99 AN ACT
1010 relating to the persons authorized to take a blood specimen from a
1111 vehicle operator to test for alcohol concentration or other
1212 intoxicating substances.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. The heading to Section 724.017, Transportation
1515 Code, is amended to read as follows:
1616 Sec. 724.017. TAKING OF BLOOD SPECIMEN.
1717 SECTION 2. Section 724.017, Transportation Code, is amended
1818 by amending Subsections (a) and (c) and adding Subsections (a-1),
1919 (c-1), and (c-2) to read as follows:
2020 (a) Only the following [a physician, qualified technician,
2121 chemist, registered professional nurse, or licensed vocational
2222 nurse] may take a blood specimen at the request or order of a peace
2323 officer under this chapter:
2424 (1) a physician;
2525 (2) a qualified technician;
2626 (3) a registered professional nurse;
2727 (4) a licensed vocational nurse; or
2828 (5) a licensed or certified emergency medical
2929 technician-intermediate or emergency medical technician-paramedic
3030 authorized to take a blood specimen under Subsection (c).
3131 (a-1) The blood specimen must be taken in a sanitary place.
3232 (c) A licensed or certified emergency medical
3333 technician-intermediate or emergency medical technician-paramedic
3434 may take a blood specimen only if authorized by the medical director
3535 for the entity that employs the technician-intermediate or
3636 technician-paramedic. The specimen must be taken according to a
3737 protocol developed by the medical director that provides direction
3838 to the technician-intermediate or technician-paramedic for the
3939 taking of a blood specimen at the request or order of a peace
4040 officer. In this subsection, "medical director" means a licensed
4141 physician who supervises the provision of emergency medical
4242 services by a public or private entity that:
4343 (1) provides those services; and
4444 (2) employs one or more licensed or certified
4545 emergency medical technician-intermediates or emergency medical
4646 technician-paramedics [In this section, "qualified technician"
4747 does not include emergency medical services personnel].
4848 (c-1) A protocol developed under Subsection (c) may address
4949 whether an emergency medical technician-intermediate or emergency
5050 medical technician-paramedic engaged in the performance of
5151 official duties is entitled to refuse to:
5252 (1) go to the location of a person from whom a peace
5353 officer requests or orders the taking of a blood specimen solely for
5454 the purpose of taking that blood specimen;
5555 (2) take a blood specimen if the
5656 technician-intermediate or technician-paramedic reasonably
5757 believes that complying with the peace officer's request or order
5858 to take the specimen would impair or interfere with the provision of
5959 patient care or the performance of other official duties; or
6060 (3) provide the equipment or supplies necessary to
6161 take a blood specimen.
6262 (c-2) If a licensed or certified emergency medical
6363 technician-intermediate or emergency medical technician-paramedic
6464 takes a blood specimen at the request or order of a peace officer, a
6565 peace officer must:
6666 (1) observe the taking of the specimen; and
6767 (2) immediately take possession of the specimen for
6868 purposes of establishing a chain of custody.
6969 SECTION 3. This Act takes effect September 1, 2013.
