99 relating to the creation of the Cascades Municipal Utility District
1010 No. 1; providing authority to issue bonds; providing authority to
1111 impose assessments, fees, or taxes.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1414 Code, is amended by adding Chapter 8477 to read as follows:
1515 CHAPTER 8477. CASCADES MUNICIPAL UTILITY DISTRICT NO. 1
1616 SUBCHAPTER A. GENERAL PROVISIONS
1717 Sec. 8477.001. DEFINITIONS. In this chapter:
1818 (1) "Board" means the district's board of directors.
1919 (2) "Commission" means the Texas Commission on
2020 Environmental Quality.
2121 (3) "Director" means a board member.
2222 (4) "District" means the Cascades Municipal Utility
2323 District No. 1.
2424 Sec. 8477.002. NATURE OF DISTRICT. The district is a
2525 municipal utility district created under Section 59, Article XVI,
2626 Texas Constitution.
2727 Sec. 8477.003. CONFIRMATION AND DIRECTORS' ELECTION
2828 REQUIRED. The temporary directors shall hold an election to
2929 confirm the creation of the district and to elect permanent
3030 directors as provided by Section 49.102, Water Code, and this
3131 chapter.
3232 Sec. 8477.004. CONSENT OF MUNICIPALITY REQUIRED. (a) The
3333 temporary directors may not hold an election under Section 8477.003
3434 until each municipality in whose corporate limits or
3535 extraterritorial jurisdiction the district is located has
3636 consented by ordinance or resolution to the creation of the
3737 district and to the inclusion of land in the district.
3838 (b) If a municipality in whose extraterritorial
3939 jurisdiction the district is located does not consent to the
4040 creation of the district or if the district does not enter into an
4141 agreement required by the terms of the municipal ordinance or
4242 resolution consenting to the creation of the district under this
4343 section before September 1, 2014:
4444 (1) the district is dissolved September 1, 2014,
4545 except that:
4646 (A) any debts incurred shall be paid;
4747 (B) any assets that remain after the payment of
4848 debts shall be transferred to the municipality or another local
4949 governmental entity to be used for a public purpose; and
5050 (C) the organization of the district shall be
5151 maintained until all debts are paid and remaining assets are
5252 transferred; and
5353 (2) this chapter expires September 1, 2014.
5454 Sec. 8477.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
5555 The district is created to serve a public purpose and benefit.
5656 (b) The district is created to accomplish the purposes of:
5757 (1) a municipal utility district as provided by
5858 general law and Section 59, Article XVI, Texas Constitution; and
5959 (2) Section 52, Article III, Texas Constitution, that
6060 relate to the construction, acquisition, improvement, operation,
6161 or maintenance of macadamized, graveled, or paved roads, or
6262 improvements, including storm drainage, in aid of those roads.
6363 Sec. 8477.006. INITIAL DISTRICT TERRITORY. (a) The
6464 district is initially composed of the territory described by
6565 Section 2 of the Act enacting this chapter.
6666 (b) The boundaries and field notes contained in Section 2 of
6767 the Act enacting this chapter form a closure. A mistake made in the
6868 field notes or in copying the field notes in the legislative process
6969 does not affect the district's:
7070 (1) organization, existence, or validity;
7171 (2) right to issue any type of bond for the purposes
7272 for which the district is created or to pay the principal of and
7373 interest on a bond;
7474 (3) right to impose a tax; or
7575 (4) legality or operation.
7676 SUBCHAPTER B. BOARD OF DIRECTORS
7777 Sec. 8477.051. GOVERNING BODY; TERMS. (a) Except as
7878 provided by Subsection (b), the district is governed by a board of
7979 elected directors qualified to serve under Section 54.102, Water
8080 Code.
8181 (b) If required under the terms of the agreement, ordinance,
8282 or resolution by which a municipality consents to the creation of
8383 the district, the board consists of:
8484 (1) four elected directors qualified to serve under
8585 Section 54.102, Water Code; and
8686 (2) one director appointed by the governing body of
8787 the municipality who:
8888 (A) may be a member or other officer of the
8989 governing body or an employee of the municipality; and
9090 (B) is not required to be a qualified voter of the
9191 district or own land subject to taxation in the district.
9292 (c) The common law doctrine of incompatibility does not
9393 disqualify a member or other officer of the governing body or
9494 employee of the municipality from being appointed a director by the
9595 governing body of a municipality under Subsection (b)(2), and a
9696 director appointed to the board may continue to serve in a public
9797 office of or be employed by the municipality.
9898 (d) Except as provided by Section 8477.052, directors serve
9999 staggered four-year terms. A permanent director may not serve more
100100 than two four-year terms.
101101 Sec. 8477.052. TEMPORARY DIRECTORS. (a) The temporary
102102 board consists of:
103103 (1) John R. C. Munn;
104104 (2) George Roman;
105105 (3) Allen Gallia;
106106 (4) Donna Morgan; and
107107 (5) Charlotte Vick.
108108 (b) Temporary directors serve until the earlier of:
109109 (1) the date permanent directors are elected under
110110 Section 8477.003; or
111111 (2) the fourth anniversary of the effective date of
112112 the Act enacting this chapter.
113113 (c) If permanent directors have not been elected under
114114 Section 8477.003 and the terms of the temporary directors have
115115 expired, successor temporary directors shall be appointed or
116116 reappointed as provided by Subsection (d) to serve terms that
117117 expire on the earlier of:
118118 (1) the date permanent directors are elected under
119119 Section 8477.003; or
120120 (2) the fourth anniversary of the date of the
121121 appointment or reappointment.
122122 (d) If Subsection (c) applies, the owner or owners of a
123123 majority of the assessed value of the real property in the district
124124 may submit a petition to the commission requesting that the
125125 commission appoint as successor temporary directors the five
126126 persons named in the petition. The commission shall appoint as
127127 successor temporary directors the five persons named in the
128128 petition.
129129 SUBCHAPTER C. POWERS AND DUTIES
130130 Sec. 8477.101. GENERAL POWERS AND DUTIES. The district has
131131 the powers and duties necessary to accomplish the purposes for
132132 which the district is created.
133133 Sec. 8477.102. MUNICIPAL UTILITY DISTRICT POWERS AND
134134 DUTIES. The district has the powers and duties provided by the
135135 general law of this state, including Chapters 49 and 54, Water Code,
136136 applicable to municipal utility districts created under Section 59,
137137 Article XVI, Texas Constitution.
138138 Sec. 8477.103. AUTHORITY FOR ROAD PROJECTS. (a) Under
139139 Section 52, Article III, Texas Constitution, the district may
140140 design, acquire, construct, finance, issue bonds for, improve, and
141141 convey to this state, a county, or a municipality for operation and
142142 maintenance macadamized, graveled, or paved roads described by
143143 Section 54.234, Water Code, or improvements, including storm
144144 drainage, in aid of those roads.
145145 (b) The district may exercise the powers provided by this
146146 section without submitting a petition to or obtaining approval from
147147 the commission as required by Section 54.234, Water Code.
148148 Sec. 8477.104. APPROVAL OF ROAD PROJECT. (a) The district
149149 may not undertake a road project authorized by Section 8477.103
150150 unless:
151151 (1) each municipality or county that will operate and
152152 maintain the road has approved the plans and specifications of the
153153 road project, if a municipality or county will operate and maintain
154154 the road; or
155155 (2) the Texas Transportation Commission has approved
156156 the plans and specifications of the road project, if the state will
157157 operate and maintain the road.
158158 (b) Except as provided by Subsection (a), the district is
159159 not required to obtain approval from the Texas Transportation
160160 Commission to design, acquire, construct, finance, issue bonds for,
161161 improve, or convey a road project.
162162 Sec. 8477.105. COMPLIANCE WITH AND ENFORCEABILITY OF
163163 MUNICIPAL CONSENT ORDINANCE OR RESOLUTION. (a) The district shall
164164 comply with all applicable requirements of any ordinance or
165165 resolution that is adopted under Section 54.016 or 54.0165, Water
166166 Code, and that consents to the creation of the district or to the
167167 inclusion of land in the district.
168168 (b) Any agreement between the district and a municipality
169169 related to the municipality's consent to the creation of the
170170 district is valid and enforceable.
171171 (c) On the issuance of bonds by the district, the district
172172 is considered to have waived sovereign immunity to suit by a
173173 municipality for the purpose of adjudicating a claim for breach of
174174 an agreement described by this section.
175175 (d) The district and a municipality may contract on terms
176176 that the board and governing body of the municipality agree will
177177 further regional cooperation between the district and the
178178 municipality.
179179 Sec. 8477.106. NO EMINENT DOMAIN POWER. The district may
180180 not exercise the power of eminent domain.
181181 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
182182 Sec. 8477.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
183183 district may issue, without an election, bonds and other
184184 obligations secured by:
185185 (1) revenue other than ad valorem taxes; or
186186 (2) contract payments described by Section 8477.153.
187187 (b) The district must hold an election in the manner
188188 provided by Chapters 49 and 54, Water Code, to obtain voter approval
189189 before the district may impose an ad valorem tax or issue bonds
190190 payable from ad valorem taxes.
191191 (c) The district may not issue bonds payable from ad valorem
192192 taxes to finance a road project unless the issuance is approved by a
193193 vote of a two-thirds majority of the district voters voting at an
194194 election held for that purpose.
195195 Sec. 8477.152. OPERATION AND MAINTENANCE TAX. (a) If
196196 authorized at an election held under Section 8477.151, the district
197197 may impose an operation and maintenance tax on taxable property in
198198 the district in accordance with Section 49.107, Water Code.
199199 (b) The board shall determine the tax rate. The rate may not
200200 exceed the rate approved at the election.
201201 (c) If required by an agreement between the district and a
202202 municipality under Section 8477.105, the total ad valorem tax rate
203203 of the district may not be less than the total ad valorem tax rate of
204204 the municipality.
205205 Sec. 8477.153. CONTRACT TAXES. (a) In accordance with
206206 Section 49.108, Water Code, the district may impose a tax other than
207207 an operation and maintenance tax and use the revenue derived from
208208 the tax to make payments under a contract after the provisions of
209209 the contract have been approved by a majority of the district voters
210210 voting at an election held for that purpose.
211211 (b) A contract approved by the district voters may contain a
212212 provision stating that the contract may be modified or amended by
213213 the board without further voter approval.
214214 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
215215 Sec. 8477.201. AUTHORITY TO ISSUE BONDS AND OTHER
216216 OBLIGATIONS. The district may issue bonds or other obligations
217217 payable wholly or partly from ad valorem taxes, impact fees,
218218 revenue, contract payments, grants, or other district money, or any
219219 combination of those sources, to pay for any authorized district
220220 purpose.
221221 Sec. 8477.202. TAXES FOR BONDS. At the time the district
222222 issues bonds payable wholly or partly from ad valorem taxes, the
223223 board shall provide for the annual imposition of a continuing
224224 direct ad valorem tax, without limit as to rate or amount, while all
225225 or part of the bonds are outstanding as required and in the manner
226226 provided by Sections 54.601 and 54.602, Water Code.
227227 Sec. 8477.203. BONDS FOR ROAD PROJECTS. At the time of
228228 issuance, the total principal amount of bonds or other obligations
229229 issued or incurred to finance road projects and payable from ad
230230 valorem taxes may not exceed one-fourth of the assessed value of the
231231 real property in the district.
232232 SUBCHAPTER F. STRATEGIC PARTNERSHIP AGREEMENT; MUNICIPAL
233233 ANNEXATION AND NOTICE
234234 Sec. 8477.301. STRATEGIC PARTNERSHIP; CONTINUATION OF
235235 DISTRICT AFTER ANNEXATION BY MUNICIPALITY. (a) The district may
236236 continue to exist as a limited district after full-purpose
237237 annexation by a municipality if the district and the annexing
238238 municipality state the terms of the limited district's existence in
239239 a strategic partnership agreement under Section 43.0751, Local
240240 Government Code.
241241 (b) The strategic partnership agreement may provide for a
242242 term of any number of years. The limitation in Section
243243 43.0751(g)(2), Local Government Code, on the length of the term
244244 does not apply to a limited district created under this section.
245245 Sec. 8477.302. MUNICIPAL ANNEXATION; NOTICE. (a) Sections
246246 43.0561 and 43.0562, Local Government Code, do not apply to the
247247 annexation of the district by a municipality that consents to the
248248 creation of the district under Section 8477.004.
249249 (b) Not later than the 30th day after the date a
250250 municipality adopts a resolution or ordinance consenting to the
251251 creation of the district, the municipality shall file, in the real
252252 property records of the county in which the land to be included in
253253 the district is located, a notice to purchasers of real property in
254254 the district that describes:
255255 (1) the municipality's authority and intention to
256256 annex the district; and
257257 (2) the anticipated date of the annexation.
258258 (c) After the notice is filed, a person who proposes to sell
259259 or otherwise convey real property in the district must include the
260260 information contained in the municipality's notice in the Notice to
261261 Purchasers required by Section 49.452, Water Code.
262262 SECTION 2. The Cascades Municipal Utility District No. 1
263263 initially includes all the territory contained in the following
264264 area:
265265 135.796 ACRES, OUT OF THE SANTIAGO DEL VALLE GRANT IN TRAVIS COUNTY,
266266 TEXAS BEING ALL OF THAT 223.68 ACRES OUT OF THE SANTIAGO DEL VALLE
267267 GRANT IN TRAVIS COUNTY, TEXAS AND BEING ALL OF A CALLED 117.188 ACRE
268268 TRACT, ALL OF A CALLED 2.273 ACRE TRACT, ALL OF A CALLED 87.884 ACRE
269269 TRACT, ALL A OF CALLED 8.17 ACRE TRACT ALL DESCRIBED IN CORRECTION
270270 JOINT PARTNERSHIP CONTRIBUTION GENERAL WARRANTY DEED TO ONION
271271 ASSOCIATES, LTD RECORDED IN DOCUMENT NO. 2006236625, ALL OF A

483483 SECTION 3. (a) The legal notice of the intention to
484484 introduce this Act, setting forth the general substance of this
485485 Act, has been published as provided by law, and the notice and a
486486 copy of this Act have been furnished to all persons, agencies,
487487 officials, or entities to which they are required to be furnished
488488 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
489489 Government Code.
490490 (b) The governor, one of the required recipients, has
491491 submitted the notice and Act to the Texas Commission on
492492 Environmental Quality.
493493 (c) The Texas Commission on Environmental Quality has filed
494494 its recommendations relating to this Act with the governor, the
495495 lieutenant governor, and the speaker of the house of
496496 representatives within the required time.
497497 (d) All requirements of the constitution and laws of this
498498 state and the rules and procedures of the legislature with respect
499499 to the notice, introduction, and passage of this Act are fulfilled
500500 and accomplished.
501501 SECTION 4. This Act takes effect immediately if it receives
502502 a vote of two-thirds of all the members elected to each house, as
503503 provided by Section 39, Article III, Texas Constitution. If this
504504 Act does not receive the vote necessary for immediate effect, this
505505 Act takes effect September 1, 2013.
