9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 2308.458, Occupations Code, is amended | |
11 | 11 | by adding Subsection (f) to read as follows: | |
12 | 12 | (f) The court may issue an order of release directing a | |
13 | 13 | vehicle storage facility to immediately release the vehicle to the | |
14 | 14 | owner of the vehicle or a booting company to immediately remove a | |
15 | 15 | boot from the vehicle. If the court finds that the person to whom an | |
16 | 16 | order described by this subsection was issued has not complied with | |
17 | 17 | the order, the court may issue an order directing the person to | |
18 | 18 | appear on a designated date and show cause why the person should not | |
19 | 19 | be held in contempt of court. If the court then finds that the | |
20 | 20 | person directly or indirectly disobeyed the order of release, the | |
21 | 21 | court may find the person in contempt of court and impose a | |
22 | 22 | punishment under Section 21.002(c), Government Code. | |
23 | 23 | SECTION 2. This Act takes effect September 1, 2013. |
