| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 542.402(b-1), Transportation Code, is |
|---|
| 13 | 13 | | amended to read as follows: |
|---|
| 14 | 14 | | (b-1) A [Subject to Subsection (b-2), a] county may use a |
|---|
| 15 | 15 | | fine collected for a violation of a highway law as the county |
|---|
| 16 | 16 | | determines appropriate if: |
|---|
| 17 | 17 | | (1) the county has a population of less than 5,000; and |
|---|
| 18 | 18 | | (2) the commissioners court of the county by |
|---|
| 19 | 19 | | resolution elects to spend the revenue in a manner other than as |
|---|
| 20 | 20 | | provided by Subsection (a). |
|---|
| 21 | 21 | | SECTION 2. Sections 542.402(b), (b-2), (c), (d), (d-1), |
|---|
| 22 | 22 | | (e), (f), and (g), Transportation Code, are repealed. |
|---|
| 23 | 23 | | SECTION 3. The change in law made by this Act to Section |
|---|
| 24 | 24 | | 542.402, Transportation Code, applies only to the fiscal year of a |
|---|
| 25 | 25 | | municipality or county that begins on or after the effective date of |
|---|
| 26 | 26 | | this Act. |
|---|
| 27 | 27 | | SECTION 4. This Act takes effect September 1, 2013. |
