66 AN ACT
77 relating to a housing plan developed and certain housing
88 information collected and reported by the Texas Department of
99 Housing and Community Affairs.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subsection (c), Section 2306.072, Government
1212 Code, is amended to read as follows:
1313 (c) The report must include:
1414 (1) a complete operating and financial statement of
1515 the department;
1616 (2) a comprehensive statement of the activities of the
1717 department during the preceding year to address the needs
1818 identified in the state low income housing plan prepared as
1919 required by Section 2306.0721, including:
2020 (A) a statistical and narrative analysis of the
2121 department's performance in addressing the housing needs of
2222 individuals and families of low and very low income;
2323 (B) the ethnic and racial composition of
2424 individuals and families applying for and receiving assistance from
2525 each housing-related program operated by the department; [and]
2626 (C) the department's progress in meeting the
2727 goals established in the previous housing plan, including goals
2828 established with respect to the populations described by Section
2929 2306.0721(c)(1); and
3030 (D) recommendations on how to improve the
3131 coordination of department services to the populations described by
3232 Section 2306.0721(c)(1);
3333 (3) an explanation of the efforts made by the
3434 department to ensure the participation of individuals of low income
3535 and their community-based institutions in department programs that
3636 affect them;
3737 (4) a statement of the evidence that the department
3838 has made an affirmative effort to ensure the involvement of
3939 individuals of low income and their community-based institutions in
4040 the allocation of funds and the planning process;
4141 (5) a statistical analysis, delineated according to
4242 each ethnic and racial group served by the department, that
4343 indicates the progress made by the department in implementing the
4444 state low income housing plan in each of the uniform state service
4545 regions;
4646 (6) an analysis, based on information provided by the
4747 fair housing sponsor reports required under Section 2306.0724 and
4848 other available data, of fair housing opportunities in each housing
4949 development that receives financial assistance from the department
5050 that includes the following information for each housing
5151 development that contains 20 or more living units:
5252 (A) the street address and municipality or county
5353 in which the property is located;
5454 (B) the telephone number of the property
5555 management or leasing agent;
5656 (C) the total number of units, reported by
5757 bedroom size;
5858 (D) the total number of units, reported by
5959 bedroom size, designed for individuals who are physically
6060 challenged or who have special needs and the number of these
6161 individuals served annually;
6262 (E) the rent for each type of rental unit,
6363 reported by bedroom size;
6464 (F) the race or ethnic makeup of each project;
6565 (G) the number of units occupied by individuals
6666 receiving government-supported housing assistance and the type of
6767 assistance received;
6868 (H) the number of units occupied by individuals
6969 and families of extremely low income, very low income, low income,
7070 moderate income, and other levels of income;
7171 (I) a statement as to whether the department has
7272 been notified of a violation of the fair housing law that has been
7373 filed with the United States Department of Housing and Urban
7474 Development, the Commission on Human Rights, or the United States
7575 Department of Justice; and
7676 (J) a statement as to whether the development has
7777 any instances of material noncompliance with bond indentures or
7878 deed restrictions discovered through the normal monitoring
7979 activities and procedures that include meeting occupancy
8080 requirements or rent restrictions imposed by deed restriction or
8181 financing agreements;
8282 (7) a report on the geographic distribution of low
8383 income housing tax credits, the amount of unused low income housing
8484 tax credits, and the amount of low income housing tax credits
8585 received from the federal pool of unused funds from other states;
8686 and
8787 (8) a statistical analysis, based on information
8888 provided by the fair housing sponsor reports required by Section
8989 2306.0724 and other available data, of average rents reported by
9090 county.
9191 SECTION 2. Subsection (c), Section 2306.0721, Government
9292 Code, is amended to read as follows:
9393 (c) The plan must include:
9494 (1) an estimate and analysis of the size and the
9595 different housing needs of the following populations in each
9696 uniform state service region:
9797 (A) individuals and families of moderate, low,
9898 very low, and extremely low income;
9999 (B) individuals with special needs; [and]
100100 (C) homeless individuals;
101101 (D) veterans;
102102 (E) farmworkers;
103103 (F) youth who are aging out of foster care; and
104104 (G) elderly individuals;
105105 (2) a proposal to use all available housing resources
106106 to address the housing needs of the populations described by
107107 Subdivision (1) by establishing funding levels for all
108108 housing-related programs;
109109 (3) an estimate of the number of federally assisted
110110 housing units available for individuals and families of low and
111111 very low income and individuals with special needs in each uniform
112112 state service region;
113113 (4) a description of state programs that govern the
114114 use of all available housing resources;
115115 (5) a resource allocation plan that targets all
116116 available housing resources to individuals and families of low and
117117 very low income and individuals with special needs in each uniform
118118 state service region;
119119 (6) a description of the department's efforts to
120120 monitor and analyze the unused or underused federal resources of
121121 other state agencies for housing-related services and services for
122122 homeless individuals and the department's recommendations to
123123 ensure the full use by the state of all available federal resources
124124 for those services in each uniform state service region;
125125 (7) strategies to provide housing for individuals and
126126 families with special needs in each uniform state service region;
127127 (8) a description of the department's efforts to
128128 encourage in each uniform state service region the construction of
129129 housing units that incorporate energy efficient construction and
130130 appliances;
131131 (9) an estimate and analysis of the housing supply in
132132 each uniform state service region;
133133 (10) an inventory of all publicly and, where possible,
134134 privately funded housing resources, including public housing
135135 authorities, housing finance corporations, community housing
136136 development organizations, and community action agencies;
137137 (11) strategies for meeting rural housing needs;
138138 (12) a biennial action plan for colonias that:
139139 (A) addresses current policy goals for colonia
140140 programs, strategies to meet the policy goals, and the projected
141141 outcomes with respect to the policy goals; and
142142 (B) includes information on the demand for
143143 contract-for-deed conversions, services from self-help centers,
144144 consumer education, and other colonia resident services in counties
145145 some part of which is within 150 miles of the international border
146146 of this state;
147147 (13) a summary of public comments received at a
148148 hearing under this chapter or from another source that concern the
149149 demand for colonia resident services described by Subdivision (12);
150150 (13-a) information regarding foreclosures of
151151 residential property in this state, including the number and
152152 geographic location of those foreclosures; and
153153 (14) any other housing-related information that the
154154 state is required to include in the one-year action plan of the
155155 consolidated plan submitted annually to the United States
156156 Department of Housing and Urban Development.
157157 SECTION 3. Section 51.0022, Property Code, is repealed.
158158 SECTION 4. This Act takes effect immediately if it receives
159159 a vote of two-thirds of all the members elected to each house, as
160160 provided by Section 39, Article III, Texas Constitution. If this
161161 Act does not receive the vote necessary for immediate effect, this
162162 Act takes effect September 1, 2013.
