99 AN ACT
1010 relating to the authority of a county to advertise on leased
1111 vehicles.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Sections 263.251(a) and (b), Local Government
1414 Code, are amended to read as follows:
1515 (a) The commissioners court of a county may adopt a
1616 procedure by which the county may:
1717 (1) lease to another entity advertising space located:
1818 (A) in or on a building or part of a building
1919 owned by the county;
2020 (B) on a vehicle owned by the county; [or]
2121 (C) on an official county website; or
2222 (D) on a vehicle leased by the county, with the
2323 vehicle owner's consent; or
2424 (2) sell advertising space located on correspondence
2525 distributed by the county through the United States Postal Service.
2626 (b) The procedure must include a requirement that the county
2727 publish, before a sale or lease of advertising space is made, a
2828 notice of its intent to sell or lease the advertising space. The
2929 notice must:
3030 (1) be published:
3131 (A) at least one time in a newspaper of general
3232 circulation in the county not earlier than the 30th day or later
3333 than the 14th day before the date the award of the sale or lease is
3434 made; and
3535 (B) on the county's official website
3636 continuously for the 14 days immediately before the date the award
3737 of the sale or lease is made;
3838 (2) include a description of the advertising space,
3939 including its location and a description of the part of any real or
4040 personal property that the advertising space occupies; and
4141 (3) include a description of the procedure by which
4242 bids or proposals for the sale or lease may be submitted.
4343 SECTION 2. This Act takes effect immediately if it receives
4444 a vote of two-thirds of all the members elected to each house, as
4545 provided by Section 39, Article III, Texas Constitution. If this
4646 Act does not receive the vote necessary for immediate effect, this
4747 Act takes effect September 1, 2013.
