| 7 | 7 | | relating to the definition of a lock for purposes of the regulation |

| 8 | 8 | | of certain private security companies and occupations. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 1702.002, Occupations Code, is amended |
|---|
| 11 | 11 | | by adding Subdivision (13-a) to read as follows: |
|---|
| 12 | 12 | | (13-a) "Lock" means a fastening device that: |
|---|
| 13 | 13 | | (A) is used to secure, regulate, activate, or |
|---|
| 14 | 14 | | control a door, gate, drawer, cabinet, safe, or automobile by means |
|---|
| 15 | 15 | | of a mechanical or electric device, including a latch, bolt, key, |
|---|
| 16 | 16 | | transmitter, card-reader, keypad, or proximity key fob; and |
|---|
| 17 | 17 | | (B) is not monitored by security personnel or |
|---|
| 18 | 18 | | services and does not send a signal to which law enforcement or |
|---|
| 19 | 19 | | emergency services respond. |

| 20 | 20 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 21 | 21 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 22 | 22 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 23 | 23 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 24 | 24 | | Act takes effect September 1, 2013. |
