7 | 7 | | relating to the use of real property by the University of |

8 | 8 | | Houston--Sugar Land. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. The legislature finds that the transfer of real |
---|
11 | 11 | | property, on which the University of Houston--Sugar Land is now |
---|
12 | 12 | | located, to the University of Houston System by the Texas |
---|
13 | 13 | | Department of Transportation pursuant to Chapter 1243 (H.B. 1961), |
---|
14 | 14 | | Acts of the 75th Legislature, Regular Session, 1997, was made in the |
---|
15 | 15 | | public interest and continues to serve all public purposes of the |
---|
16 | 16 | | state listed in Subsection (a), Section 1 of Chapter 1243. |
---|
17 | 17 | | SECTION 2. The legislature finds that: |
---|
18 | 18 | | (1) the public purpose requirements placed on the |
---|
19 | 19 | | property transferred pursuant to Chapter 1243 are served if the |
---|
20 | 20 | | property is used for higher education purposes that encompass more |
---|
21 | 21 | | than strictly academic pursuits; and |
---|
22 | 22 | | (2) the language in Chapter 1243 that required the |
---|
23 | 23 | | property to be used "only for higher education purposes" is |
---|
24 | 24 | | misleading to the extent that it may be construed to imply that the |
---|
25 | 25 | | property is reserved for strictly academic pursuits. |
---|
26 | 26 | | SECTION 3. To clarify the intent of the legislature and in |
---|
27 | 27 | | accordance with the findings made by this Act, the ownership and |
---|
28 | 28 | | transfer documents for the property shall be amended to state that |
---|
29 | 29 | | the University of Houston--Sugar Land shall use the property "for |
---|
30 | 30 | | higher education purposes" consistent with the purposes of the |
---|
31 | 31 | | university. |
---|
32 | 32 | | SECTION 4. This Act takes effect immediately if it receives |
---|
33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
---|
34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
---|
36 | 36 | | Act takes effect September 1, 2013. |
