7	7	relating to the provision of emergency services in the Bella Vista
8	8	Municipal Utility District.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Subtitle F, Title 6, Special District Local Laws
11	11	Code, is amended by adding Chapter 8437 to read as follows:
12	12	CHAPTER 8437. BELLA VISTA MUNICIPAL UTILITY DISTRICT
13	13	Sec. 8437.001. DEFINITION. In this chapter, "district"
14	14	means the Bella Vista Municipal Utility District.
15	15	Sec. 8437.002. REMOVAL OF AREA FROM EMERGENCY SERVICES
16	16	DISTRICT. (a) This section applies only to:
17	17	(1) a municipality with a population of less than
18	18	100,000; and
19	19	(2) an emergency services district operating under
20	20	Chapter 775, Health and Safety Code, in which the district is wholly
21	21	or partly located.
22	22	(b) If the district enters into a strategic partnership
23	23	agreement with a municipality under Section 43.0751, Local
24	24	Government Code, that includes the provision of fire-fighting
25	25	services as defined by Section 49.351(k), Water Code, and the
26	26	district has completed all other procedures necessary for a
27	27	limited-purpose annexation by that municipality, an emergency
28	28	services district shall disannex the territory of the district to
29	29	be served by the municipality under the agreement in accordance
30	30	with Subsection (c).
31	31	(c) The territory remains part of the emergency services
32	32	district until the secretary of the emergency services district
33	33	board receives from the district notice that the requirements of
34	34	Subsection (b) have been met. On receipt of the notice, the board
35	35	shall immediately change its records to show that the district
36	36	territory has been disannexed from the emergency services district
37	37	and shall cease to provide further services to the residents of that
38	38	territory.
39	39	(d) Sections 775.022(b), (c), (d), (e), and (f), Health and
40	40	Safety Code, apply to a disannexation under this section, as if the
41	41	disannexation occurred under the provisions of Section 775.022(a),
42	42	Health and Safety Code.
43	43	SECTION 2. (a) The legal notice of the intention to
44	44	introduce this Act, setting forth the general substance of this
45	45	Act, has been published as provided by law, and the notice and a
46	46	copy of this Act have been furnished to all persons, agencies,
47	47	officials, or entities to which they are required to be furnished
48	48	under Section 59, Article XVI, Texas Constitution, and Chapter 313,
49	49	Government Code.
50	50	(b) The governor, one of the required recipients, has
51	51	submitted the notice and Act to the Texas Commission on
52	52	Environmental Quality.
53	53	(c) The Texas Commission on Environmental Quality has filed
54	54	its recommendations relating to this Act with the governor, the
55	55	lieutenant governor, and the speaker of the house of
56	56	representatives within the required time.
57	57	(d) All requirements of the constitution and laws of this
58	58	state and the rules and procedures of the legislature with respect
59	59	to the notice, introduction, and passage of this Act are fulfilled
60	60	and accomplished.
61	61	SECTION 3. This Act takes effect September 1, 2013.
