| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 552.108, Government Code, is amended by |
|---|
| 13 | 13 | | adding Subsection (b-1) to read as follows: |
|---|
| 14 | 14 | | (b-1) Detailed, aggregated information held by a law |
|---|
| 15 | 15 | | enforcement agency or prosecutor that relates to the location of a |
|---|
| 16 | 16 | | vehicle used for law enforcement is excepted from the requirements |
|---|
| 17 | 17 | | of Section 552.021 if: |
|---|
| 18 | 18 | | (1) the information requested: |
|---|
| 19 | 19 | | (A) would directly or indirectly reveal the |
|---|
| 20 | 20 | | physical location of or route used by more than one peace officer or |
|---|
| 21 | 21 | | vehicles operated by more than one peace officer or in relation to |
|---|
| 22 | 22 | | more than one incident; and |
|---|
| 23 | 23 | | (B) relates to more than a 24-hour period; and |
|---|
| 24 | 24 | | (2) the law enforcement agency determines that the |
|---|
| 25 | 25 | | release of the information may create a hazard to a peace officer, |
|---|
| 26 | 26 | | the public, or another person. |
|---|
| 27 | 27 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 31 | 31 | | Act takes effect September 1, 2013. |
