1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1414 Code, is amended by adding Chapter 8484 to read as follows:
1515 CHAPTER 8484. KENDALL COUNTY MUNICIPAL UTILITY DISTRICT NO. 1
1616 SUBCHAPTER A. GENERAL PROVISIONS
1717 Sec. 8484.001. DEFINITIONS. In this chapter:
1818 (1) "Board" means the district's board of directors.
1919 (2) "Commission" means the Texas Commission on
2020 Environmental Quality.
2121 (3) "Director" means a board member.
2222 (4) "District" means the Kendall County Municipal
2323 Utility District No. 1.
2424 Sec. 8484.002. NATURE OF DISTRICT. The district is a
2525 municipal utility district created under Section 59, Article XVI,
2626 Texas Constitution.
2727 Sec. 8484.003. CONFIRMATION AND DIRECTORS' ELECTION
2828 REQUIRED. The temporary directors shall hold an election to
2929 confirm the creation of the district and to elect five permanent
3030 directors as provided by Section 49.102, Water Code.
3131 Sec. 8484.004. CONSENT OF MUNICIPALITY REQUIRED. The
3232 temporary directors may not hold an election under Section 8484.003
3333 until each municipality in whose corporate limits or
3434 extraterritorial jurisdiction the district is located has
3535 consented by ordinance or resolution to the creation of the
3636 district and to the inclusion of land in the district.
3737 Sec. 8484.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
3838 The district is created to serve a public purpose and benefit.
3939 (b) The district is created to accomplish the purposes of a
4040 municipal utility district as provided by general law and Section
4141 59, Article XVI, Texas Constitution.
4242 Sec. 8484.006. INITIAL DISTRICT TERRITORY. (a) The
4343 district is initially composed of the territory described by
4444 Section 2 of the Act enacting this chapter.
4545 (b) The boundaries and field notes contained in Section 2 of
4646 the Act enacting this chapter form a closure. A mistake made in the
4747 field notes or in copying the field notes in the legislative process
4848 does not affect the district's:
4949 (1) organization, existence, or validity;
5050 (2) right to issue any type of bond for the purposes
5151 for which the district is created or to pay the principal of and
5252 interest on a bond;
5353 (3) right to impose a tax; or
5454 (4) legality or operation.
5555 SUBCHAPTER B. BOARD OF DIRECTORS
5656 Sec. 8484.051. GOVERNING BODY; TERMS. (a) The district is
5757 governed by a board of five elected directors.
5858 (b) Except as provided by Section 8484.052, directors serve
5959 staggered four-year terms.
6060 Sec. 8484.052. TEMPORARY DIRECTORS. (a) The temporary
6161 board consists of:
6262 (1) Michael Sedlak;
6363 (2) Austin Ruple;
6464 (3) Chris Hoegemeyer;
6565 (4) Scot Wilson; and
6666 (5) Jim Guy Egbert.
6767 (b) Temporary directors serve until the earlier of:
6868 (1) the date permanent directors are elected under
6969 Section 8484.003; or
7070 (2) the fourth anniversary of the effective date of
7171 the Act enacting this chapter.
7272 (c) If permanent directors have not been elected under
7373 Section 8484.003 and the terms of the temporary directors have
7474 expired, successor temporary directors shall be appointed or
7575 reappointed as provided by Subsection (d) to serve terms that
7676 expire on the earlier of:
7777 (1) the date permanent directors are elected under
7878 Section 8484.003; or
7979 (2) the fourth anniversary of the date of the
8080 appointment or reappointment.
8181 (d) If Subsection (c) applies, the owner or owners of a
8282 majority of the assessed value of the real property in the district
8383 may submit a petition to the commission requesting that the
8484 commission appoint as successor temporary directors the five
8585 persons named in the petition. The commission shall appoint as
8686 successor temporary directors the five persons named in the
8787 petition.
8888 SUBCHAPTER C. POWERS AND DUTIES
8989 Sec. 8484.101. GENERAL POWERS AND DUTIES. The district has
9090 the powers and duties necessary to accomplish the purposes for
9191 which the district is created.
9292 Sec. 8484.102. MUNICIPAL UTILITY DISTRICT POWERS AND
9393 DUTIES. The district has the powers and duties provided by the
9494 general law of this state, including Chapters 49 and 54, Water Code,
9595 applicable to municipal utility districts created under Section 59,
9696 Article XVI, Texas Constitution.
9797 Sec. 8484.103. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
9898 OR RESOLUTION. The district shall comply with all applicable
9999 requirements of any ordinance or resolution that is adopted under
100100 Section 54.016 or 54.0165, Water Code, and that consents to the
101101 creation of the district or to the inclusion of land in the
102102 district.
103103 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
104104 Sec. 8484.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
105105 district may issue, without an election, bonds and other
106106 obligations secured by:
107107 (1) revenue other than ad valorem taxes; or
108108 (2) contract payments described by Section 8484.153.
109109 (b) The district must hold an election in the manner
110110 provided by Chapters 49 and 54, Water Code, to obtain voter approval
111111 before the district may impose an ad valorem tax or issue bonds
112112 payable from ad valorem taxes.
113113 Sec. 8484.152. OPERATION AND MAINTENANCE TAX. (a) If
114114 authorized at an election held under Section 8484.151, the district
115115 may impose an operation and maintenance tax on taxable property in
116116 the district in accordance with Section 49.107, Water Code.
117117 (b) The board shall determine the tax rate. The rate may not
118118 exceed the rate approved at the election.
119119 Sec. 8484.153. CONTRACT TAXES. (a) In accordance with
120120 Section 49.108, Water Code, the district may impose a tax other than
121121 an operation and maintenance tax and use the revenue derived from
122122 the tax to make payments under a contract after the provisions of
123123 the contract have been approved by a majority of the district voters
124124 voting at an election held for that purpose.
125125 (b) A contract approved by the district voters may contain a
126126 provision stating that the contract may be modified or amended by
127127 the board without further voter approval.
128128 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
129129 Sec. 8484.201. AUTHORITY TO ISSUE BONDS AND OTHER
130130 OBLIGATIONS. The district may issue bonds or other obligations
131131 payable wholly or partly from ad valorem taxes, impact fees,
132132 revenue, contract payments, grants, or other district money, or any
133133 combination of those sources, to pay for any authorized district
134134 purpose.
135135 Sec. 8484.202. TAXES FOR BONDS. (a) At the time the
136136 district issues bonds payable wholly or partly from ad valorem
137137 taxes, the board shall provide for the annual imposition of a
138138 continuing direct ad valorem tax, without limit as to rate or
139139 amount, while all or part of the bonds are outstanding as required
140140 and in the manner provided by Sections 54.601 and 54.602, Water
141141 Code.
142142 (b) The board's order to issue bonds and authorize an ad
143143 valorem tax must provide that the imposition of the tax ends and the
144144 district's authority to assess and collect the tax ends on the
145145 retirement of the bonds for which the tax was originally authorized
146146 unless the district voters authorize the extension or continuation
147147 of the ad valorem tax in a subsequent bond election.
148148 SECTION 2. The Kendall County Municipal Utility District
149149 No. 1 initially includes all the territory contained in the

648648 its recommendations relating to this Act with the governor, the
649649 lieutenant governor, and the speaker of the house of
650650 representatives within the required time.
651651 (d) All requirements of the constitution and laws of this
652652 state and the rules and procedures of the legislature with respect
653653 to the notice, introduction, and passage of this Act are fulfilled

655655 SECTION 4. (a) If this Act does not receive a two-thirds
656656 vote of all the members elected to each house, Subchapter C, Chapter
657657 8484, Special District Local Laws Code, as added by Section 1 of
658658 this Act, is amended by adding Section 8484.104 to read as follows:
659659 Sec. 8484.104. NO EMINENT DOMAIN POWER. The district may
660660 not exercise the power of eminent domain.
661661 (b) This section is not intended to be an expression of a
662662 legislative interpretation of the requirements of Section 17(c),
663663 Article I, Texas Constitution.
664664 SECTION 5. This Act takes effect immediately if it receives
665665 a vote of two-thirds of all the members elected to each house, as
666666 provided by Section 39, Article III, Texas Constitution. If this
667667 Act does not receive the vote necessary for immediate effect, this
668668 Act takes effect September 1, 2013.
