99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 4A.108, Business & Commerce Code, is
1111 amended to read as follows:
1212 Sec. 4A.108. RELATIONSHIP TO ELECTRONIC FUND TRANSFER
1313 ACT [EXCLUSION OF CONSUMER TRANSACTIONS GOVERNED BY FEDERAL LAW].
1414 (a) Except as provided in Subsection (b), this [This] chapter does
1515 not apply to a funds transfer any part of which is governed by the
1616 Electronic Fund Transfer Act, 15 U.S.C. Sec. 1693 et seq., as
1717 amended from time to time.
1818 (b) This chapter applies to a funds transfer that is a
1919 remittance transfer as defined in the Electronic Fund Transfer Act
2020 (15 U.S.C. Sec. 1693o-1), as amended from time to time, unless the
2121 remittance transfer is also an electronic fund transfer as defined
2222 in the Electronic Fund Transfer Act (15 U.S.C. Sec. 1693a), as
2323 amended from time to time.
2424 (c) In a funds transfer to which this chapter applies, in
2525 the event of an inconsistency between the applicable provision of
2626 this chapter and an applicable provision of the Electronic Fund
2727 Transfer Act, the applicable provision of the Electronic Fund
2828 Transfer Act governs to the extent of the inconsistency.
2929 SECTION 2. This Act takes effect September 1, 2013.
