10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Section 73.115, Education Code, is amended by | |
12 | 12 | adding Subsection (g) to read as follows: | |
13 | 13 | (g) In any contract for the acquisition of goods or services | |
14 | 14 | to which the institution is a party, a provision required by | |
15 | 15 | applicable law to be included in the contract is considered to be a | |
16 | 16 | part of the executed contract without regard to: | |
17 | 17 | (1) whether the provision appears on the face of the | |
18 | 18 | contract; or | |
19 | 19 | (2) whether the contract includes any provision to the | |
20 | 20 | contrary. | |
21 | 21 | SECTION 2. This Act takes effect immediately if it receives | |
22 | 22 | a vote of two-thirds of all the members elected to each house, as | |
23 | 23 | provided by Section 39, Article III, Texas Constitution. If this | |
24 | 24 | Act does not receive the vote necessary for immediate effect, this | |
25 | 25 | Act takes effect September 1, 2013. |
