77 relating to matching private grants given to enhance additional
88 research activities at institutions of higher education.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subsections (a) and (b), Section 62.123,
1111 Education Code, are amended to read as follows:
1212 (a) An eligible institution that receives gifts or
1313 endowments from private sources in a state fiscal year for the
1414 purpose of enhancing research activities at the institution,
1515 including a gift or endowment for endowed chairs, professorships,
1616 facilities, equipment, program costs, [or] graduate stipends or
1717 fellowships, or undergraduate research, is entitled to receive, out
1818 of funds appropriated for the purposes of the program for that
1919 fiscal year, a matching grant in an amount determined according to
2020 the following rates:
2121 (1) 50 percent of the amount of the gifts and
2222 endowments, if the total amount of gifts and endowments is $100,000
2323 or more but not more than $999,999;
2424 (2) 75 percent of the amount of the gifts and
2525 endowments, if the total amount of gifts and endowments is $1
2626 million or more but not more than $1,999,999; or
2727 (3) 100 percent of the amount of the gifts and
2828 endowments, if the total amount of gifts and endowments is $2
2929 million or more.
3030 (b) An eligible institution is not entitled to matching
3131 funds under the program for:
3232 (1) a gift that has been pledged but has not been
3333 received by the institution;
3434 (2) a gift for undergraduate scholarships or financial
3535 aid grants; or
3636 (3) any portion of gifts or endowments received by the
3737 institution from a single source in a state fiscal year in excess of
3838 $10 million.
3939 SECTION 2. This Act takes effect September 1, 2013.
