88 relating to posting certain information regarding compensation of
99 state agency executive staff on the Internet.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 659, Government Code, is
1212 amended by adding Section 659.026 to read as follows:
1313 Sec. 659.026. INFORMATION REGARDING EXECUTIVE STAFF
1414 COMPENSATION. (a) In this section:
1515 (1) "Compensation" includes an emolument provided in
1616 lieu of base salary or wages or a supplement to base salary or
1717 wages.
1818 (2) "Executive staff" means:
1919 (A) the director, executive director,
2020 commissioner, administrator, or other individual who is appointed
2121 by the governing body of a state agency or by another state officer
2222 to act as the chief executive or administrative head of the agency
2323 and who is not an appointed officer; and
2424 (B) other management or senior level staff
2525 members of a state agency.
2626 (3) "State agency" means a board, commission,
2727 department, institute, office, or other agency in the executive
2828 branch of state government that is created by the constitution or a
2929 statute of this state, including an institution of higher education
3030 as defined by Section 61.003, Education Code.
3131 (b) A state agency shall make available to the public by
3232 posting on the agency's Internet website the agency's methodology,
3333 including any employment market analysis, for determining the
3434 compensation of executive staff employed by the agency at the time
3535 and in the manner provided by the state auditor.
3636 SECTION 2. This Act takes effect immediately if it receives
3737 a vote of two-thirds of all the members elected to each house, as
3838 provided by Section 39, Article III, Texas Constitution. If this
3939 Act does not receive the vote necessary for immediate effect, this
4040 Act takes effect September 1, 2013.
