99 relating to excepting certain vehicle location information from
1010 required disclosure under the public information law.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 552.108, Government Code, is amended by
1313 adding Subsection (b-1) to read as follows:
1414 (b-1) Detailed, aggregated information held by a law
1515 enforcement agency or prosecutor that relates to the location of a
1616 vehicle used for law enforcement is excepted from the requirements
1717 of Section 552.021 if:
1818 (1) the information requested:
1919 (A) would directly or indirectly reveal the
2020 physical location of or route used by more than one peace officer or
2121 vehicles operated by more than one peace officer or in relation to
2222 more than one incident; and
2323 (B) relates to more than a 24-hour period; and
2424 (2) the law enforcement agency determines that the
2525 release of the information may create a hazard to a peace officer,
2626 the public, or another person.
2727 SECTION 2. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect September 1, 2013.
