| 10 | 10 | | relating to the authority of a county to advertise on leased |
|---|
| 11 | 11 | | vehicles. |

| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Sections 263.251(a) and (b), Local Government |
|---|
| 14 | 14 | | Code, are amended to read as follows: |
|---|
| 15 | 15 | | (a) The commissioners court of a county may adopt a |
|---|
| 16 | 16 | | procedure by which the county may: |
|---|
| 17 | 17 | | (1) lease to another entity advertising space located: |
|---|
| 18 | 18 | | (A) in or on a building or part of a building |
|---|
| 19 | 19 | | owned by the county; |
|---|
| 20 | 20 | | (B) on a vehicle owned by the county; [or] |
|---|
| 21 | 21 | | (C) on an official county website; or |
|---|
| 22 | 22 | | (D) on a vehicle leased by the county, with the |
|---|
| 23 | 23 | | vehicle owner's consent; or |
|---|
| 24 | 24 | | (2) sell advertising space located on correspondence |
|---|
| 25 | 25 | | distributed by the county through the United States Postal Service. |
|---|
| 26 | 26 | | (b) The procedure must include a requirement that the county |
|---|
| 27 | 27 | | publish, before a sale or lease of advertising space is made, a |
|---|
| 28 | 28 | | notice of its intent to sell or lease the advertising space. The |
|---|
| 29 | 29 | | notice must: |
|---|
| 30 | 30 | | (1) be published: |
|---|
| 31 | 31 | | (A) at least one time in a newspaper of general |
|---|
| 32 | 32 | | circulation in the county not earlier than the 30th day or later |
|---|
| 33 | 33 | | than the 14th day before the date the award of the sale or lease is |
|---|
| 34 | 34 | | made; and |
|---|
| 35 | 35 | | (B) on the county's official website |
|---|
| 36 | 36 | | continuously for the 14 days immediately before the date the award |
|---|
| 37 | 37 | | of the sale or lease is made; |
|---|
| 38 | 38 | | (2) include a description of the advertising space, |
|---|
| 39 | 39 | | including its location and a description of the part of any real or |
|---|
| 40 | 40 | | personal property that the advertising space occupies; and |
|---|
| 41 | 41 | | (3) include a description of the procedure by which |
|---|
| 42 | 42 | | bids or proposals for the sale or lease may be submitted. |
|---|
| 43 | 43 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 44 | 44 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 45 | 45 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 46 | 46 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 47 | 47 | | Act takes effect September 1, 2013. |
