99 relating to certain restrictions on contributions and expenditures
1010 from political funds by a lobbyist; providing penalties.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 253, Election Code, is
1313 amended by adding Section 253.006 to read as follows:
1414 Sec. 253.006. CERTAIN CONTRIBUTIONS AND EXPENDITURES BY
1515 LOBBYISTS RESTRICTED. (a) In this section, "administrative
1616 action," "communicates directly with," "legislation," "member of
1717 the executive branch," and "member of the legislative branch" have
1818 the meanings assigned by Section 305.002, Government Code.
1919 (b) Notwithstanding any other provision of law and except as
2020 provided by Subsection (c), a person required to register under
2121 Chapter 305, Government Code, may not, before the second
2222 anniversary of the date the last term for which the person was
2323 elected ends, knowingly make or authorize a political contribution
2424 or political expenditure from political contributions accepted by
2525 the person as a candidate or officeholder.
2626 (c) Subsection (b) does not apply to a person who:
2727 (1) communicates directly with a member of the
2828 legislative or executive branch only to influence legislation or
2929 administrative action on behalf of:
3030 (A) a nonprofit organization exempt from federal
3131 income taxation under Section 501(a), Internal Revenue Code of
3232 1986, as an organization described by Section 501(c)(3) of that
3333 code;
3434 (B) a group of low-income individuals; or
3535 (C) a group of individuals with disabilities;
3636 and
3737 (2) does not receive compensation other than
3838 reimbursement for actual expenses for engaging in communication
3939 described by Subdivision (1).
4040 (d) A person who violates this section commits an offense.
4141 An offense under this section is a Class A misdemeanor.
4242 SECTION 2. Subchapter B, Chapter 305, Government Code, is
4343 amended by adding Section 305.030 to read as follows:
4444 Sec. 305.030. EXPENDITURES FROM POLITICAL CONTRIBUTIONS
4545 RESTRICTED. (a) In this section, "political contribution" has the
4646 meaning assigned by Section 251.001, Election Code.
4747 (b) Notwithstanding any other provision of law and except as
4848 provided by Subsection (c), a person required to register under
4949 this chapter may not, before the second anniversary of the date the
5050 last term for which the person was elected ends, knowingly make or
5151 authorize an expenditure under this chapter from political
5252 contributions accepted by the person as a candidate or
5353 officeholder.
5454 (c) Subsection (b) does not apply to a person who:
5555 (1) communicates directly with a member of the
5656 legislative or executive branch only to influence legislation or
5757 administrative action on behalf of:
5858 (A) a nonprofit organization exempt from federal
5959 income taxation under Section 501(a), Internal Revenue Code of
6060 1986, as an organization described by Section 501(c)(3) of that
6161 code;
6262 (B) a group of low-income individuals; or
6363 (C) a group of individuals with disabilities;
6464 and
6565 (2) does not receive compensation other than
6666 reimbursement for actual expenses for engaging in communication
6767 described by Subdivision (1).
6868 SECTION 3. Section 253.006, Election Code, as added by this
6969 Act, and Section 305.030, Government Code, as added by this Act,
7070 apply to a political contribution, political expenditure, or
7171 lobbying expenditure made on or after September 1, 2013, from funds
7272 accepted as a political contribution, regardless of the date the
7373 funds were accepted.
7474 SECTION 4. This Act takes effect September 1, 2013.
