55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the fine or penalty for violation of a municipal rule,
88 ordinance, or police regulation and municipal court jurisdiction to
99 enforce certain violations.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 54.001(b), Local Government Code, is
1212 amended to read as follows:
1313 (b) A fine or penalty for the violation of a rule,
1414 ordinance, or police regulation may not exceed $1,000 [$500].
1515 However, a fine or penalty for the violation of a rule, ordinance,
1616 or police regulation that governs fire safety, zoning, or public
1717 health and sanitation, including dumping of refuse, may not exceed
1818 $4,000 [$2,000].
1919 SECTION 2. Section 29.003(a), Government Code, is amended
2020 to read as follows:
2121 (a) A municipal court, including a municipal court of
2222 record, shall have exclusive original jurisdiction within the
2323 municipality's territorial limits and property owned by the
2424 municipality located in the municipality's extraterritorial
2525 jurisdiction in all criminal cases that:
2626 (1) arise under:
2727 (A) the ordinances of the municipality; or
2828 (B) a resolution, rule, or order of a joint board
2929 operating an airport under Section 22.074, Transportation Code; and
3030 (2) are punishable by a fine not to exceed:
3131 (A) $4,000 [$2,000] in all cases arising under
3232 municipal ordinances or resolutions, rules, or orders of a joint
3333 board that govern fire safety, zoning, or public health and
3434 sanitation, including dumping of refuse; or
3535 (B) $1,000 [$500] in all other cases arising
3636 under a municipal ordinance or a resolution, rule, or order of a
3737 joint board.
3838 SECTION 3. Article 4.14(a), Code of Criminal Procedure, is
3939 amended to read as follows:
4040 (a) A municipal court, including a municipal court of
4141 record, shall have exclusive original jurisdiction within the
4242 territorial limits of the municipality in all criminal cases that:
4343 (1) arise under the ordinances of the municipality;
4444 and
4545 (2) are punishable by a fine not to exceed:
4646 (A) $4,000 [$2,000] in all cases arising under
4747 municipal ordinances that govern fire safety, zoning, or public
4848 health and sanitation, including dumping of refuse; or
4949 (B) $1,000 [$500] in all other cases arising
5050 under a municipal ordinance.
5151 SECTION 4. This Act takes effect September 1, 2013.
