1010 AN ACT
1111 relating to the creation of the Harris County Municipal Utility
1212 District No. 529; granting a limited power of eminent domain;
1313 providing authority to issue bonds; providing authority to impose
1414 assessments, fees, or taxes.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1717 Code, is amended by adding Chapter 8444 to read as follows:
1818 CHAPTER 8444. HARRIS COUNTY MUNICIPAL UTILITY DISTRICT NO. 529
1919 SUBCHAPTER A. GENERAL PROVISIONS
2020 Sec. 8444.001. DEFINITIONS. In this chapter:
2121 (1) "Board" means the district's board of directors.
2222 (2) "Commission" means the Texas Commission on
2323 Environmental Quality.
2424 (3) "Director" means a board member.
2525 (4) "District" means the Harris County Municipal
2626 Utility District No. 529.
2727 Sec. 8444.002. NATURE OF DISTRICT. The district is a
2828 municipal utility district created under Section 59, Article XVI,
2929 Texas Constitution.
3030 Sec. 8444.003. CONFIRMATION AND DIRECTORS' ELECTION
3131 REQUIRED. The temporary directors shall hold an election to
3232 confirm the creation of the district and to elect five permanent
3333 directors as provided by Section 49.102, Water Code.
3434 Sec. 8444.004. CONSENT OF MUNICIPALITY REQUIRED. The
3535 temporary directors may not hold an election under Section 8444.003
3636 until each municipality in whose corporate limits or
3737 extraterritorial jurisdiction the district is located has
3838 consented by ordinance or resolution to the creation of the
3939 district and to the inclusion of land in the district.
4040 Sec. 8444.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
4141 The district is created to serve a public purpose and benefit.
4242 (b) The district is created to accomplish the purposes of a
4343 municipal utility district as provided by general law and Section
4444 59, Article XVI, Texas Constitution.
4545 Sec. 8444.006. INITIAL DISTRICT TERRITORY. (a) The
4646 district is initially composed of the territory described by
4747 Section 2 of the Act enacting this chapter.
4848 (b) The boundaries and field notes contained in Section 2 of
4949 the Act enacting this chapter form a closure. A mistake made in the
5050 field notes or in copying the field notes in the legislative process
5151 does not affect the district's:
5252 (1) organization, existence, or validity;
5353 (2) right to issue any type of bond for the purposes
5454 for which the district is created or to pay the principal of and
5555 interest on a bond;
5656 (3) right to impose a tax; or
5757 (4) legality or operation.
5858 SUBCHAPTER B. BOARD OF DIRECTORS
5959 Sec. 8444.051. GOVERNING BODY; TERMS. (a) The district is
6060 governed by a board of five elected directors.
6161 (b) Except as provided by Section 8444.052, directors serve
6262 staggered four-year terms.
6363 Sec. 8444.052. TEMPORARY DIRECTORS. (a) The temporary
6464 board consists of:
6565 (1) Joseph Forrester;
6666 (2) Eric Willis;
6767 (3) George Kaleh;
6868 (4) Jennifer Montgomery; and
6969 (5) Dan Quinlan.
7070 (b) Temporary directors serve until the earlier of:
7171 (1) the date permanent directors are elected under
7272 Section 8444.003; or
7373 (2) the fourth anniversary of the effective date of
7474 the Act enacting this chapter.
7575 (c) If permanent directors have not been elected under
7676 Section 8444.003 and the terms of the temporary directors have
7777 expired, successor temporary directors shall be appointed or
7878 reappointed as provided by Subsection (d) to serve terms that
7979 expire on the earlier of:
8080 (1) the date permanent directors are elected under
8181 Section 8444.003; or
8282 (2) the fourth anniversary of the date of the
8383 appointment or reappointment.
8484 (d) If Subsection (c) applies, the owner or owners of a
8585 majority of the assessed value of the real property in the district
8686 may submit a petition to the commission requesting that the
8787 commission appoint as successor temporary directors the five
8888 persons named in the petition. The commission shall appoint as
8989 successor temporary directors the five persons named in the
9090 petition.
9191 SUBCHAPTER C. POWERS AND DUTIES
9292 Sec. 8444.101. GENERAL POWERS AND DUTIES. The district has
9393 the powers and duties necessary to accomplish the purposes for
9494 which the district is created.
9595 Sec. 8444.102. MUNICIPAL UTILITY DISTRICT POWERS AND
9696 DUTIES. The district has the powers and duties provided by the
9797 general law of this state, including Chapters 49 and 54, Water Code,
9898 applicable to municipal utility districts created under Section 59,
9999 Article XVI, Texas Constitution.
100100 Sec. 8444.103. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
101101 OR RESOLUTION. The district shall comply with all applicable
102102 requirements of any ordinance or resolution that is adopted under
103103 Section 54.016 or 54.0165, Water Code, and that consents to the
104104 creation of the district or to the inclusion of land in the
105105 district.
106106 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
107107 Sec. 8444.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
108108 district may issue, without an election, bonds and other
109109 obligations secured by:
110110 (1) revenue other than ad valorem taxes; or
111111 (2) contract payments described by Section 8444.153.
112112 (b) The district must hold an election in the manner
113113 provided by Chapters 49 and 54, Water Code, to obtain voter approval
114114 before the district may impose an ad valorem tax or issue bonds
115115 payable from ad valorem taxes.
116116 Sec. 8444.152. OPERATION AND MAINTENANCE TAX. (a) If
117117 authorized at an election held under Section 8444.151, the district
118118 may impose an operation and maintenance tax on taxable property in
119119 the district in accordance with Section 49.107, Water Code.
120120 (b) The board shall determine the tax rate. The rate may not
121121 exceed the rate approved at the election.
122122 Sec. 8444.153. CONTRACT TAXES. (a) In accordance with
123123 Section 49.108, Water Code, the district may impose a tax other than
124124 an operation and maintenance tax and use the revenue derived from
125125 the tax to make payments under a contract after the provisions of
126126 the contract have been approved by a majority of the district voters
127127 voting at an election held for that purpose.
128128 (b) A contract approved by the district voters may contain a
129129 provision stating that the contract may be modified or amended by
130130 the board without further voter approval.
131131 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
132132 Sec. 8444.201. AUTHORITY TO ISSUE BONDS AND OTHER
133133 OBLIGATIONS. The district may issue bonds or other obligations
134134 payable wholly or partly from ad valorem taxes, impact fees,
135135 revenue, contract payments, grants, or other district money, or any
136136 combination of those sources, to pay for any authorized district
137137 purpose.
138138 Sec. 8444.202. TAXES FOR BONDS. At the time the district
139139 issues bonds payable wholly or partly from ad valorem taxes, the
140140 board shall provide for the annual imposition of a continuing
141141 direct ad valorem tax, without limit as to rate or amount, while all
142142 or part of the bonds are outstanding as required and in the manner
143143 provided by Sections 54.601 and 54.602, Water Code.
144144 SECTION 2. The Harris County Municipal Utility District No.
145145 529 initially includes all the territory contained in the following
146146 area:
147147 TRACT 1
148148 BEING a 54.22 acre tract of land situated in the Joel Wheaton
149149 Survey, A-80, City of Houston, Harris County, Texas, being out of
150150 Lot 3 of Bringhurst Subdivision an unrecorded subdivision and being
151151 all or part of the following ten (10) tracts of land: a called
152152 18.4965 acre tract described and recorded under Harris County
153153 Clerk's File Number (H.C.C.F. No.) V502562, a called 2.9313 acre
154154 tract described and recorded under H.C.C.F. No. Z195460, a called
155155 2.9228 acre tract described and recorded under H.C.C.F. No.
156156 Z162927, a called 3.5932 acre tract described as Tract 1, a called
157157 3.000 acre tract described as Tract 2, a called 4.0403 acre tract
158158 described as Tract 4 all three recorded under H.C.C.F. No. Z167404,
159159 a called 8.211 acre tract described and recorded under H.C.C.F. No.
160160 Z023414, a called 3.4341 acre tract described and recorded under

331331 SECTION 3. (a) The legal notice of the intention to
332332 introduce this Act, setting forth the general substance of this
333333 Act, has been published as provided by law, and the notice and a
334334 copy of this Act have been furnished to all persons, agencies,
335335 officials, or entities to which they are required to be furnished
336336 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
337337 Government Code.
338338 (b) The governor, one of the required recipients, has
339339 submitted the notice and Act to the Texas Commission on
340340 Environmental Quality.
341341 (c) The Texas Commission on Environmental Quality has filed
342342 its recommendations relating to this Act with the governor, the
343343 lieutenant governor, and the speaker of the house of
344344 representatives within the required time.
345345 (d) All requirements of the constitution and laws of this
346346 state and the rules and procedures of the legislature with respect
347347 to the notice, introduction, and passage of this Act are fulfilled
348348 and accomplished.
349349 SECTION 4. (a) If this Act does not receive a two-thirds
350350 vote of all the members elected to each house, Subchapter C, Chapter
351351 8444, Special District Local Laws Code, as added by Section 1 of
352352 this Act, is amended by adding Section 8444.104 to read as follows:
353353 Sec. 8444.104. NO EMINENT DOMAIN POWER. The district may
354354 not exercise the power of eminent domain.
355355 (b) This section is not intended to be an expression of a
356356 legislative interpretation of the requirements of Section 17(c),
357357 Article I, Texas Constitution.
358358 SECTION 5. This Act takes effect immediately if it receives
359359 a vote of two-thirds of all the members elected to each house, as
360360 provided by Section 39, Article III, Texas Constitution. If this
361361 Act does not receive the vote necessary for immediate effect, this
362362 Act takes effect September 1, 2013.
