88 AN ACT
99 relating to penalties imposed on a holder of an alcoholic beverage
1010 license or permit on the basis of a criminal prosecution.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 11.641(c), Alcoholic Beverage Code, is
1313 amended to read as follows:
1414 (c) A civil penalty against the holder of[, including
1515 cancellation of] a permit[,] may not be imposed on the basis of a
1616 criminal prosecution in which the defendant was found not guilty,
1717 the criminal charges were dismissed, or there has not been final
1818 adjudication except for allegations involving:
1919 (1) a violation of:
2020 (A) Section 22.12, 28.11, 69.13, 71.09, 101.04,
2121 101.63, 104.01(4), 104.01(9), 106.03, 106.06, or 106.15; or
2222 (B) Chapter 105; or
2323 (2) prostitution, trafficking of persons, or
2424 gambling.
2525 SECTION 2. Section 11.641(c), Alcoholic Beverage Code, as
2626 amended by this Act, applies only to the imposition of a penalty for
2727 a violation that occurs on or after the effective date of this Act.
2828 The imposition of a penalty for a violation that occurs before the
2929 effective date of this Act is governed by the law in effect
3030 immediately before the effective date of this Act, and that law is
3131 continued in effect for that purpose.
3232 SECTION 3. This Act takes effect September 1, 2013.
