| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 2267.003, Government Code, as added by |
|---|
| 13 | 13 | | Chapter 1334 (S.B. 1048), Acts of the 82nd Legislature, Regular |
|---|
| 14 | 14 | | Session, 2011, is amended to read as follows: |
|---|
| 15 | 15 | | Sec. 2267.003. APPLICABILITY. This chapter does not apply |
|---|
| 16 | 16 | | to: |
|---|
| 17 | 17 | | (1) the financing, design, construction, maintenance, |
|---|
| 18 | 18 | | or operation of a highway in the state highway system; |
|---|
| 19 | 19 | | (2) a transportation authority created under Chapter |
|---|
| 20 | 20 | | 451, 452, 453, or 460, Transportation Code; [or] |
|---|
| 21 | 21 | | (3) any telecommunications, cable television, video |
|---|
| 22 | 22 | | service, or broadband infrastructure other than technology |
|---|
| 23 | 23 | | installed as part of a qualifying project that is essential to the |
|---|
| 24 | 24 | | project; or |
|---|
| 25 | 25 | | (4) a redevelopment project of a defense base |
|---|
| 26 | 26 | | development authority created under Chapter 379B, Local Government |
|---|
| 27 | 27 | | Code. |
|---|
| 28 | 28 | | SECTION 2. (a) This section takes effect only if the Act of |
|---|
| 29 | 29 | | the 83rd Legislature, Regular Session, 2013, relating to |
|---|
| 30 | 30 | | nonsubstantive additions to and corrections in enacted codes does |
|---|
| 31 | 31 | | not become law. |
|---|
| 32 | 32 | | (b) Subchapter A, Chapter 2267, Government Code, as added by |
|---|
| 33 | 33 | | Chapter 1129 (H.B. 628), Acts of the 82nd Legislature, Regular |
|---|
| 34 | 34 | | Session, 2011, is amended by adding Section 2267.011 to read as |
|---|
| 35 | 35 | | follows: |
|---|
| 36 | 36 | | Sec. 2267.011. EXEMPTION: DEFENSE BASE DEVELOPMENT |

| 37 | 37 | | AUTHORITIES. This chapter does not apply to a defense base |

| 53 | 53 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 54 | 54 | | Act takes effect September 1, 2013. |
