9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subtitle C, Title 4, Special District Local Laws |
---|
11 | 11 | | Code, is amended by adding Chapter 3912 to read as follows: |
---|
12 | 12 | | CHAPTER 3912. PADRE ISLES MANAGEMENT DISTRICT |
---|
13 | 13 | | SUBCHAPTER A. GENERAL PROVISIONS |
---|
14 | 14 | | Sec. 3912.001. DEFINITIONS. In this chapter: |
---|
15 | 15 | | (1) "Board" means the district's board of directors. |
---|
16 | 16 | | (2) "Bulkhead property" means all bulkheads in the |
---|
17 | 17 | | district owned by the district or owned or previously owned by the |
---|
18 | 18 | | Padre Isles Property Owners Association, including any associated |
---|
19 | 19 | | easements. |
---|
20 | 20 | | (3) "City" means the City of Corpus Christi. |
---|
21 | 21 | | (4) "Director" means a board member. |
---|
22 | 22 | | (5) "District" means the Padre Isles Management |
---|
23 | 23 | | District. |
---|
24 | 24 | | Sec. 3912.002. CREATION AND NATURE OF DISTRICT. The Padre |
---|
25 | 25 | | Isles Management District is a special district created under |
---|
26 | 26 | | Section 59, Article XVI, Texas Constitution. |
---|
27 | 27 | | Sec. 3912.003. PURPOSE; LEGISLATIVE FINDINGS. (a) The |
---|
28 | 28 | | creation of the district is essential to accomplish the purposes of |
---|
29 | 29 | | Sections 52 and 52-a, Article III, and Section 59, Article XVI, |
---|
30 | 30 | | Texas Constitution, and other public purposes stated in this |
---|
31 | 31 | | chapter. By creating the district and in authorizing the city and |
---|
32 | 32 | | other political subdivisions to contract with the district, the |
---|
33 | 33 | | legislature has established a program to accomplish the public |
---|
34 | 34 | | purposes set out in Section 52-a, Article III, Texas Constitution. |
---|
35 | 35 | | (b) The creation of the district is necessary to promote, |
---|
36 | 36 | | develop, encourage, and maintain safety and the public welfare in |
---|
37 | 37 | | the district. |
---|
38 | 38 | | (c) The district is created to supplement and not to |
---|
39 | 39 | | supplant city services provided in the district. |
---|
40 | 40 | | Sec. 3912.004. FINDINGS OF BENEFIT AND PUBLIC PURPOSE. |
---|
41 | 41 | | (a) The district is created to serve a public use and benefit. |
---|
42 | 42 | | (b) All land and other property included in the district |
---|
43 | 43 | | will benefit from the improvements and services to be provided by |
---|
44 | 44 | | the district under powers conferred by Sections 52 and 52-a, |
---|
45 | 45 | | Article III, and Section 59, Article XVI, Texas Constitution, and |
---|
46 | 46 | | other powers granted under this chapter. |
---|
47 | 47 | | (c) The creation of the district is in the public interest |
---|
48 | 48 | | and is essential to further the public purposes of developing and |
---|
49 | 49 | | diversifying the economy of the state. |
---|
50 | 50 | | (d) The district will: |
---|
51 | 51 | | (1) promote the health, safety, and general welfare of |
---|
52 | 52 | | residents, employers, potential employees, employees, visitors, |
---|
53 | 53 | | and consumers in the district, and of the public; |
---|
54 | 54 | | (2) seek and provide needed funding for the district |
---|
55 | 55 | | to preserve, maintain, and enhance the economic health and vitality |
---|
56 | 56 | | of the district territory as a residential community and business |
---|
57 | 57 | | center; and |
---|
58 | 58 | | (3) promote the health, safety, welfare, and enjoyment |
---|
59 | 59 | | of the public by providing for the preservation of bulkhead |
---|
60 | 60 | | property and the navigable waters surrounding Padre Island. |
---|
61 | 61 | | (e) The district will not act as the agent or |
---|
62 | 62 | | instrumentality of any private interest even though the district |
---|
63 | 63 | | will benefit many private interests as well as the public. |
---|
64 | 64 | | Sec. 3912.005. DISTRICT TERRITORY. (a) The district is |
---|
65 | 65 | | initially composed of the territory described by Section 2 of the |
---|
66 | 66 | | Act enacting this chapter. |
---|
67 | 67 | | (b) The boundaries and field notes contained in Section 2 of |
---|
68 | 68 | | the Act enacting this chapter form a closure. A mistake in the |
---|
69 | 69 | | field notes or in copying the field notes in the legislative process |
---|
70 | 70 | | does not affect the district's: |
---|
71 | 71 | | (1) organization, existence, or validity; |
---|
72 | 72 | | (2) right to issue revenue bonds for the purposes for |
---|
73 | 73 | | which the district is created or to pay the principal of and |
---|
74 | 74 | | interest on the bonds; |
---|
75 | 75 | | (3) right to pursue relief funding from any lawful |
---|
76 | 76 | | source, including this state, the federal government, or any |
---|
77 | 77 | | private source; or |
---|
78 | 78 | | (4) legality or operation. |
---|
79 | 79 | | Sec. 3912.006. APPLICABILITY OF MUNICIPAL MANAGEMENT |
---|
80 | 80 | | DISTRICTS LAW. Except as otherwise provided by this chapter, |
---|
81 | 81 | | Chapter 375, Local Government Code, applies to the district. |
---|
82 | 82 | | Sec. 3912.007. CONSTRUCTION OF CHAPTER. This chapter shall |
---|
83 | 83 | | be liberally construed in conformity with the findings and purposes |
---|
84 | 84 | | stated in this chapter. |
---|
85 | 85 | | SUBCHAPTER B. BOARD OF DIRECTORS |
---|
86 | 86 | | Sec. 3912.051. GOVERNING BODY; TERMS. The district is |
---|
87 | 87 | | governed by a board of five voting directors who serve staggered |
---|
88 | 88 | | terms of four years with two or three directors' terms expiring June |
---|
89 | 89 | | 1 of each odd-numbered year. |
---|
90 | 90 | | Sec. 3912.052. QUALIFICATIONS OF DIRECTORS APPOINTED BY |
---|
91 | 91 | | CITY. (a) To be qualified to serve as a director appointed by the |
---|
92 | 92 | | governing body of the city, a person must be: |
---|
93 | 93 | | (1) a resident of the district who is also a registered |
---|
94 | 94 | | voter of the district; |
---|
95 | 95 | | (2) an owner of property in the district; |
---|
96 | 96 | | (3) an owner of stock or a partnership or membership |
---|
97 | 97 | | interest, whether beneficial or otherwise, of a corporate |
---|
98 | 98 | | partnership, limited liability company, or other entity owner of a |
---|
99 | 99 | | direct or indirect interest in property in the district; |
---|
100 | 100 | | (4) an owner of a beneficial interest in a trust, or a |
---|
101 | 101 | | trustee in a trust, that directly or indirectly owns property in the |
---|
102 | 102 | | district; |
---|
103 | 103 | | (5) an agent, employee, or tenant of a person |
---|
104 | 104 | | described by Subdivision (2), (3), or (4); or |
---|
105 | 105 | | (6) an initial director. |
---|
106 | 106 | | (b) Section 49.052, Water Code, does not apply to the |
---|
107 | 107 | | district. |
---|
108 | 108 | | Sec. 3912.053. APPOINTMENT OF DIRECTORS. The governing |
---|
109 | 109 | | body of the city shall appoint directors from persons recommended |
---|
110 | 110 | | by the board. |
---|
111 | 111 | | Sec. 3912.054. VACANCY. The remaining directors shall fill |
---|
112 | 112 | | a vacancy on the board by appointing a person who meets the |
---|
113 | 113 | | qualifications prescribed by Section 3912.052 to serve for the |
---|
114 | 114 | | remainder of the unexpired term. |
---|
115 | 115 | | Sec. 3912.055. DIRECTOR'S OATH OR AFFIRMATION. (a) A |
---|
116 | 116 | | director shall file the director's oath or affirmation of office |
---|
117 | 117 | | with the district, and the district shall retain the oath or |
---|
118 | 118 | | affirmation in the district records. |
---|
119 | 119 | | (b) A director shall file a copy of the director's oath or |
---|
120 | 120 | | affirmation with the secretary of the city. |
---|
121 | 121 | | Sec. 3912.056. OFFICERS. The board shall elect from among |
---|
122 | 122 | | the directors a chair, a vice chair, and a secretary. The offices |
---|
123 | 123 | | of chair and secretary may not be held by the same person. |
---|
124 | 124 | | Sec. 3912.057. COMPENSATION; EXPENSES. A director is not |
---|
125 | 125 | | entitled to compensation, but is entitled to reimbursement for |
---|
126 | 126 | | necessary and reasonable expenses incurred in carrying out the |
---|
127 | 127 | | duties and responsibilities of the board. |
---|
128 | 128 | | Sec. 3912.058. LIABILITY INSURANCE. The district may |
---|
129 | 129 | | obtain and pay for comprehensive general liability insurance |
---|
130 | 130 | | coverage from a commercial insurance company or other source that |
---|
131 | 131 | | protects and insures a director against personal liability and from |
---|
132 | 132 | | all claims relating to: |
---|
133 | 133 | | (1) actions taken by the director in the director's |
---|
134 | 134 | | capacity as a member of the board; |
---|
135 | 135 | | (2) actions and activities taken by the district; or |
---|
136 | 136 | | (3) the actions of others acting on behalf of the |
---|
137 | 137 | | district. |
---|
138 | 138 | | Sec. 3912.059. NO EXECUTIVE COMMITTEE. The board may not |
---|
139 | 139 | | create an executive committee to exercise the powers of the board. |
---|
140 | 140 | | Sec. 3912.060. BOARD MEETINGS. The board shall hold |
---|
141 | 141 | | meetings at a place accessible to the public. |
---|
142 | 142 | | Sec. 3912.061. INITIAL DIRECTORS. (a) The initial board |
---|

---|
158 | 158 | | Sec. 3912.101. GENERAL POWERS AND DUTIES. The district has |
---|
159 | 159 | | the powers and duties necessary to accomplish the purposes for |
---|
160 | 160 | | which the district is created. |
---|
161 | 161 | | Sec. 3912.102. AGREEMENTS; GRANTS. (a) As provided by |
---|
162 | 162 | | Chapter 375, Local Government Code, the district may make an |
---|
163 | 163 | | agreement with or accept a gift, grant, or loan from any person. |
---|
164 | 164 | | (b) The implementation of a project is a governmental |
---|
165 | 165 | | function or service for the purposes of Chapter 791, Government |
---|
166 | 166 | | Code. |
---|
167 | 167 | | Sec. 3912.103. LIABILITY RESULTING FROM DISTRICT ACTION. |
---|
168 | 168 | | An action of the district or the board does not create a liability |
---|
169 | 169 | | against the city or any other political subdivision. |
---|
170 | 170 | | Sec. 3912.104. NO EMINENT DOMAIN POWER. The district may |
---|
171 | 171 | | not exercise the power of eminent domain. |
---|
172 | 172 | | SUBCHAPTER C-1. IMPROVEMENT PROJECTS |
---|
173 | 173 | | Sec. 3912.131. IMPROVEMENT PROJECTS AND SERVICES; |
---|
174 | 174 | | LIMITATIONS. (a) The district may provide, design, construct, |
---|
175 | 175 | | acquire, improve, relocate, operate, maintain, or finance an |
---|
176 | 176 | | improvement project or service described by Subsection (b) using |
---|
177 | 177 | | any money available to the district, or contract with a |
---|
178 | 178 | | governmental or private entity to provide, design, construct, |
---|
179 | 179 | | acquire, improve, relocate, operate, maintain, or finance an |
---|
180 | 180 | | improvement project or service authorized under this chapter and |
---|
181 | 181 | | Chapter 375, Local Government Code. |
---|
182 | 182 | | (b) The district may undertake an improvement project or |
---|
183 | 183 | | service only as necessary to reconstruct, preserve, and maintain |
---|
184 | 184 | | bulkhead property. |
---|
185 | 185 | | Sec. 3912.132. LOCATION OF IMPROVEMENT PROJECT. An |
---|
186 | 186 | | improvement project described by Section 3912.131 must be located |
---|
187 | 187 | | in the district. |
---|
188 | 188 | | Sec. 3912.133. ADDITIONAL DISTRICT DUTIES REGARDING |
---|
189 | 189 | | IMPROVEMENT PROJECTS. The district shall: |
---|
190 | 190 | | (1) submit written notice to the city administrator or |
---|
191 | 191 | | the administrator's designee of the anticipated date construction |
---|
192 | 192 | | of an improvement project will begin; |
---|
193 | 193 | | (2) comply with applicable city ordinances, |
---|
194 | 194 | | resolutions, and regulations when constructing and maintaining an |
---|
195 | 195 | | improvement project; |
---|
196 | 196 | | (3) allow a representative of the city to inspect an |
---|
197 | 197 | | improvement project during construction to assess the project's |
---|
198 | 198 | | compliance with applicable city ordinances, resolutions, and |
---|
199 | 199 | | regulations; |
---|
200 | 200 | | (4) alter an improvement project to comply with |
---|
201 | 201 | | applicable city ordinances, resolutions, and regulations if the |
---|
202 | 202 | | representative of the city provides the district with written |
---|
203 | 203 | | notice that the improvement project does not comply with applicable |
---|
204 | 204 | | city ordinances, resolutions, and regulations; and |
---|
205 | 205 | | (5) obtain any necessary permits from city, county, |
---|
206 | 206 | | state, or federal authorities to construct and maintain an |
---|
207 | 207 | | improvement project. |
---|
208 | 208 | | Sec. 3912.134. LICENSE AND CERTIFICATION REQUIREMENTS. The |
---|
209 | 209 | | district may not contract with or employ a person to plan or |
---|
210 | 210 | | construct an improvement project unless the person is licensed or |
---|
211 | 211 | | certified in an area relating to planning or construction, as |
---|
212 | 212 | | applicable. |
---|
213 | 213 | | SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS |
---|
214 | 214 | | Sec. 3912.151. DISBURSEMENTS AND TRANSFERS OF MONEY. The |
---|
215 | 215 | | board by resolution shall establish the number of directors' |
---|
216 | 216 | | signatures and the procedure required for a disbursement or |
---|
217 | 217 | | transfer of the district's money. |
---|
218 | 218 | | Sec. 3912.152. MONEY USED FOR IMPROVEMENTS OR SERVICES. |
---|
219 | 219 | | The district may acquire, construct, finance, operate, or maintain |
---|
220 | 220 | | an improvement project or service authorized under this chapter and |
---|
221 | 221 | | Chapter 375, Local Government Code, using any money available to |
---|
222 | 222 | | the district, including contract payments from any lawful source. |
---|
223 | 223 | | SUBCHAPTER E. BONDS |
---|
224 | 224 | | Sec. 3912.201. BONDS AND OTHER OBLIGATIONS. (a) The |
---|
225 | 225 | | district may issue, by public or private sale, bonds, notes, or |
---|
226 | 226 | | other obligations payable wholly or partly from district revenue. |
---|
227 | 227 | | (b) In exercising the district's borrowing power, the |
---|
228 | 228 | | district may issue a bond or other obligation in the form of a bond, |
---|
229 | 229 | | note, certificate of participation or other instrument evidencing a |
---|
230 | 230 | | proportionate interest in payments to be made by the district, or |
---|
231 | 231 | | other type of obligation. |
---|
232 | 232 | | (c) District bonds may be secured and made payable wholly or |
---|
233 | 233 | | partly by a pledge of any part of the money the district receives |
---|
234 | 234 | | from improvement revenue or from any other source. |
---|
235 | 235 | | Sec. 3912.202. BOND MATURITY. Bonds may mature not more |
---|
236 | 236 | | than 30 years from their date of issue. |
---|
237 | 237 | | SUBCHAPTER F. DISSOLUTION |
---|
238 | 238 | | Sec. 3912.251. DISSOLUTION BY CITY ORDINANCE. (a) The |
---|
239 | 239 | | city by ordinance may dissolve the district. |
---|
240 | 240 | | (b) The city may not dissolve the district until the |
---|
241 | 241 | | district's outstanding debt or contractual obligations that are |
---|
242 | 242 | | payable from any source available to the district have been repaid |
---|
243 | 243 | | or discharged, or the city has affirmatively assumed the obligation |
---|
244 | 244 | | to pay the outstanding debt from city revenue. |
---|
245 | 245 | | Sec. 3912.252. COLLECTION OF REVENUE. If the dissolved |
---|
246 | 246 | | district has bonds or other obligations outstanding secured by and |
---|
247 | 247 | | payable from district revenue, the city shall succeed to the rights |
---|
248 | 248 | | and obligations of the district regarding enforcement and |
---|
249 | 249 | | collection of the revenue. |
---|
250 | 250 | | SECTION 2. The Padre Isles Management District initially |

251 | 251 | | includes all territory contained in the following area: |
