88 A BILL TO BE ENTITLED
99 AN ACT
1010 relating to the enforcement of an order to pay child support by
1111 contempt and the awarding of costs and fees in certain proceedings.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 157.162(b), Family Code, is amended to
1414 read as follows:
1515 (b) A finding that the respondent is not in contempt does
1616 not preclude the court from awarding the petitioner court costs and
1717 reasonable attorney's fees or ordering any other enforcement
1818 remedy, including rendering a money judgment, posting a bond or
1919 other security, or withholding income.
2020 SECTION 2. Sections 157.162(d) and (e), Family Code, are
2121 repealed.
2222 SECTION 3. The repeal by this Act of Sections 157.162(d) and
2323 (e), Family Code, applies to a hearing to enforce an order in a suit
2424 affecting the parent-child relationship that commences on or after
2525 the effective date of this Act. A hearing that commences before the
2626 effective date of this Act is governed by the law in effect on the
2727 date the hearing commenced, and the former law is continued in
2828 effect for that purpose.
2929 SECTION 4. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2013.
