77 relating to the composition of the 12th and 369th Judicial
88 Districts, the redesignation of the district attorney for the 12th
99 Judicial District as the district attorney for the 369th Judicial
1010 District, and the composition of the Leon County juvenile board.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 24.113, Government Code, is amended to
1313 read as follows:
1414 Sec. 24.113. 12TH JUDICIAL DISTRICT (GRIMES, [LEON,]
1515 MADISON, AND WALKER COUNTIES). [(a)] The 12th Judicial District is
1616 composed of Grimes, [Leon,] Madison, and Walker counties.
1717 [(b) The terms of the 12th District Court in each county of
1818 the district begin on the first Mondays in January and July.]
1919 SECTION 2. Section 24.514, Government Code, is amended to
2020 read as follows:
2121 Sec. 24.514. 369TH JUDICIAL DISTRICT (ANDERSON, [AND]
2222 CHEROKEE, AND LEON COUNTIES). The 369th Judicial District is
2323 composed of Anderson, [and] Cherokee, and Leon counties.
2424 SECTION 3. Section 43.106, Government Code, is redesignated
2525 as Section 43.1815, Government Code, and amended to read as
2626 follows:
2727 Sec. 43.1815 [43.106]. 369TH [12TH] JUDICIAL DISTRICT. (a)
2828 The voters of Leon County elect a district attorney for the 369th
2929 [12th] Judicial District who represents the state in that district
3030 court only in Leon County.
3131 (b) The district attorney of the 369th [12th] Judicial
3232 District also represents the state in all criminal and civil
3333 actions in which the state is interested that arise in the 87th
3434 Judicial District in Leon County.
3535 (c) The district attorney may, with the consent of the
3636 Commissioners Court of Leon County, appoint a deputy district
3737 attorney.
3838 (d) The Commissioners Court of Leon County shall pay the
3939 salary and traveling expenses of the deputy district attorney from
4040 the officers' salary fund. The salary shall be paid in equal monthly
4141 installments and expense claims shall be paid at the end of each
4242 month. The salary is subject to participation fully in the Texas
4343 County and District Retirement System.
4444 SECTION 4. Section 46.002, Government Code, is amended to
4545 read as follows:
4646 Sec. 46.002. PROSECUTORS SUBJECT TO CHAPTER. This chapter
4747 applies to the state prosecuting attorney, all county prosecutors,
4848 and the following state prosecutors:
4949 (1) the district attorneys for Kenedy and Kleberg
5050 Counties and for the 1st, 2nd, 8th, 9th, [12th,] 18th, 21st, 23rd,
5151 25th, 26th, 27th, 29th, 31st, 32nd, 33rd, 34th, 35th, 36th, 38th,
5252 39th, 42nd, 43rd, 46th, 47th, 49th, 50th, 51st, 52nd, 53rd, 63rd,
5353 64th, 66th, 69th, 70th, 76th, 81st, 83rd, 84th, 85th, 88th, 90th,
5454 97th, 100th, 105th, 106th, 109th, 110th, 112th, 118th, 119th,
5555 123rd, 142nd, 143rd, 145th, 156th, 159th, 173rd, 196th, 198th,
5656 216th, 220th, 229th, 235th, 253rd, 258th, 259th, 266th, 268th,
5757 271st, 286th, 329th, 344th, 349th, 355th, 369th, and 506th judicial
5858 districts;
5959 (2) the criminal district attorneys for the counties
6060 of Anderson, Austin, Bastrop, Bexar, Bowie, Brazoria, Caldwell,
6161 Calhoun, Cass, Collin, Comal, Dallas, Deaf Smith, Denton, Eastland,
6262 Fannin, Galveston, Grayson, Gregg, Harrison, Hays, Hidalgo,
6363 Jasper, Jefferson, Kaufman, Lubbock, McLennan, Madison, Navarro,
6464 Newton, Panola, Polk, Randall, Rockwall, San Jacinto, Smith,
6565 Tarrant, Taylor, Tyler, Upshur, Van Zandt, Victoria, Walker,
6666 Waller, Wichita, Wood, and Yoakum; and
6767 (3) the county attorneys performing the duties of
6868 district attorneys in the counties of Andrews, Callahan, Cameron,
6969 Castro, Colorado, Crosby, Ellis, Falls, Freestone, Lamar, Lamb,
7070 Lampasas, Lee, Limestone, Marion, Milam, Morris, Ochiltree,
7171 Orange, Rains, Red River, Robertson, Rusk, Swisher, Terry, Webb,
7272 and Willacy.
7373 SECTION 5. Section 152.1511(a), Human Resources Code, as
7474 amended by Chapters 531 (H.B. 956), 1152 (H.B. 3045), and 1352 (S.B.
7575 1189), Acts of the 79th Legislature, Regular Session, 2005, is
7676 reenacted to read as follows:
7777 (a) The juvenile board of Leon County is composed of the
7878 county judge and the district judges in Leon County.
7979 SECTION 6. (a) The local administrative district judge
8080 shall transfer all cases from Leon County that are pending in the
8181 12th District Court on September 1, 2013, to the 369th District
8282 Court.
8383 (b) When a case is transferred as provided by Subsection (a)
8484 of this section, all processes, writs, bonds, recognizances, or
8585 other obligations issued from the 12th District Court are
8686 returnable to the 369th District Court as if originally issued by
8787 that court. The obligees on all bonds and recognizances taken in
8888 and for the 12th District Court and all witnesses summoned to appear
8989 in the 12th District Court are required to appear before the 369th
9090 District Court as if originally required to appear before that
9191 court.
9292 SECTION 7. The person serving as district attorney for the
9393 12th Judicial District on September 1, 2013, unless otherwise
9494 removed from office, continues to serve in that office as
9595 redesignated as the district attorney for the 369th Judicial
9696 District for the term to which elected or appointed.
9797 SECTION 8. This Act takes effect September 1, 2013.
