99 AN ACT
1010 relating to the amount of a chargeback for unemployment
1111 compensation benefits paid to a person who is partially unemployed.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 204.022, Labor Code, is amended by
1414 adding Subsection (a-1) to read as follows:
1515 (a-1) Benefits computed on benefit wage credits of an
1616 employee may not be charged to the account of an employer if the
1717 employee continued to work the employee's customary hours for the
1818 employer when the employee's benefit year began. This subsection
1919 does not apply to a claim for unemployment benefits made under
2020 Chapter 215.
2121 SECTION 2. The change in law made by this Act applies only
2222 to a claim for unemployment compensation benefits filed with the
2323 Texas Workforce Commission on or after the effective date of this
2424 Act. A claim filed before the effective date of this Act is
2525 governed by the law in effect on the date the claim was filed, and
2626 the former law is continued in effect for that purpose.
2727 SECTION 3. This Act takes effect September 1, 2013.
