| 11 | 11 | | relating to certain written information the Windham School District |

| 12 | 12 | | must provide to a person before the person enrolls in a district |
|---|
| 13 | 13 | | vocational training program. |
|---|
| 14 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 15 | | SECTION 1. Chapter 19, Education Code, is amended by adding |
|---|
| 16 | 16 | | Section 19.0042 to read as follows: |
|---|
| 17 | 17 | | Sec. 19.0042. INFORMATION TO BE PROVIDED BY DISTRICT BEFORE |
|---|
| 18 | 18 | | VOCATIONAL TRAINING PROGRAM ENROLLMENT. Before a person described |
|---|
| 19 | 19 | | by Section 19.005 enrolls in a district vocational training |
|---|
| 20 | 20 | | program, the district must inform the person in writing of: |
|---|
| 21 | 21 | | (1) any rule or policy of a state agency that would |
|---|
| 22 | 22 | | impose a restriction or prohibition on the person in obtaining a |
|---|
| 23 | 23 | | certificate or license in connection with the vocational training |
|---|
| 24 | 24 | | program; |
|---|
| 25 | 25 | | (2) the total number of district students released |
|---|
| 26 | 26 | | during the preceding 10 years who have completed a district |
|---|
| 27 | 27 | | vocational training program that allows for an opportunity to apply |
|---|
| 28 | 28 | | for a certificate or license from a state agency and, of those |
|---|
| 29 | 29 | | students: |
|---|
| 30 | 30 | | (A) the number who have applied for a certificate |
|---|
| 31 | 31 | | or license from a state agency; |
|---|
| 32 | 32 | | (B) the number who have been issued a certificate |
|---|
| 33 | 33 | | or license by a state agency; and |
|---|
| 34 | 34 | | (C) the number who have been denied a certificate |
|---|
| 35 | 35 | | or license by a state agency; and |
|---|
| 36 | 36 | | (3) the procedures for: |
|---|
| 37 | 37 | | (A) requesting a criminal history evaluation |
|---|
| 38 | 38 | | letter under Section 53.102, Occupations Code; |
|---|
| 39 | 39 | | (B) providing evidence of fitness to perform the |
|---|
| 40 | 40 | | duties and discharge the responsibilities of a licensed occupation |
|---|
| 41 | 41 | | for purposes of Section 53.023, Occupations Code; and |
|---|
| 42 | 42 | | (C) appealing a state agency's denial of a |
|---|
| 43 | 43 | | certificate or license, including deadlines and due process |
|---|
| 44 | 44 | | requirements: |
|---|
| 45 | 45 | | (i) to the State Office of Administrative |
|---|
| 46 | 46 | | Hearings under Subchapter C, Chapter 2001, Government Code; and |
|---|
| 47 | 47 | | (ii) through any other available avenue. |
|---|
| 48 | 48 | | SECTION 2. Section 19.0042, Education Code, as added by |
|---|
| 49 | 49 | | this Act, applies only regarding enrollment of a person in a Windham |
|---|
| 50 | 50 | | School District vocational training program on or after September |
|---|
| 51 | 51 | | 1, 2013. |
|---|
| 52 | 52 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 53 | 53 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 54 | 54 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 55 | 55 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 56 | 56 | | Act takes effect September 1, 2013. |
