99 AN ACT
1010 relating to the creation of the Comal County Water Improvement
1111 District No. 3; granting a limited power of eminent domain;
1212 providing authority to issue bonds; providing authority to impose
1313 assessments, fees, or taxes.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1616 Code, is amended by adding Chapter 8489 to read as follows:
1717 CHAPTER 8489. COMAL COUNTY WATER IMPROVEMENT DISTRICT NO. 3
1818 SUBCHAPTER A. GENERAL PROVISIONS
1919 Sec. 8489.001. DEFINITIONS. In this chapter:
2020 (1) "Board" means the district's board of directors.
2121 (2) "Commission" means the Texas Commission on
2222 Environmental Quality.
2323 (3) "Director" means a board member.
2424 (4) "District" means the Comal County Water
2525 Improvement District No. 3.
2626 Sec. 8489.002. NATURE OF DISTRICT. The district is a
2727 municipal utility district created under Section 59, Article XVI,
2828 Texas Constitution.
2929 Sec. 8489.003. CONFIRMATION AND DIRECTORS' ELECTION
3030 REQUIRED. The temporary directors shall hold an election to
3131 confirm the creation of the district and to elect five permanent
3232 directors as provided by Section 49.102, Water Code.
3333 Sec. 8489.004. CONSENT OF MUNICIPALITY AND DEVELOPMENT
3434 AGREEMENT REQUIRED. (a) The temporary directors may not hold an
3535 election under Section 8489.003 until each municipality in whose
3636 corporate limits or extraterritorial jurisdiction the district is
3737 located has:
3838 (1) consented by ordinance or resolution to the
3939 creation of the district and to the inclusion of land in the
4040 district; and
4141 (2) entered into a development agreement under Section
4242 212.172, Local Government Code, with the retail public utility
4343 owned by the municipality that addresses water and wastewater
4444 issues and with the owners of land in the district that addresses
4545 relevant issues, including:
4646 (A) the provision of services other than water or
4747 wastewater services to land in the district, including emergency
4848 services and solid waste collection;
4949 (B) traffic and roadway impacts caused by the
5050 creation of the district;
5151 (C) the amount of debt to be issued by the
5252 district or any new district created by the division of the
5353 district;
5454 (D) a plan for dividing the district, including
5555 the number, location, and size of any new districts created by the
5656 division of the district;
5757 (E) fire flow;
5858 (F) a prohibition against a retail public
5959 utility, as defined by Section 13.002, Water Code, other than the
6060 retail public utility owned by the municipality, from providing
6161 retail water or wastewater service to the property in the district
6262 or a new district created by the division of the district except
6363 with respect to any lands in the district or a new district created
6464 by division of the district that are included within the
6565 certificated service territory of another retail public utility, as
6666 defined by a certificate of public convenience and necessity;
6767 (G) an agreement to comply with the
6868 municipality's most current building codes and ordinances, public
6969 health and safety codes and ordinances, and environmental
7070 regulation codes and ordinances; and
7171 (H) an agreement to comply with the
7272 municipality's most current land use regulations.
7373 (b) The development agreement may not contain a provision
7474 prohibited by Section 212.174, Local Government Code, in relation
7575 to the provision of utility service.
7676 (c) A confirmation election held in violation of this
7777 section is void.
7878 Sec. 8489.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
7979 The district is created to serve a public purpose and benefit.
8080 (b) The district is created to accomplish the purposes of:
8181 (1) a municipal utility district as provided by
8282 general law and Section 59, Article XVI, Texas Constitution; and
8383 (2) Section 52, Article III, Texas Constitution, that
8484 relate to the construction, acquisition, improvement, operation,
8585 or maintenance of macadamized, graveled, or paved roads, or
8686 improvements, including storm drainage, in aid of those roads.
8787 Sec. 8489.006. INITIAL DISTRICT TERRITORY. (a) The
8888 district is initially composed of the territory described by
8989 Section 2 of the Act enacting this chapter.
9090 (b) The boundaries and field notes contained in Section 2 of
9191 the Act enacting this chapter form a closure. A mistake made in the
9292 field notes or in copying the field notes in the legislative process
9393 does not affect the district's:
9494 (1) organization, existence, or validity;
9595 (2) right to issue any type of bond for the purposes
9696 for which the district is created or to pay the principal of and
9797 interest on a bond;
9898 (3) right to impose a tax; or
9999 (4) legality or operation.
100100 SUBCHAPTER B. BOARD OF DIRECTORS
101101 Sec. 8489.051. GOVERNING BODY; TERMS. (a) The district is
102102 governed by a board of five elected directors.
103103 (b) Except as provided by Section 8489.052, directors serve
104104 staggered four-year terms.
105105 Sec. 8489.052. TEMPORARY DIRECTORS. (a) The temporary
106106 board consists of:
107107 (1) William McLean;
108108 (2) Michael Morrill;
109109 (3) Lance Sallis;
110110 (4) Noah Shaffer; and
111111 (5) Stephen Delgado.
112112 (b) Temporary directors serve until the earlier of:
113113 (1) the date permanent directors are elected under
114114 Section 8489.003; or
115115 (2) the fourth anniversary of the effective date of
116116 the Act enacting this chapter.
117117 (c) If permanent directors have not been elected under
118118 Section 8489.003 and the terms of the temporary directors have
119119 expired, successor temporary directors shall be appointed or
120120 reappointed as provided by Subsection (d) to serve terms that
121121 expire on the earlier of:
122122 (1) the date permanent directors are elected under
123123 Section 8489.003; or
124124 (2) the fourth anniversary of the date of the
125125 appointment or reappointment.
126126 (d) If Subsection (c) applies, the owner or owners of a
127127 majority of the assessed value of the real property in the district
128128 may submit a petition to the commission requesting that the
129129 commission appoint as successor temporary directors the five
130130 persons named in the petition. The commission shall appoint as
131131 successor temporary directors the five persons named in the
132132 petition.
133133 SUBCHAPTER C. POWERS AND DUTIES
134134 Sec. 8489.101. GENERAL POWERS AND DUTIES. The district has
135135 the powers and duties necessary to accomplish the purposes for
136136 which the district is created.
137137 Sec. 8489.102. MUNICIPAL UTILITY DISTRICT POWERS AND
138138 DUTIES. The district has the powers and duties provided by the
139139 general law of this state, including Chapters 49 and 54, Water Code,
140140 applicable to municipal utility districts created under Section 59,
141141 Article XVI, Texas Constitution.
142142 Sec. 8489.103. AUTHORITY FOR ROAD PROJECTS. Under Section
143143 52, Article III, Texas Constitution, the district may design,
144144 acquire, construct, finance, issue bonds for, improve, operate,
145145 maintain, and convey to this state, a county, or a municipality for
146146 operation and maintenance macadamized, graveled, or paved roads, or
147147 improvements, including storm drainage, in aid of those roads.
148148 Sec. 8489.104. ROAD STANDARDS AND REQUIREMENTS. (a) A road
149149 project must meet all applicable construction standards, zoning and
150150 subdivision requirements, and regulations of each municipality in
151151 whose corporate limits or extraterritorial jurisdiction the road
152152 project is located.
153153 (b) If a road project is not located in the corporate limits
154154 or extraterritorial jurisdiction of a municipality, the road
155155 project must meet all applicable construction standards,
156156 subdivision requirements, and regulations of each county in which
157157 the road project is located.
158158 (c) If the state will maintain and operate the road, the
159159 Texas Transportation Commission must approve the plans and
160160 specifications of the road project.
161161 Sec. 8489.105. WATER AND WASTEWATER INFRASTRUCTURE. (a)
162162 The district may not construct a water or wastewater facility
163163 unless any municipality in whose corporate limits or
164164 extraterritorial jurisdiction the facility is located at the time
165165 of construction has approved the plans and specifications of the
166166 facility.
167167 (b) On completion of a water or wastewater facility
168168 described in a development agreement between the district and a
169169 municipality, the district shall convey the facility to the
170170 municipality or to the retail public utility owned by the
171171 municipality, free of all liens, claims, or encumbrances, in the
172172 form and manner acceptable to the municipality or retail public
173173 utility.
174174 Sec. 8489.106. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
175175 OR RESOLUTION AND DEVELOPMENT AGREEMENT. (a) The district shall
176176 comply with all applicable requirements of any ordinance or
177177 resolution that is adopted under Section 54.016 or 54.0165, Water
178178 Code, and that consents to the creation of the district or to the
179179 inclusion of land in the district.
180180 (b) Notwithstanding other law, a municipality may place a
181181 condition or restriction on the creation of the district or
182182 inclusion of land in the district that is:
183183 (1) expressly permitted by Sections 54.016(e) and (i),
184184 Water Code; or
185185 (2) contained in the development agreement entered
186186 into under Section 212.172, Local Government Code, and this
187187 chapter.
188188 Sec. 8489.107. DIVISION OF DISTRICT. (a) The district may
189189 be divided into two or more new districts only if the district:
190190 (1) has no outstanding bonded debt; and
191191 (2) is not imposing ad valorem taxes.
192192 (b) This chapter applies to any new district created by the
193193 division of the district, and a new district has all the powers and
194194 duties of the district.
195195 (c) Any new district created by the division of the district
196196 may not, at the time the new district is created, contain any land
197197 outside the area described by Section 2 of the Act enacting this
198198 chapter.
199199 (d) The board, on its own motion or on receipt of a petition
200200 signed by the owner or owners of a majority of the assessed value of
201201 the real property in the district, may adopt an order dividing the
202202 district.
203203 (e) The board may adopt an order dividing the district
204204 before or after the date the board holds an election under Section
205205 8489.003 to confirm the district's creation.
206206 (f) An order dividing the district shall:
207207 (1) name each new district;
208208 (2) include the metes and bounds description of the
209209 territory of each new district;
210210 (3) appoint temporary directors for each new district;
211211 and
212212 (4) provide for the division of assets and liabilities
213213 between or among the new districts.
214214 (g) On or before the 30th day after the date of adoption of
215215 an order dividing the district, the district shall file the order
216216 with the commission and record the order in the real property
217217 records of each county in which the district is located.
218218 (h) Any new district created by the division of the district
219219 shall hold a confirmation and directors' election as required by
220220 Section 8489.003.
221221 (i) Municipal consent to the creation of the district and to
222222 the inclusion of land in the district granted under Section
223223 8489.004 acts as municipal consent to the creation of any new
224224 district created by the division of the district and to the
225225 inclusion of land in the new district.
226226 (j) Any new district created by the division of the district
227227 must hold an election as required by this chapter to obtain voter
228228 approval before the district may impose a maintenance tax or issue
229229 bonds payable wholly or partly from ad valorem taxes.
230230 Sec. 8489.108. LIMITATION ON ANNEXATION OF LAND BY
231231 DISTRICT. The district or any new district created by the division
232232 of the district may not annex land outside the area described by
233233 Section 2 of the Act enacting this chapter without the consent of
234234 each municipality in whose corporate limits or extraterritorial
235235 jurisdiction any of the land in the area described by Section 2 of
236236 the Act enacting this chapter is located.
237237 Sec. 8489.109. MUNICIPAL ANNEXATION ADJACENT TO DISTRICT.
238238 For the purposes of Section 43.021(2), Local Government Code, or
239239 other law, including a municipal charter or ordinance relating to
240240 annexation, an area adjacent to the district or any new district
241241 created by the division of the district is considered adjacent to a
242242 municipality in whose corporate limits or extraterritorial
243243 jurisdiction any of the land in the area described by Section 2 of
244244 the Act enacting this chapter is located.
245245 Sec. 8489.110. LIMITS ON DISTRICT SERVICES. Inside the
246246 corporate limits or extraterritorial jurisdiction of a
247247 municipality, the district may not provide without the
248248 municipality's consent:
249249 (1) solid waste collection, treatment, or disposal
250250 services; or
251251 (2) fire protection services.
252252 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
253253 Sec. 8489.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
254254 district may issue, without an election, bonds and other
255255 obligations secured by:
256256 (1) revenue other than ad valorem taxes; or
257257 (2) contract payments described by Section 8489.153.
258258 (b) The district must hold an election in the manner
259259 provided by Chapters 49 and 54, Water Code, to obtain voter approval
260260 before the district may impose an ad valorem tax or issue bonds
261261 payable from ad valorem taxes.
262262 (c) The district may not issue bonds payable from ad valorem
263263 taxes to finance a road project unless the issuance is approved by a
264264 vote of a two-thirds majority of the district voters voting at an
265265 election held for that purpose.
266266 Sec. 8489.152. OPERATION AND MAINTENANCE TAX. (a) If
267267 authorized at an election held under Section 8489.151, the district
268268 may impose an operation and maintenance tax on taxable property in
269269 the district in accordance with Section 49.107, Water Code.
270270 (b) The board shall determine the tax rate. The rate may not
271271 exceed the rate approved at the election.
272272 Sec. 8489.153. CONTRACT TAXES. (a) In accordance with
273273 Section 49.108, Water Code, the district may impose a tax other than
274274 an operation and maintenance tax and use the revenue derived from
275275 the tax to make payments under a contract after the provisions of
276276 the contract have been approved by a majority of the district voters
277277 voting at an election held for that purpose.
278278 (b) A contract approved by the district voters may contain a
279279 provision stating that the contract may be modified or amended by
280280 the board without further voter approval.
281281 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
282282 Sec. 8489.201. AUTHORITY TO ISSUE BONDS AND OTHER
283283 OBLIGATIONS. The district may issue bonds or other obligations
284284 payable wholly or partly from ad valorem taxes, impact fees,
285285 revenue, contract payments, grants, or other district money, or any
286286 combination of those sources, to pay for any authorized district
287287 purpose.
288288 Sec. 8489.202. TAXES FOR BONDS. At the time the district
289289 issues bonds payable wholly or partly from ad valorem taxes, the
290290 board shall provide for the annual imposition of a continuing
291291 direct ad valorem tax, without limit as to rate or amount, while all
292292 or part of the bonds are outstanding as required and in the manner
293293 provided by Sections 54.601 and 54.602, Water Code.
294294 Sec. 8489.203. BONDS FOR ROAD PROJECTS. At the time of
295295 issuance, the total principal amount of bonds or other obligations
296296 issued or incurred to finance road projects and payable from ad
297297 valorem taxes may not exceed one-fourth of the assessed value of the
298298 real property in the district.
299299 SECTION 2. The Comal County Water Improvement District No.
300300 3 initially includes all the territory contained in the following
301301 area:
302302 TRACT ONE:
303303 1252.958 acres of land located in the Antonio Maria Esnaurizar
304304 Eleven League Grant, Survey No. 1, Abstract No. 1, Subdivisions 13,
305305 14, 15, 16, 17, 18, 19, 20, 21, 22, and 31, Comal County, Texas, and
306306 being comprised of the following parcels: 1015.410 acre tract as
307307 described as a 1015.701 acre tract by a SPECIAL WARRANTY DEED from
308308 NORMANDY TERRACE, INC., a Texas Corporation, JAMES C. NORMAN, NANCY
309309 NORMAN and SUSAN N. SMITH to LAMROCK 3-2001 LIMITED, a Texas limited
310310 partnership, executed on April 30, 2001, and recorded in Document
311311 No. 200106014380 of the Official Public Records of Comal County,
312312 Texas, and an 85.763 acre tract comprised of a 57.133 acre tract as
313313 described in a PARTITION DEED between LEE E. JOHNSON and wife JEN
314314 MEI JOHNSON, executed on September 7, 1983, and recorded in Volume
315315 351, Pages 931-939 of the Deed Records of Comal County, Texas, and a
316316 28.500 acre tract as conveyed by SPECIAL WARRANTY DEED dated

320320 SPECIAL WARRANTY DEED from the RESOLUTION TRUST CORPORATION (RTC)
321321 to M.W. KRAFT, JR., executed on January 14, 1983, and recorded in
322322 Volume 874, Pages 72-76 of the Official Public Records of Comal
323323 County, Texas, and 27.474 acres of land being out of and a part of a
324324 27.611 acre tract as conveyed by GENERAL WARRANTY DEED from MICHAEL
325325 PAYNTER and wife THETA SCHUG PAYNTER, to MARY EVELYN FREEMAN, filed

936936 (b) The governor, one of the required recipients, has
937937 submitted the notice and Act to the Texas Commission on

939939 (c) The Texas Commission on Environmental Quality has filed
940940 its recommendations relating to this Act with the governor, the
941941 lieutenant governor, and the speaker of the house of
942942 representatives within the required time.
943943 (d) All requirements of the constitution and laws of this
944944 state and the rules and procedures of the legislature with respect
945945 to the notice, introduction, and passage of this Act are fulfilled
946946 and accomplished.
947947 SECTION 4. (a) If this Act does not receive a two-thirds
948948 vote of all the members elected to each house, Subchapter C, Chapter
949949 8489, Special District Local Laws Code, as added by Section 1 of
950950 this Act, is amended by adding Section 8489.111 to read as follows:
951951 Sec. 8489.111. NO EMINENT DOMAIN POWER. The district may
952952 not exercise the power of eminent domain.
953953 (b) This section is not intended to be an expression of a
954954 legislative interpretation of the requirements of Section 17(c),
955955 Article I, Texas Constitution.
956956 SECTION 5. This Act takes effect immediately if it receives
957957 a vote of two-thirds of all the members elected to each house, as
958958 provided by Section 39, Article III, Texas Constitution. If this
959959 Act does not receive the vote necessary for immediate effect, this
960960 Act takes effect September 1, 2013.
