| 7 | 7 | | relating to the reporting of information by a school district |
|---|
| 8 | 8 | | relating to certain offenses committed by certain students. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 37, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 37.023 to read as follows: |
|---|
| 12 | 12 | | Sec. 37.023. REPORTS RELATING TO CERTAIN OFFENSES COMMITTED |
|---|
| 13 | 13 | | BY CERTAIN STUDENTS. (a) In the manner required by the |
|---|
| 14 | 14 | | commissioner and subject to Subsection (b), each school district |
|---|
| 15 | 15 | | shall annually report to the commissioner information relating to |
|---|
| 16 | 16 | | each offense that does not involve the use of a weapon: |
|---|
| 17 | 17 | | (1) committed during school hours on school property |
|---|
| 18 | 18 | | by a student who is younger than 12 years of age; and |
|---|
| 19 | 19 | | (2) for which the student receives a citation. |
|---|
| 20 | 20 | | (b) Conduct that must be reported under Subsection (a) |
|---|
| 21 | 21 | | includes only conduct that: |
|---|
| 22 | 22 | | (1) is not harassment as defined by Section 37.001; |
|---|
| 23 | 23 | | (2) occurs between two students; |
|---|
| 24 | 24 | | (3) is not violent; |
|---|
| 25 | 25 | | (4) involves open-handed physical contact; and |
|---|
| 26 | 26 | | (5) is not intended to cause harm and is playful. |
|---|
| 27 | 27 | | (c) The report required under Subsection (a) must include: |
|---|
| 28 | 28 | | (1) the offense committed by the student; |
|---|
| 29 | 29 | | (2) the age and sex of the student; |
|---|
| 30 | 30 | | (3) the race or ethnicity of the student; |
|---|
| 31 | 31 | | (4) the grade level of the student; and |
|---|
| 32 | 32 | | (5) the campus to which the student is assigned. |
|---|
| 33 | 33 | | (d) The commissioner may adopt rules necessary to implement |
|---|
| 34 | 34 | | this section. |
|---|
| 35 | 35 | | SECTION 2. This Act applies beginning with the 2013-2014 |
|---|
| 36 | 36 | | school year. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 38 | 38 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 39 | 39 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 40 | 40 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 41 | 41 | | Act takes effect September 1, 2013. |
