66 AN ACT
77 relating to the execution of a search warrant for taking a blood
88 specimen from certain persons in certain intoxication offenses.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 18, Code of Criminal Procedure, is
1111 amended by adding Article 18.065 to read as follows:
1212 Art. 18.065. WARRANT FOR BLOOD SPECIMEN IN INTOXICATION
1313 OFFENSE MAY BE EXECUTED IN CONTIGUOUS COUNTY. Notwithstanding any
1414 other law, a warrant issued under Article 18.02(10) to collect a
1515 blood specimen from a person suspected of committing an
1616 intoxication offense under Section 49.04, 49.045, 49.05, 49.06,
1717 49.065, 49.07, or 49.08, Penal Code, may be executed in a county
1818 that is contiguous to the county in which the warrant is issued,
1919 regardless of whether the issuing court's jurisdiction extends
2020 outside the county in which that court is located.
2121 SECTION 2. The change in law made by this Act applies only
2222 to a search warrant issued on or after the effective date of this
2323 Act. A search warrant issued before the effective date of this Act
2424 is governed by the law in effect on the date the warrant was issued,
2525 and the former law is continued in effect for that purpose.
2626 SECTION 3. This Act takes effect September 1, 2013.
