11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 24.113, Government Code, is amended to |
---|
13 | 13 | | read as follows: |
---|
14 | 14 | | Sec. 24.113. 12TH JUDICIAL DISTRICT (GRIMES, [LEON,] |
---|
15 | 15 | | MADISON, AND WALKER COUNTIES). [(a)] The 12th Judicial District is |
---|
16 | 16 | | composed of Grimes, [Leon,] Madison, and Walker counties. |
---|
17 | 17 | | [(b) The terms of the 12th District Court in each county of |
---|
18 | 18 | | the district begin on the first Mondays in January and July.] |
---|
19 | 19 | | SECTION 2. Section 24.514, Government Code, is amended to |
---|
20 | 20 | | read as follows: |
---|
21 | 21 | | Sec. 24.514. 369TH JUDICIAL DISTRICT (ANDERSON, [AND] |
---|
22 | 22 | | CHEROKEE, AND LEON COUNTIES). The 369th Judicial District is |
---|
23 | 23 | | composed of Anderson, [and] Cherokee, and Leon counties. |
---|
24 | 24 | | SECTION 3. Section 43.106, Government Code, is redesignated |
---|
25 | 25 | | as Section 43.1815, Government Code, and amended to read as |
---|
26 | 26 | | follows: |
---|
27 | 27 | | Sec. 43.1815 [43.106]. 369TH [12TH] JUDICIAL DISTRICT. (a) |
---|
28 | 28 | | The voters of Leon County elect a district attorney for the 369th |
---|
29 | 29 | | [12th] Judicial District who represents the state in that district |
---|
30 | 30 | | court only in Leon County. |
---|
31 | 31 | | (b) The district attorney of the 369th [12th] Judicial |
---|
32 | 32 | | District also represents the state in all criminal and civil |
---|
33 | 33 | | actions in which the state is interested that arise in the 87th |
---|
34 | 34 | | Judicial District in Leon County. |
---|
35 | 35 | | (c) The district attorney may, with the consent of the |
---|
36 | 36 | | Commissioners Court of Leon County, appoint a deputy district |
---|
37 | 37 | | attorney. |
---|
38 | 38 | | (d) The Commissioners Court of Leon County shall pay the |
---|
39 | 39 | | salary and traveling expenses of the deputy district attorney from |
---|
40 | 40 | | the officers' salary fund. The salary shall be paid in equal monthly |
---|
41 | 41 | | installments and expense claims shall be paid at the end of each |
---|
42 | 42 | | month. The salary is subject to participation fully in the Texas |
---|
43 | 43 | | County and District Retirement System. |
---|
44 | 44 | | SECTION 4. Section 46.002, Government Code, is amended to |
---|
45 | 45 | | read as follows: |
---|
46 | 46 | | Sec. 46.002. PROSECUTORS SUBJECT TO CHAPTER. This chapter |
---|
47 | 47 | | applies to the state prosecuting attorney, all county prosecutors, |
---|
48 | 48 | | and the following state prosecutors: |

53 | 53 | | 64th, 66th, 69th, 70th, 76th, 81st, 83rd, 84th, 85th, 88th, 90th, |

54 | 54 | | 97th, 100th, 105th, 106th, 109th, 110th, 112th, 118th, 119th, |

64 | 64 | | Newton, Panola, Polk, Randall, Rockwall, San Jacinto, Smith, |

70 | 70 | | Lampasas, Lee, Limestone, Marion, Milam, Morris, Ochiltree, |
---|
71 | 71 | | Orange, Rains, Red River, Robertson, Rusk, Swisher, Terry, Webb, |
---|
72 | 72 | | and Willacy. |

73 | 73 | | SECTION 5. Section 152.1511(a), Human Resources Code, as |
---|
74 | 74 | | amended by Chapters 531 (H.B. 956), 1152 (H.B. 3045), and 1352 (S.B. |
---|
75 | 75 | | 1189), Acts of the 79th Legislature, Regular Session, 2005, is |
---|
76 | 76 | | reenacted to read as follows: |
---|
77 | 77 | | (a) The juvenile board of Leon County is composed of the |
---|
78 | 78 | | county judge and the district judges in Leon County. |
---|
79 | 79 | | SECTION 6. (a) The local administrative district judge |
---|
80 | 80 | | shall transfer all cases from Leon County that are pending in the |
---|
81 | 81 | | 12th District Court on September 1, 2013, to the 369th District |
---|
82 | 82 | | Court. |
---|
83 | 83 | | (b) When a case is transferred as provided by Subsection (a) |
---|
84 | 84 | | of this section, all processes, writs, bonds, recognizances, or |
---|
85 | 85 | | other obligations issued from the 12th District Court are |
---|
86 | 86 | | returnable to the 369th District Court as if originally issued by |
---|
87 | 87 | | that court. The obligees on all bonds and recognizances taken in |
---|
88 | 88 | | and for the 12th District Court and all witnesses summoned to appear |
---|
89 | 89 | | in the 12th District Court are required to appear before the 369th |
---|
90 | 90 | | District Court as if originally required to appear before that |
---|
91 | 91 | | court. |
---|
92 | 92 | | SECTION 7. The person serving as district attorney for the |
---|
93 | 93 | | 12th Judicial District on September 1, 2013, unless otherwise |
---|
94 | 94 | | removed from office, continues to serve in that office as |
---|
95 | 95 | | redesignated as the district attorney for the 369th Judicial |
---|
96 | 96 | | District for the term to which elected or appointed. |
---|
97 | 97 | | SECTION 8. This Act takes effect September 1, 2013. |
