8	8	relating to the creation of the Kendall County Municipal Utility
9	9	District No. 1; granting a limited power of eminent domain;
10	10	providing authority to issue bonds; providing authority to impose
11	11	assessments, fees, or taxes.
12	12	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	13	SECTION 1. Subtitle F, Title 6, Special District Local Laws
14	14	Code, is amended by adding Chapter 8484 to read as follows:
15	15	CHAPTER 8484. KENDALL COUNTY MUNICIPAL UTILITY DISTRICT NO. 1
16	16	SUBCHAPTER A. GENERAL PROVISIONS
17	17	Sec. 8484.001. DEFINITIONS. In this chapter:
18	18	(1) "Board" means the district's board of directors.
19	19	(2) "Commission" means the Texas Commission on
20	20	Environmental Quality.
21	21	(3) "Director" means a board member.
22	22	(4) "District" means the Kendall County Municipal
23	23	Utility District No. 1.
24	24	Sec. 8484.002. NATURE OF DISTRICT. The district is a
25	25	municipal utility district created under Section 59, Article XVI,
26	26	Texas Constitution.
27	27	Sec. 8484.003. CONFIRMATION AND DIRECTORS' ELECTION
28	28	REQUIRED. The temporary directors shall hold an election to
29	29	confirm the creation of the district and to elect five permanent
30	30	directors as provided by Section 49.102, Water Code.
31	31	Sec. 8484.004. CONSENT OF MUNICIPALITY REQUIRED. The
32	32	temporary directors may not hold an election under Section 8484.003
33	33	until each municipality in whose corporate limits or
34	34	extraterritorial jurisdiction the district is located has
35	35	consented by ordinance or resolution to the creation of the
36	36	district and to the inclusion of land in the district.
37	37	Sec. 8484.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
38	38	The district is created to serve a public purpose and benefit.
39	39	(b) The district is created to accomplish the purposes of a
40	40	municipal utility district as provided by general law and Section
41	41	59, Article XVI, Texas Constitution.
42	42	Sec. 8484.006. INITIAL DISTRICT TERRITORY. (a) The
43	43	district is initially composed of the territory described by
44	44	Section 2 of the Act enacting this chapter.
45	45	(b) The boundaries and field notes contained in Section 2 of
46	46	the Act enacting this chapter form a closure. A mistake made in the
47	47	field notes or in copying the field notes in the legislative process
48	48	does not affect the district's:
49	49	(1) organization, existence, or validity;
50	50	(2) right to issue any type of bond for the purposes
51	51	for which the district is created or to pay the principal of and
52	52	interest on a bond;
53	53	(3) right to impose a tax; or
54	54	(4) legality or operation.
55	55	SUBCHAPTER B. BOARD OF DIRECTORS
56	56	Sec. 8484.051. GOVERNING BODY; TERMS. (a) The district is
57	57	governed by a board of five elected directors.
58	58	(b) Except as provided by Section 8484.052, directors serve
59	59	staggered four-year terms.
60	60	Sec. 8484.052. TEMPORARY DIRECTORS. (a) The temporary
61	61	board consists of:
62	62	(1) Michael Sedlak;
63	63	(2) Austin Ruple;
64	64	(3) Chris Hoegemeyer;
65	65	(4) Scot Wilson; and
66	66	(5) Jim Guy Egbert.
67	67	(b) Temporary directors serve until the earlier of:
68	68	(1) the date permanent directors are elected under
69	69	Section 8484.003; or
70	70	(2) the fourth anniversary of the effective date of
71	71	the Act enacting this chapter.
72	72	(c) If permanent directors have not been elected under
73	73	Section 8484.003 and the terms of the temporary directors have
74	74	expired, successor temporary directors shall be appointed or
75	75	reappointed as provided by Subsection (d) to serve terms that
76	76	expire on the earlier of:
77	77	(1) the date permanent directors are elected under
78	78	Section 8484.003; or
79	79	(2) the fourth anniversary of the date of the
80	80	appointment or reappointment.
81	81	(d) If Subsection (c) applies, the owner or owners of a
82	82	majority of the assessed value of the real property in the district
83	83	may submit a petition to the commission requesting that the
84	84	commission appoint as successor temporary directors the five
85	85	persons named in the petition. The commission shall appoint as
86	86	successor temporary directors the five persons named in the
87	87	petition.
88	88	SUBCHAPTER C. POWERS AND DUTIES
89	89	Sec. 8484.101. GENERAL POWERS AND DUTIES. The district has
90	90	the powers and duties necessary to accomplish the purposes for
91	91	which the district is created.
92	92	Sec. 8484.102. MUNICIPAL UTILITY DISTRICT POWERS AND
93	93	DUTIES. The district has the powers and duties provided by the
94	94	general law of this state, including Chapters 49 and 54, Water Code,
95	95	applicable to municipal utility districts created under Section 59,
96	96	Article XVI, Texas Constitution.
97	97	Sec. 8484.103. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
98	98	OR RESOLUTION. The district shall comply with all applicable
99	99	requirements of any ordinance or resolution that is adopted under
100	100	Section 54.016 or 54.0165, Water Code, and that consents to the
101	101	creation of the district or to the inclusion of land in the
102	102	district.
103	103	SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
104	104	Sec. 8484.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
105	105	district may issue, without an election, bonds and other
106	106	obligations secured by:
107	107	(1) revenue other than ad valorem taxes; or
108	108	(2) contract payments described by Section 8484.153.
109	109	(b) The district must hold an election in the manner
110	110	provided by Chapters 49 and 54, Water Code, to obtain voter approval
111	111	before the district may impose an ad valorem tax or issue bonds
112	112	payable from ad valorem taxes.
113	113	Sec. 8484.152. OPERATION AND MAINTENANCE TAX. (a) If
114	114	authorized at an election held under Section 8484.151, the district
115	115	may impose an operation and maintenance tax on taxable property in
116	116	the district in accordance with Section 49.107, Water Code.
117	117	(b) The board shall determine the tax rate. The rate may not
118	118	exceed the rate approved at the election.
119	119	Sec. 8484.153. CONTRACT TAXES. (a) In accordance with
120	120	Section 49.108, Water Code, the district may impose a tax other than
121	121	an operation and maintenance tax and use the revenue derived from
122	122	the tax to make payments under a contract after the provisions of
123	123	the contract have been approved by a majority of the district voters
124	124	voting at an election held for that purpose.
125	125	(b) A contract approved by the district voters may contain a
126	126	provision stating that the contract may be modified or amended by
127	127	the board without further voter approval.
128	128	SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
129	129	Sec. 8484.201. AUTHORITY TO ISSUE BONDS AND OTHER
130	130	OBLIGATIONS. The district may issue bonds or other obligations
131	131	payable wholly or partly from ad valorem taxes, impact fees,
132	132	revenue, contract payments, grants, or other district money, or any
133	133	combination of those sources, to pay for any authorized district
134	134	purpose.
135	135	Sec. 8484.202. TAXES FOR BONDS. (a) At the time the
136	136	district issues bonds payable wholly or partly from ad valorem
137	137	taxes, the board shall provide for the annual imposition of a
138	138	continuing direct ad valorem tax, without limit as to rate or
139	139	amount, while all or part of the bonds are outstanding as required
140	140	and in the manner provided by Sections 54.601 and 54.602, Water
141	141	Code.
142	142	(b) The board's order to issue bonds and authorize an ad
143	143	valorem tax must provide that the imposition of the tax ends and the
144	144	district's authority to assess and collect the tax ends on the
145	145	retirement of the bonds for which the tax was originally authorized
146	146	unless the district voters authorize the extension or continuation
147	147	of the ad valorem tax in a subsequent bond election.
148	148	SECTION 2. The Kendall County Municipal Utility District
149	149	No. 1 initially includes all the territory contained in the
150	150	following area:

659	659	Sec. 8484.104. NO EMINENT DOMAIN POWER. The district may
660	660	not exercise the power of eminent domain.
661	661	(b) This section is not intended to be an expression of a
662	662	legislative interpretation of the requirements of Section 17(c),
663	663	Article I, Texas Constitution.
664	664	SECTION 5. This Act takes effect immediately if it receives
665	665	a vote of two-thirds of all the members elected to each house, as
666	666	provided by Section 39, Article III, Texas Constitution. If this
667	667	Act does not receive the vote necessary for immediate effect, this
668	668	Act takes effect September 1, 2013.
