, Article XVI, Texas Constitution, and |
---|
80 | 80 | | other powers granted under this chapter. |
---|
81 | 81 | | (c) The creation of the district is in the public interest |
---|
82 | 82 | | and is essential to further the public purposes of: |
---|
83 | 83 | | (1) developing and diversifying the economy of the |
---|
84 | 84 | | state; |
---|
85 | 85 | | (2) eliminating unemployment and underemployment; and |
---|
86 | 86 | | (3) developing or expanding transportation and |
---|
87 | 87 | | commerce. |
---|
88 | 88 | | (d) The district will: |
---|
89 | 89 | | (1) promote the health, safety, and general welfare of |
---|
90 | 90 | | residents, employers, potential employees, employees, visitors, |
---|
91 | 91 | | and consumers in the district, and of the public; |
---|
92 | 92 | | (2) provide needed funding for the district to |
---|
93 | 93 | | preserve, maintain, and enhance the economic health and vitality of |
---|
94 | 94 | | the district territory as a community and business center; |
---|
95 | 95 | | (3) promote the health, safety, welfare, and enjoyment |
---|
96 | 96 | | of the public by providing pedestrian ways and by landscaping and |
---|
97 | 97 | | developing certain areas in the district, which are necessary for |
---|
98 | 98 | | the restoration, preservation, and enhancement of scenic beauty; |
---|
99 | 99 | | and |
---|
100 | 100 | | (4) provide for water, wastewater, drainage, road, and |
---|
101 | 101 | | recreational facilities for the district. |
---|
102 | 102 | | (e) Pedestrian ways along or across a street, whether at |
---|
103 | 103 | | grade or above or below the surface, and street lighting, street |
---|
104 | 104 | | landscaping, parking, and street art objects are parts of and |
---|
105 | 105 | | necessary components of a street and are considered to be a street |
---|
106 | 106 | | or road improvement. |
---|
107 | 107 | | (f) The district will not act as the agent or |
---|
108 | 108 | | instrumentality of any private interest even though the district |
---|
109 | 109 | | will benefit many private interests as well as the public. |
---|
110 | 110 | | Sec. 3924.007. INITIAL DISTRICT TERRITORY. (a) The |
---|
111 | 111 | | district is initially composed of the territory described by |
---|
112 | 112 | | Section 2 of the Act enacting this chapter. |
---|
113 | 113 | | (b) The boundaries and field notes contained in Section 2 of |
---|
114 | 114 | | the Act enacting this chapter form a closure. A mistake in the |
---|
115 | 115 | | field notes or in copying the field notes in the legislative process |
---|
116 | 116 | | does not affect the district's: |
---|
117 | 117 | | (1) organization, existence, or validity; |
---|
118 | 118 | | (2) right to issue any type of bonds for the purposes |
---|
119 | 119 | | for which the district is created or to pay the principal of and |
---|
120 | 120 | | interest on the bonds; |
---|
121 | 121 | | (3) right to impose or collect an assessment or tax; or |
---|
122 | 122 | | (4) legality or operation. |
---|
123 | 123 | | Sec. 3924.008. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES. |
---|
124 | 124 | | All or any part of the area of the district is eligible to be |
---|
125 | 125 | | included in: |
---|
126 | 126 | | (1) a tax abatement reinvestment zone created under |
---|
127 | 127 | | Chapter 312, Tax Code; or |
---|
128 | 128 | | (2) an enterprise zone created under Chapter 2303, |
---|
129 | 129 | | Government Code. |
---|
130 | 130 | | Sec. 3924.009. APPLICABILITY OF MUNICIPAL MANAGEMENT |
---|
131 | 131 | | DISTRICTS LAW. Except as otherwise provided by this chapter, |
---|
132 | 132 | | Chapter 375, Local Government Code, applies to the district. |
---|
133 | 133 | | Sec. 3924.010. CONSTRUCTION OF CHAPTER. This chapter shall |
---|
134 | 134 | | be liberally construed in conformity with the findings and purposes |
---|
135 | 135 | | stated in this chapter. |
---|
136 | 136 | | SUBCHAPTER B. BOARD OF DIRECTORS |
---|
137 | 137 | | Sec. 3924.051. GOVERNING BODY; TERMS. (a) The district is |
---|
138 | 138 | | governed by a board of seven voting directors who serve staggered |
---|
139 | 139 | | terms of four years, with three or four directors' terms expiring |
---|
140 | 140 | | June 1 of each odd-numbered year. |
---|
141 | 141 | | (b) The qualifications of the permanent directors must |
---|
142 | 142 | | comply with those established in the ordinance or resolution under |
---|
143 | 143 | | Section 3924.005(c)(1). |
---|
144 | 144 | | (c) The board by resolution may change the number of voting |
---|
145 | 145 | | directors on the board if the board determines that the change is in |
---|
146 | 146 | | the best interest of the district and the city approves the change. |
---|
147 | 147 | | The board may not consist of fewer than 7 or more than 15 voting |
---|
148 | 148 | | directors. |
---|
149 | 149 | | Sec. 3924.052. APPOINTMENT OF VOTING DIRECTORS. The |
---|
150 | 150 | | governing body of the city shall appoint the voting directors. A |
---|
151 | 151 | | person is appointed if a majority of the members of the governing |
---|
152 | 152 | | body vote to appoint that person. |
---|
153 | 153 | | Sec. 3924.053. QUORUM. For purposes of determining the |
---|
154 | 154 | | requirements for a quorum of the board, the following are not |
---|
155 | 155 | | counted: |
---|
156 | 156 | | (1) a board position vacant for any reason, including |
---|
157 | 157 | | death, resignation, or disqualification; or |
---|
158 | 158 | | (2) a director who is abstaining from participation in |
---|
159 | 159 | | a vote because of a conflict of interest. |
---|
160 | 160 | | Sec. 3924.054. COMPENSATION. A director is entitled to |
---|
161 | 161 | | receive fees of office and reimbursement for actual expenses as |
---|
162 | 162 | | provided by Section 49.060, Water Code. Sections 375.069 and |
---|
163 | 163 | | 375.070, Local Government Code, do not apply to the board. |
---|
164 | 164 | | Sec. 3924.055. INITIAL VOTING DIRECTORS. (a) The initial |
---|
165 | 165 | | board consists of the following voting directors: |

188 | 188 | | SUBCHAPTER C. POWERS AND DUTIES |
---|
189 | 189 | | Sec. 3924.101. GENERAL POWERS AND DUTIES. The district has |
---|
190 | 190 | | the powers and duties necessary to accomplish the purposes for |
---|
191 | 191 | | which the district is created. |
---|
192 | 192 | | Sec. 3924.102. IMPROVEMENT PROJECTS AND SERVICES. The |
---|
193 | 193 | | district may provide, design, construct, acquire, improve, |
---|
194 | 194 | | relocate, operate, maintain, or finance an improvement project or |
---|
195 | 195 | | service using any money available to the district, or contract with |
---|
196 | 196 | | a governmental or private entity to provide, design, construct, |
---|
197 | 197 | | acquire, improve, relocate, operate, maintain, or finance an |
---|
198 | 198 | | improvement project or service authorized under this chapter or |
---|
199 | 199 | | Chapter 375, Local Government Code. |
---|
200 | 200 | | Sec. 3924.103. LOCATION OF IMPROVEMENT PROJECT. An |
---|
201 | 201 | | improvement project described by Section 3924.102 may be located: |
---|
202 | 202 | | (1) in the district; or |
---|
203 | 203 | | (2) in an area outside the district if the board |
---|
204 | 204 | | determines that the project benefits the district. |
---|
205 | 205 | | Sec. 3924.104. DEVELOPMENT CORPORATION POWERS. The |
---|
206 | 206 | | district, using money available to the district, may exercise the |
---|
207 | 207 | | powers given to a development corporation under Chapter 505, Local |
---|
208 | 208 | | Government Code, including the power to own, operate, acquire, |
---|
209 | 209 | | construct, lease, improve, or maintain a project under that |
---|
210 | 210 | | chapter. |
---|
211 | 211 | | Sec. 3924.105. NONPROFIT CORPORATION. (a) The board by |
---|
212 | 212 | | resolution may authorize the creation of a nonprofit corporation to |
---|
213 | 213 | | assist and act for the district in implementing a project or |
---|
214 | 214 | | providing a service authorized by this chapter. |
---|
215 | 215 | | (b) The nonprofit corporation: |
---|
216 | 216 | | (1) has each power of and is considered to be a local |
---|
217 | 217 | | government corporation created under Subchapter D, Chapter 431, |
---|
218 | 218 | | Transportation Code; and |
---|
219 | 219 | | (2) may implement any project and provide any service |
---|
220 | 220 | | authorized by this chapter. |
---|
221 | 221 | | (c) The board shall appoint the board of directors of the |
---|
222 | 222 | | nonprofit corporation. The board of directors of the nonprofit |
---|
223 | 223 | | corporation shall serve in the same manner as the board of directors |
---|
224 | 224 | | of a local government corporation created under Subchapter D, |
---|
225 | 225 | | Chapter 431, Transportation Code, except that a board member is not |
---|
226 | 226 | | required to reside in the district. |
---|
227 | 227 | | Sec. 3924.106. AGREEMENTS; GRANTS. (a) As provided by |
---|
228 | 228 | | Chapter 375, Local Government Code, the district may make an |
---|
229 | 229 | | agreement with or accept a gift, grant, or loan from any person. |
---|
230 | 230 | | (b) The implementation of a project is a governmental |
---|
231 | 231 | | function or service for the purposes of Chapter 791, Government |
---|
232 | 232 | | Code. |
---|
233 | 233 | | Sec. 3924.107. LAW ENFORCEMENT SERVICES. To protect the |
---|
234 | 234 | | public interest, the district may contract with a qualified party, |
---|
235 | 235 | | including the county or the city, to provide law enforcement |
---|
236 | 236 | | services for a fee. |
---|
237 | 237 | | Sec. 3924.108. MEMBERSHIP IN CHARITABLE ORGANIZATIONS. The |
---|
238 | 238 | | district may join and pay dues to a charitable or nonprofit |
---|
239 | 239 | | organization that performs a service or provides an activity |
---|
240 | 240 | | consistent with the furtherance of a district purpose. |
---|
241 | 241 | | Sec. 3924.109. ECONOMIC DEVELOPMENT. (a) The district may |
---|
242 | 242 | | engage in activities that accomplish the economic development |
---|
243 | 243 | | purposes of the district. |
---|
244 | 244 | | (b) The district may establish and provide for the |
---|
245 | 245 | | administration of one or more programs to promote state or local |
---|
246 | 246 | | economic development and to stimulate business and commercial |
---|
247 | 247 | | activity, including programs to: |
---|
248 | 248 | | (1) make loans and grants of public money; and |
---|
249 | 249 | | (2) provide district personnel and services. |
---|
250 | 250 | | (c) The district may create economic development programs |
---|
251 | 251 | | and exercise the economic development powers provided to |
---|
252 | 252 | | municipalities by: |
---|
253 | 253 | | (1) Chapter 380, Local Government Code; and |
---|
254 | 254 | | (2) Subchapter A, Chapter 1509, Government Code. |
---|
255 | 255 | | Sec. 3924.110. PARKING FACILITIES. (a) The district may |
---|
256 | 256 | | acquire, lease as lessor or lessee, construct, develop, own, |
---|
257 | 257 | | operate, and maintain parking facilities or a system of parking |
---|
258 | 258 | | facilities, including lots, garages, parking terminals, or other |
---|
259 | 259 | | structures or accommodations for parking motor vehicles off the |
---|
260 | 260 | | streets and related appurtenances. |
---|
261 | 261 | | (b) The district's parking facilities serve the public |
---|
262 | 262 | | purposes of the district and are owned, used, and held for a public |
---|
263 | 263 | | purpose even if leased or operated by a private entity for a term of |
---|
264 | 264 | | years. |
---|
265 | 265 | | (c) The district's parking facilities are parts of and |
---|
266 | 266 | | necessary components of a street and are considered to be a street |
---|
267 | 267 | | or road improvement. |
---|
268 | 268 | | (d) The development and operation of the district's parking |
---|
269 | 269 | | facilities may be considered an economic development program. |
---|
270 | 270 | | Sec. 3924.111. APPROVAL BY CITY. (a) Except as provided by |
---|
271 | 271 | | Subsection (c), the district must obtain the approval of the city |
---|
272 | 272 | | for: |
---|
273 | 273 | | (1) the issuance of bonds; |
---|
274 | 274 | | (2) the annexation of land in the city or the |
---|
275 | 275 | | extraterritorial jurisdiction of the city; |
---|
276 | 276 | | (3) the plans and specifications of an improvement |
---|
277 | 277 | | project financed by bonds; and |
---|
278 | 278 | | (4) the plans and specifications of an improvement |
---|
279 | 279 | | project related to the use of land owned by the city, an easement |
---|
280 | 280 | | granted by the city, or a right-of-way of a street, road, or |
---|
281 | 281 | | highway. |
---|
282 | 282 | | (b) The district may not issue bonds or annex land in the |
---|
283 | 283 | | city or extraterritorial jurisdiction of the city until the |
---|
284 | 284 | | governing body of the city adopts a resolution or ordinance |
---|
285 | 285 | | authorizing the issuance of the bonds or the annexation of the land. |
---|
286 | 286 | | (c) If the district obtains the approval of the city's |
---|
287 | 287 | | governing body of a capital improvements budget for a period not to |
---|
288 | 288 | | exceed 10 years, the district may finance the capital improvements |
---|
289 | 289 | | and issue bonds specified in the budget without further approval |
---|
290 | 290 | | from the city. |
---|
291 | 291 | | (d) The governing body of the city: |
---|
292 | 292 | | (1) is not required to adopt a resolution or ordinance |
---|
293 | 293 | | to approve plans and specifications described by Subsection (a); |
---|
294 | 294 | | and |
---|
295 | 295 | | (2) may establish an administrative process to approve |
---|
296 | 296 | | plans and specifications described by Subsection (a) without the |
---|
297 | 297 | | involvement of the governing body. |
---|
298 | 298 | | Sec. 3924.112. COMPLIANCE WITH MUNICIPAL CONSENT |
---|
299 | 299 | | AGREEMENT, ORDINANCE, OR RESOLUTION; ENFORCEABILITY OF AGREEMENT. |
---|
300 | 300 | | (a) The district shall comply with all applicable requirements of |
---|
301 | 301 | | an ordinance or resolution adopted by the city that consents to the |
---|
302 | 302 | | creation of the district or to the inclusion of land in the |
---|
303 | 303 | | district. |
---|
304 | 304 | | (b) Any agreement between the district and the city related |
---|
305 | 305 | | to the city's consent to the creation of the district is valid and |
---|
306 | 306 | | enforceable. |
---|
307 | 307 | | (c) On the issuance of bonds by the district, the district |
---|
308 | 308 | | is considered to have waived sovereign immunity to suit by the city |
---|
309 | 309 | | for the purpose of adjudicating a claim for breach of an agreement |
---|
310 | 310 | | described by this section. |
---|
311 | 311 | | Sec. 3924.113. NO EMINENT DOMAIN POWER. The district may |
---|
312 | 312 | | not exercise the power of eminent domain. |
---|
313 | 313 | | SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS; TAX AND |
---|
314 | 314 | | ASSESSMENT ABATEMENTS |
---|
315 | 315 | | Sec. 3924.151. DISBURSEMENTS AND TRANSFERS OF MONEY. The |
---|
316 | 316 | | board by resolution shall establish the number of directors' |
---|
317 | 317 | | signatures and the procedure required for a disbursement or |
---|
318 | 318 | | transfer of district money. |
---|
319 | 319 | | Sec. 3924.152. MONEY USED FOR IMPROVEMENTS OR SERVICES. |
---|
320 | 320 | | The district may acquire, construct, finance, operate, or maintain |
---|
321 | 321 | | any improvement or service authorized under this chapter or Chapter |
---|
322 | 322 | | 375, Local Government Code, using any money available to the |
---|
323 | 323 | | district. |
---|
324 | 324 | | Sec. 3924.153. ASSESSMENTS; LIENS FOR ASSESSMENTS. (a) |
---|
325 | 325 | | The board by resolution may impose and collect an assessment for any |
---|
326 | 326 | | purpose authorized by this chapter in all or any part of the |
---|
327 | 327 | | district. |
---|
328 | 328 | | (b) An assessment, a reassessment, or an assessment |
---|
329 | 329 | | resulting from an addition to or correction of the assessment roll |
---|
330 | 330 | | by the district, penalties and interest on an assessment or |
---|
331 | 331 | | reassessment, an expense of collection, and reasonable attorney's |
---|
332 | 332 | | fees incurred by the district: |
---|
333 | 333 | | (1) are a first and prior lien against the property |
---|
334 | 334 | | assessed; |
---|
335 | 335 | | (2) are superior to any other lien or claim other than |
---|
336 | 336 | | a lien or claim for county, school district, or municipal ad valorem |
---|
337 | 337 | | taxes; and |
---|
338 | 338 | | (3) are the personal liability of and a charge against |
---|
339 | 339 | | the owners of the property even if the owners are not named in the |
---|
340 | 340 | | assessment proceedings. |
---|
341 | 341 | | (c) The lien is effective from the date of the board's |
---|
342 | 342 | | resolution imposing the assessment until the date the assessment is |
---|
343 | 343 | | paid. The board may enforce the lien in the same manner that the |
---|
344 | 344 | | board may enforce an ad valorem tax lien against real property. |
---|
345 | 345 | | (d) The board may make a correction to or deletion from the |
---|
