10	10	AN ACT
11	11	relating to a medal for certain members of the state military forces
12	12	who served during the Cold War; authorizing a fee.
13	13	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14	14	SECTION 1. Section 431.134, Government Code, is amended by
15	15	amending Subsection (a) and adding Subsection (c) to read as
16	16	follows:
17	17	(a) The adjutant general may adopt rules and regulations
18	18	relating to the:
19	19	(1) Texas Faithful Service Medal, which shall be
20	20	awarded to a member of the state military forces who has completed
21	21	five years of honorable service during which the person has shown
22	22	fidelity to duty, efficient service, and great loyalty to the
23	23	state;
24	24	(2) Federal Service Medal, which shall be awarded to a
25	25	person who was inducted into federal service from the state
26	26	military forces between June 15, 1940, and January 1, 1946, or after
27	27	June 1, 1950, if the service was for more than 90 days;
28	28	(3) Texas Medal of Merit, which may be presented to a
29	29	member of the military forces of this state, another state, or the
30	30	United States who performs outstanding service or attains
31	31	extraordinary achievement in behalf of the state or United States;
32	32	(4) Texas Outstanding Service Medal, which may be
33	33	presented to a member of the military forces of this state, another
34	34	state, or the United States who has performed service in a superior
35	35	and clearly outstanding manner;
36	36	(5) Texas State Guard Service Medal, which shall be
37	37	awarded to a person who completes three consecutive years of
38	38	honorable service in the Texas State Guard during which the person
39	39	has shown fidelity to duty, efficient service, and great loyalty to
40	40	the state;
41	41	(6) Texas Desert Shield/Desert Storm Campaign Medal,
42	42	which shall be awarded to a person who was inducted into federal
43	43	service from the Texas National Guard after August 1, 1990, in
44	44	support of Operation Desert Shield or Operation Desert Storm,
45	45	without regard to the place that the person was deployed while
46	46	serving on active federal military duty;
47	47	(7) Texas Humanitarian Service Medal, which shall be
48	48	awarded to a person who:
49	49	(A) does not meet the criteria for an award of the
50	50	federal Humanitarian Service Medal;
51	51	(B) is a member of the state military forces; and
52	52	(C) while serving on state active duty or active
53	53	duty under state authority in accordance with Title 32 of the United
54	54	States Code, participates satisfactorily in defense support to a
55	55	mission under civilian authority to protect life or property during
56	56	or soon after a natural disaster or civil unrest in the state;
57	57	(8) Texas Cavalry Medal, which shall be awarded to a
58	58	person who:
59	59	(A) served on or after September 11, 2001, in the
60	60	124th Cavalry, Texas Army National Guard; and
61	61	(B) served in a hostile fire zone as designated
62	62	by the United States secretary of defense;
63	63	(9) Texas Combat Service Ribbon, which shall be
64	64	awarded to a member of the Texas National Guard who served, after
65	65	September 11, 2001, in a hostile fire zone as designated by the
66	66	United States secretary of defense;
67	67	(10) Texas Purple Heart Medal, which shall be awarded
68	68	to a person who, after September 11, 2001:
69	69	(A) was inducted into federal service from the
70	70	Texas National Guard; and
71	71	(B) meets the criteria for an award of the
72	72	federal Purple Heart Medal;
73	73	(11) Texas Superior Service Medal, which shall be
74	74	awarded to:
75	75	(A) a member of the state military forces who
76	76	has:
77	77	(i) completed 30 or more years of honorable
78	78	state service or a combination of state and federal service; and
79	79	(ii) continually demonstrated superior
80	80	performance and service while assigned to key leadership positions
81	81	demanding responsibility; or
82	82	(B) a civilian who has contributed significant
83	83	service to the state military forces;
84	84	(12) Texas Homeland Defense Service Medal, which shall
85	85	be awarded to a member of the state military forces who served:
86	86	(A) on or after September 11, 2001;
87	87	(B) on state active duty or active duty under
88	88	state authority in accordance with Title 32 of the United States
89	89	Code; and
90	90	(C) satisfactorily in defense support to a
91	91	mission in the state under civilian authority;
92	92	(13) Texas Iraqi Campaign Medal, which shall be
93	93	awarded to a person who was inducted into federal service from the
94	94	Texas National Guard, without regard to the place that the person
95	95	was deployed while serving on active federal military duty, after:
96	96	(A) March 19, 2003, in support of Operation Iraqi
97	97	Freedom; or
98	98	(B) August 31, 2010, in support of Operation New
99	99	Dawn; [and]
100	100	(14) Texas Afghanistan Campaign Medal, which shall be
101	101	awarded to a person who was inducted into federal service from the
102	102	Texas National Guard after October 6, 2001, in support of Operation
103	103	Enduring Freedom, without regard to the place that the person was
104	104	deployed while serving on active federal military duty; and
105	105	(15) Cold War Medal, which shall be awarded to a member
106	106	of the Texas National Guard or the Texas State Guard who served
107	107	between September 2, 1945, and December 26, 1991, subject to
108	108	Subsection (c).
109	109	(c) A person described by Subsection (a)(15) may be awarded
110	110	a Cold War Medal only if a fee in the amount necessary to cover the
111	111	costs of awarding the medal is paid to the adjutant general's
112	112	department.
113	113	SECTION 2. This Act takes effect September 1, 2013.
