66 AN ACT
77 relating to authorizing the East Downtown Management District to
88 impose a tax, fee, or assessment on a residential property.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 3808.157, Special District Local Laws
1111 Code, is amended to read as follows:
1212 Sec. 3808.157. PROPERTY EXEMPT FROM TAXES, IMPACT FEES, AND
1313 ASSESSMENTS. The district may not impose:
1414 (1) a tax, impact fee, or assessment on a residential
1515 property or condominium development consisting of fewer than nine
1616 units; or
1717 (2) an impact fee or assessment on the property,
1818 equipment, or facilities of a person that provides to the public
1919 cable television, gas, light, power, telephone, sewage, or water
2020 service.
2121 SECTION 2. (a) The legal notice of the intention to
2222 introduce this Act, setting forth the general substance of this
2323 Act, has been published as provided by law, and the notice and a
2424 copy of this Act have been furnished to all persons, agencies,
2525 officials, or entities to which they are required to be furnished
2626 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
2727 Government Code.
2828 (b) The governor, one of the required recipients, has
2929 submitted the notice and Act to the Texas Commission on
3030 Environmental Quality.
3131 (c) The Texas Commission on Environmental Quality has filed
3232 its recommendations relating to this Act with the governor, the
3333 lieutenant governor, and the speaker of the house of
3434 representatives within the required time.
3535 (d) All requirements of the constitution and laws of this
3636 state and the rules and procedures of the legislature with respect
3737 to the notice, introduction, and passage of this Act are fulfilled
3838 and accomplished.
3939 SECTION 3. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2013.
