13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 14 | | SECTION 1. Section 352.005(e), Local Government Code, is |
---|
15 | 15 | | amended to read as follows: |
---|
16 | 16 | | (e) The petitioner [county] shall keep the fire-fighting |
---|
17 | 17 | | equipment in good working order, [and] make all necessary repairs |
---|
18 | 18 | | or replacements, and provide[. The commissioners court shall |
---|
19 | 19 | | determine if a repair or replacement is necessary and shall require |
---|
20 | 20 | | that repair work, including] labor and materials for repairs[, be |
---|
21 | 21 | | provided as much as possible by the court's shops that it |
---|
22 | 22 | | designates]. The commissioners court may provide the petitioner |
---|
23 | 23 | | with at least one emergency unit of fire-fighting equipment to be |
---|
24 | 24 | | used while the regular unit is being repaired or replaced. The |
---|
25 | 25 | | commissioners court may use an available truck or other equipment |
---|
26 | 26 | | if it is unable to acquire a new truck or equipment for the purpose |
---|
27 | 27 | | of building or equipping the fire-fighting equipment. |
---|
28 | 28 | | SECTION 2. This Act takes effect September 1, 2013. |
