88 AN ACT
99 relating to the restoration of certain rights to a criminal
1010 defendant.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Article 48.05(a)(2), Code of Criminal Procedure,
1313 is amended to read as follows:
1414 (2) This article applies to:
1515 (A) a federal offense, other than an offense
1616 involving:
1717 (i) violence or the threat of violence;
1818 (ii) drugs; or
1919 (iii) firearms; [and]
2020 (B) an offense under the laws of another country,
2121 other than an offense involving:
2222 (i) violence or the threat of violence;
2323 (ii) drugs; or
2424 (iii) firearms, if the elements of the
2525 offense are substantially similar to elements of an offense under
2626 the laws of this state punishable as a felony; and
2727 (C) an offense under the laws of this state,
2828 other than an offense:
2929 (i) for which an individual is required to
3030 register as a sex offender under Chapter 62; or
3131 (ii) involving drugs.
3232 SECTION 2. Article 48.05(b), Code of Criminal Procedure, is
3333 amended to read as follows:
3434 (b) An individual may not apply for restoration of civil
3535 rights under this article unless:
3636 (1) the individual has completed the sentence for the
3737 offense;
3838 (2) the conviction occurred[:
3939 [(A)] three or more years before the date of
4040 application[, if the offense is a federal offense; or
4141 [(B) two or more years before the date of
4242 application, if the offense is an offense under the laws of another
4343 country]; and
4444 (3) the individual has not been convicted at any other
4545 time of an offense under the laws of this state, another state, or
4646 the United States.
4747 SECTION 3. This Act applies to a defendant who is convicted
4848 of an offense before, on, or after the effective date of this Act.
4949 SECTION 4. This Act takes effect September 1, 2013.
