66 AN ACT
77 relating to the definition of a lock for purposes of the regulation
88 of certain private security companies and occupations.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1702.002, Occupations Code, is amended
1111 by adding Subdivision (13-a) to read as follows:
1212 (13-a) "Lock" means a fastening device that:
1313 (A) is used to secure, regulate, activate, or
1414 control a door, gate, drawer, cabinet, safe, or automobile by means
1515 of a mechanical or electric device, including a latch, bolt, key,
1616 transmitter, card-reader, keypad, or proximity key fob; and
1717 (B) is not monitored by security personnel or
1818 services and does not send a signal to which law enforcement or
1919 emergency services respond.
2020 SECTION 2. This Act takes effect immediately if it receives
2121 a vote of two-thirds of all the members elected to each house, as
2222 provided by Section 39, Article III, Texas Constitution. If this
2323 Act does not receive the vote necessary for immediate effect, this
2424 Act takes effect September 1, 2013.
