77 relating to the use of real property by the University of
88 Houston--Sugar Land.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The legislature finds that the transfer of real
1111 property, on which the University of Houston--Sugar Land is now
1212 located, to the University of Houston System by the Texas
1313 Department of Transportation pursuant to Chapter 1243 (H.B. 1961),
1414 Acts of the 75th Legislature, Regular Session, 1997, was made in the
1515 public interest and continues to serve all public purposes of the
1616 state listed in Subsection (a), Section 1 of Chapter 1243.
1717 SECTION 2. The legislature finds that:
1818 (1) the public purpose requirements placed on the
1919 property transferred pursuant to Chapter 1243 are served if the
2020 property is used for higher education purposes that encompass more
2121 than strictly academic pursuits; and
2222 (2) the language in Chapter 1243 that required the
2323 property to be used "only for higher education purposes" is
2424 misleading to the extent that it may be construed to imply that the
2525 property is reserved for strictly academic pursuits.
2626 SECTION 3. To clarify the intent of the legislature and in
2727 accordance with the findings made by this Act, the ownership and
2828 transfer documents for the property shall be amended to state that
2929 the University of Houston--Sugar Land shall use the property "for
3030 higher education purposes" consistent with the purposes of the
3131 university.
3232 SECTION 4. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2013.
