77 relating to the reporting of information by a school district
88 relating to certain offenses committed by certain students.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 37, Education Code, is
1111 amended by adding Section 37.023 to read as follows:
1212 Sec. 37.023. REPORTS RELATING TO CERTAIN OFFENSES COMMITTED
1313 BY CERTAIN STUDENTS. (a) In the manner required by the
1414 commissioner and subject to Subsection (b), each school district
1515 shall annually report to the commissioner information relating to
1616 each offense that does not involve the use of a weapon:
1717 (1) committed during school hours on school property
1818 by a student who is younger than 12 years of age; and
1919 (2) for which the student receives a citation.
2020 (b) Conduct that must be reported under Subsection (a)
2121 includes only conduct that:
2222 (1) is not harassment as defined by Section 37.001;
2323 (2) occurs between two students;
2424 (3) is not violent;
2525 (4) involves open-handed physical contact; and
2626 (5) is not intended to cause harm and is playful.
2727 (c) The report required under Subsection (a) must include:
2828 (1) the offense committed by the student;
2929 (2) the age and sex of the student;
3030 (3) the race or ethnicity of the student;
3131 (4) the grade level of the student; and
3232 (5) the campus to which the student is assigned.
3333 (d) The commissioner may adopt rules necessary to implement
3434 this section.
3535 SECTION 2. This Act applies beginning with the 2013-2014
3636 school year.
3737 SECTION 3. This Act takes effect immediately if it receives
3838 a vote of two-thirds of all the members elected to each house, as
3939 provided by Section 39, Article III, Texas Constitution. If this
4040 Act does not receive the vote necessary for immediate effect, this
4141 Act takes effect September 1, 2013.
