77 relating to the release of a vehicle held by a vehicle storage
88 facility.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 2308.458, Occupations Code, is amended
1111 by adding Subsection (f) to read as follows:
1212 (f) The court may issue an order of release directing a
1313 vehicle storage facility to immediately release the vehicle to the
1414 owner of the vehicle or a booting company to immediately remove a
1515 boot from the vehicle. If the court finds that the person to whom an
1616 order described by this subsection was issued has not complied with
1717 the order, the court may issue an order directing the person to
1818 appear on a designated date and show cause why the person should not
1919 be held in contempt of court. If the court then finds that the
2020 person directly or indirectly disobeyed the order of release, the
2121 court may find the person in contempt of court and impose a
2222 punishment under Section 21.002(c), Government Code.
2323 SECTION 2. This Act takes effect September 1, 2013.
