| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Sections 225.021(b) and (c), Transportation |
|---|
| 13 | 13 | | Code, are amended to read as follows: |
|---|
| 14 | 14 | | (b) The department shall [may] accept a grant or donation |
|---|
| 15 | 15 | | made to assist in financing the construction and maintenance of a |
|---|
| 16 | 16 | | marker. |
|---|
| 17 | 17 | | (c) The department may not [is not required to] design, |
|---|
| 18 | 18 | | construct, or erect a marker under this subchapter unless a grant or |
|---|
| 19 | 19 | | donation of funds is made to the department to cover the cost of the |
|---|
| 20 | 20 | | design, construction, and erection of the marker. |

| 21 | 21 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 22 | 22 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 23 | 23 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 24 | 24 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 25 | 25 | | Act takes effect September 1, 2013. |
