 A BILL TO BE ENTITLED
 AN ACT
 relating to certain staff-to-child ratios applicable to
 nonresidential child-care facilities.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 42.042, Human Resources Code, is amended
 by adding Subsection (m-1) to read as follows:
 (m-1)  In determining the minimum standards relating to
 staff-to-child ratios applicable to nonresidential child-care
 facilities that provide care for less than 24 hours a day, the
 department may not establish a staff-to-child ratio that exceeds:
 (1)  one staff member per nine children who are two
 years of age; and
 (2)  one staff member per 14 children who are three
 years of age.
 SECTION 2.  Not later than December 1, 2013, the executive
 commissioner of the Health and Human Services Commission shall
 adopt any rules necessary to implement Section 42.042(m-1), Human
 Resources Code, as added by this Act.
 SECTION 3.  This Act takes effect September 1, 2013.
