99 AN ACT
1010 relating to the responsibility for keeping fire-fighting equipment
1111 furnished to a volunteer fire department by a county in good working
1212 order.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 352.005(e), Local Government Code, is
1515 amended to read as follows:
1616 (e) The petitioner [county] shall keep the fire-fighting
1717 equipment in good working order, [and] make all necessary repairs
1818 or replacements, and provide[. The commissioners court shall
1919 determine if a repair or replacement is necessary and shall require
2020 that repair work, including] labor and materials for repairs[, be
2121 provided as much as possible by the court's shops that it
2222 designates]. The commissioners court may provide the petitioner
2323 with at least one emergency unit of fire-fighting equipment to be
2424 used while the regular unit is being repaired or replaced. The
2525 commissioners court may use an available truck or other equipment
2626 if it is unable to acquire a new truck or equipment for the purpose
2727 of building or equipping the fire-fighting equipment.
2828 SECTION 2. This Act takes effect September 1, 2013.
