11 | 11 | | contempt and the awarding of costs and fees in certain proceedings. |

12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Section 157.162(b), Family Code, is amended to |
---|
14 | 14 | | read as follows: |
---|
15 | 15 | | (b) A finding that the respondent is not in contempt does |
---|
16 | 16 | | not preclude the court from awarding the petitioner court costs and |
---|
17 | 17 | | reasonable attorney's fees or ordering any other enforcement |
---|
18 | 18 | | remedy, including rendering a money judgment, posting a bond or |
---|
19 | 19 | | other security, or withholding income. |
---|
20 | 20 | | SECTION 2. Sections 157.162(d) and (e), Family Code, are |
---|
21 | 21 | | repealed. |
---|
22 | 22 | | SECTION 3. The repeal by this Act of Sections 157.162(d) and |
---|
23 | 23 | | (e), Family Code, applies to a hearing to enforce an order in a suit |
---|
24 | 24 | | affecting the parent-child relationship that commences on or after |
---|
25 | 25 | | the effective date of this Act. A hearing that commences before the |
---|
26 | 26 | | effective date of this Act is governed by the law in effect on the |
---|
27 | 27 | | date the hearing commenced, and the former law is continued in |
---|
28 | 28 | | effect for that purpose. |
---|
29 | 29 | | SECTION 4. This Act takes effect immediately if it receives |
---|
30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
---|
31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
---|
33 | 33 | | Act takes effect September 1, 2013. |
