| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 18, Code of Criminal Procedure, is |
|---|
| 11 | 11 | | amended by adding Article 18.065 to read as follows: |
|---|
| 12 | 12 | | Art. 18.065. WARRANT FOR BLOOD SPECIMEN IN INTOXICATION |
|---|
| 13 | 13 | | OFFENSE MAY BE EXECUTED IN CONTIGUOUS COUNTY. Notwithstanding any |
|---|
| 14 | 14 | | other law, a warrant issued under Article 18.02(10) to collect a |
|---|
| 15 | 15 | | blood specimen from a person suspected of committing an |
|---|
| 16 | 16 | | intoxication offense under Section 49.04, 49.045, 49.05, 49.06, |
|---|
| 17 | 17 | | 49.065, 49.07, or 49.08, Penal Code, may be executed in a county |
|---|
| 18 | 18 | | that is contiguous to the county in which the warrant is issued, |
|---|
| 19 | 19 | | regardless of whether the issuing court's jurisdiction extends |
|---|
| 20 | 20 | | outside the county in which that court is located. |
|---|
| 21 | 21 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 22 | 22 | | to a search warrant issued on or after the effective date of this |
|---|
| 23 | 23 | | Act. A search warrant issued before the effective date of this Act |
|---|
| 24 | 24 | | is governed by the law in effect on the date the warrant was issued, |
|---|
| 25 | 25 | | and the former law is continued in effect for that purpose. |
|---|
| 26 | 26 | | SECTION 3. This Act takes effect September 1, 2013. |
