| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Subchapter G, Chapter 29, Education Code, is |
|---|
| 15 | 15 | | amended by adding Section 29.2021 to read as follows: |
|---|
| 16 | 16 | | Sec. 29.2021. TRANSPORTATION. (a) The school district in |
|---|
| 17 | 17 | | which a student resides shall: |
|---|
| 18 | 18 | | (1) provide to each student attending another school |
|---|
| 19 | 19 | | in the district under this subchapter transportation free of charge |
|---|
| 20 | 20 | | to and from the school the student attends; and |
|---|
| 21 | 21 | | (2) provide to each student attending a school in a |
|---|
| 22 | 22 | | contiguous district under this subchapter transportation free of |
|---|
| 23 | 23 | | charge to and from a site on which the contiguous district and the |
|---|
| 24 | 24 | | district in which the student resides mutually agree. |
|---|
| 25 | 25 | | (b) A school district that provides transportation services |
|---|
| 26 | 26 | | for students under Subsection (a)(1) is entitled to reimbursement |
|---|
| 27 | 27 | | based on the number of actual miles traveled times the per mile rate |
|---|
| 28 | 28 | | authorized by Section 42.155(f). |
|---|
| 29 | 29 | | (c) A school district in which a student resides that |
|---|
| 30 | 30 | | provides transportation to and from a site in accordance with |
|---|
| 31 | 31 | | Subsection (a)(2) is entitled to reimbursement based on the number |
|---|
| 32 | 32 | | of actual miles traveled times the per mile rate authorized by |
|---|
| 33 | 33 | | Section 42.155(f). |
|---|
| 34 | 34 | | (d) A school district contiguous to the district in which a |
|---|
| 35 | 35 | | student resides shall provide to each student that attends a school |
|---|
| 36 | 36 | | in the contiguous district transportation free of charge to and |
|---|
| 37 | 37 | | from the site described in Subsection (a)(2). |

| 38 | 38 | | SECTION 2. Subsection (f), Section 29.203, Education Code, |
|---|
| 39 | 39 | | is repealed. |
|---|
| 40 | 40 | | SECTION 3. This Act takes effect September 1, 2013. |
