99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to certain written information the Windham School District
1212 must provide to a person before the person enrolls in a district
1313 vocational training program.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Chapter 19, Education Code, is amended by adding
1616 Section 19.0042 to read as follows:
1717 Sec. 19.0042. INFORMATION TO BE PROVIDED BY DISTRICT BEFORE
1818 VOCATIONAL TRAINING PROGRAM ENROLLMENT. Before a person described
1919 by Section 19.005 enrolls in a district vocational training
2020 program, the district must inform the person in writing of:
2121 (1) any rule or policy of a state agency that would
2222 impose a restriction or prohibition on the person in obtaining a
2323 certificate or license in connection with the vocational training
2424 program;
2525 (2) the total number of district students released
2626 during the preceding 10 years who have completed a district
2727 vocational training program that allows for an opportunity to apply
2828 for a certificate or license from a state agency and, of those
2929 students:
3030 (A) the number who have applied for a certificate
3131 or license from a state agency;
3232 (B) the number who have been issued a certificate
3333 or license by a state agency; and
3434 (C) the number who have been denied a certificate
3535 or license by a state agency; and
3636 (3) the procedures for:
3737 (A) requesting a criminal history evaluation
3838 letter under Section 53.102, Occupations Code;
3939 (B) providing evidence of fitness to perform the
4040 duties and discharge the responsibilities of a licensed occupation
4141 for purposes of Section 53.023, Occupations Code; and
4242 (C) appealing a state agency's denial of a
4343 certificate or license, including deadlines and due process
4444 requirements:
4545 (i) to the State Office of Administrative
4646 Hearings under Subchapter C, Chapter 2001, Government Code; and
4747 (ii) through any other available avenue.
4848 SECTION 2. Section 19.0042, Education Code, as added by
4949 this Act, applies only regarding enrollment of a person in a Windham
5050 School District vocational training program on or after September
5151 1, 2013.
5252 SECTION 3. This Act takes effect immediately if it receives
5353 a vote of two-thirds of all the members elected to each house, as
5454 provided by Section 39, Article III, Texas Constitution. If this
5555 Act does not receive the vote necessary for immediate effect, this
5656 Act takes effect September 1, 2013.
