1010 relating to employment of persons by open-enrollment charter
1111 schools.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 12.120, Education Code, is amended by
1414 adding Subsection (a-1) to read as follows:
1515 (a-1) Notwithstanding Subsection (a), subject to Section
1616 12.1059, an open-enrollment charter school may employ a person:
1717 (1) as a teacher or educational aide if:
1818 (A) a school district could employ the person as
1919 a teacher or educational aide; or
2020 (B) a school district could employ the person as
2121 a teacher or educational aide if the person held the appropriate
2222 certificate issued under Subchapter B, Chapter 21, and the person
2323 has never held a certificate issued under Subchapter B, Chapter 21;
2424 or
2525 (2) in a position other than a position described by
2626 Subdivision (1) if a school district could employ the person in that
2727 position.
2828 SECTION 2. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2013.
