66 relating to the provision of emergency services in the
77 Williamson-Travis Counties Water Control and Improvement District
88 No. 1G.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle I, Title 6, Special District Local Laws
1111 Code, is amended by adding Chapter 9036 to read as follows:
1212 CHAPTER 9036. WILLIAMSON-TRAVIS COUNTIES WATER CONTROL AND
1313 IMPROVEMENT DISTRICT NO. 1G
1414 Sec. 9036.001. DEFINITION. In this chapter, "district"
1515 means the Williamson-Travis Counties Water Control and Improvement
1616 District No. 1G.
1717 Sec. 9036.002. REMOVAL OF AREA FROM EMERGENCY SERVICES
1818 DISTRICT. (a) This section applies only to:
1919 (1) a municipality with a population of less than
2020 100,000; and
2121 (2) an emergency services district operating under
2222 Chapter 775, Health and Safety Code, in which the district is wholly
2323 or partly located.
2424 (b) If the district enters into a strategic partnership
2525 agreement with a municipality under Section 43.0751, Local
2626 Government Code, that includes the provision of fire-fighting
2727 services as defined by Section 49.351(k), Water Code, and the
2828 district has completed all other procedures necessary for a
2929 limited-purpose annexation by that municipality, an emergency
3030 services district shall disannex the territory of the district to
3131 be served by the municipality under the agreement in accordance
3232 with Subsection (c).
3333 (c) The territory remains part of the emergency services
3434 district until the secretary of the emergency services district
3535 board receives from the district notice that the requirements of
3636 Subsection (b) have been met. On receipt of the notice, the board
3737 shall immediately change its records to show that the district
3838 territory has been disannexed from the emergency services district
3939 and shall cease to provide further services to the residents of that
4040 territory.
4141 (d) Sections 775.022(b), (c), (d), (e), and (f), Health and
4242 Safety Code, apply to a disannexation under this section, as if the
4343 disannexation occurred under the provisions of Section 775.022(a),
4444 Health and Safety Code.
4545 SECTION 2. (a) The legal notice of the intention to
4646 introduce this Act, setting forth the general substance of this
4747 Act, has been published as provided by law, and the notice and a
4848 copy of this Act have been furnished to all persons, agencies,
4949 officials, or entities to which they are required to be furnished
5050 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
5151 Government Code.
5252 (b) The governor, one of the required recipients, has
5353 submitted the notice and Act to the Texas Commission on
5454 Environmental Quality.
5555 (c) The Texas Commission on Environmental Quality has filed
5656 its recommendations relating to this Act with the governor, the
5757 lieutenant governor, and the speaker of the house of
5858 representatives within the required time.
5959 (d) All requirements of the constitution and laws of this
6060 state and the rules and procedures of the legislature with respect
6161 to the notice, introduction, and passage of this Act are fulfilled
6262 and accomplished.
6363 SECTION 3. This Act takes effect September 1, 2013.
