55 A JOINT RESOLUTION
66 proposing a constitutional amendment authorizing the foreclosure
77 of a lien on homestead property for costs incurred by a municipality
88 relating to a dangerous structure on the property.
99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 50, Article XVI, Texas Constitution, is
1111 amended by adding Subsection (a-1) to read as follows:
1212 (a-1) Notwithstanding Subsection (a) of this section, the
1313 homestead of a family, or of a single adult person, is not protected
1414 from forced sale for the payment of the costs incurred by a
1515 municipality to vacate, secure, repair, remove, or demolish a
1616 dangerous structure on the homestead property as authorized by the
1717 legislature by general law.
1818 SECTION 2. This proposed constitutional amendment shall be
1919 submitted to the voters at an election to be held November 5, 2013.
2020 The ballot shall be printed to permit voting for or against the
2121 proposition: "The constitutional amendment authorizing the
2222 foreclosure of a lien on homestead property for the costs incurred
2323 by a municipality to vacate, secure, repair, remove, or demolish a
2424 dangerous structure on the property."
