99 AN ACT
1010 relating to the application of the public and private facilities
1111 and infrastructure contracting requirements to technology
1212 facilities.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 2267.001(10), Government Code, as added
1515 by Chapter 1334 (S.B. 1048), Acts of the 82nd Legislature, Regular
1616 Session, 2011, is amended to read as follows:
1717 (10) "Qualifying project" means:
1818 (A) any ferry, mass transit facility, vehicle
1919 parking facility, port facility, power generation facility, fuel
2020 supply facility, oil or gas pipeline, water supply facility, public
2121 work, waste treatment facility, hospital, school, medical or
2222 nursing care facility, recreational facility, public building,
2323 technology facility, or other similar facility currently available
2424 or to be made available to a governmental entity for public use,
2525 including any structure, parking area, appurtenance, and other
2626 property required to operate the structure or facility and any
2727 technology infrastructure installed in the structure or facility
2828 that is essential to the project's purpose; or
2929 (B) any improvements necessary or desirable to
3030 unimproved real estate owned by a governmental entity.
3131 SECTION 2. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2013.
