77 relating to the provision of emergency services in the Bella Vista
88 Municipal Utility District.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1111 Code, is amended by adding Chapter 8437 to read as follows:
1212 CHAPTER 8437. BELLA VISTA MUNICIPAL UTILITY DISTRICT
1313 Sec. 8437.001. DEFINITION. In this chapter, "district"
1414 means the Bella Vista Municipal Utility District.
1515 Sec. 8437.002. REMOVAL OF AREA FROM EMERGENCY SERVICES
1616 DISTRICT. (a) This section applies only to:
1717 (1) a municipality with a population of less than
1818 100,000; and
1919 (2) an emergency services district operating under
2020 Chapter 775, Health and Safety Code, in which the district is wholly
2121 or partly located.
2222 (b) If the district enters into a strategic partnership
2323 agreement with a municipality under Section 43.0751, Local
2424 Government Code, that includes the provision of fire-fighting
2525 services as defined by Section 49.351(k), Water Code, and the
2626 district has completed all other procedures necessary for a
2727 limited-purpose annexation by that municipality, an emergency
2828 services district shall disannex the territory of the district to
2929 be served by the municipality under the agreement in accordance
3030 with Subsection (c).
3131 (c) The territory remains part of the emergency services
3232 district until the secretary of the emergency services district
3333 board receives from the district notice that the requirements of
3434 Subsection (b) have been met. On receipt of the notice, the board
3535 shall immediately change its records to show that the district
3636 territory has been disannexed from the emergency services district
3737 and shall cease to provide further services to the residents of that
3838 territory.
3939 (d) Sections 775.022(b), (c), (d), (e), and (f), Health and
4040 Safety Code, apply to a disannexation under this section, as if the
4141 disannexation occurred under the provisions of Section 775.022(a),
4242 Health and Safety Code.
4343 SECTION 2. (a) The legal notice of the intention to
4444 introduce this Act, setting forth the general substance of this
4545 Act, has been published as provided by law, and the notice and a
4646 copy of this Act have been furnished to all persons, agencies,
4747 officials, or entities to which they are required to be furnished
4848 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
4949 Government Code.
5050 (b) The governor, one of the required recipients, has
5151 submitted the notice and Act to the Texas Commission on
5252 Environmental Quality.
5353 (c) The Texas Commission on Environmental Quality has filed
5454 its recommendations relating to this Act with the governor, the
5555 lieutenant governor, and the speaker of the house of
5656 representatives within the required time.
5757 (d) All requirements of the constitution and laws of this
5858 state and the rules and procedures of the legislature with respect
5959 to the notice, introduction, and passage of this Act are fulfilled
6060 and accomplished.
6161 SECTION 3. This Act takes effect September 1, 2013.
